Regulations of Sichuan Province on the Protection of Chishui River Basin

Chapter I General Provisions Article 1 In order to strengthen the protection of Chishui River Basin, promote the rational and efficient utilization of resources, ensure ecological security, promote green development, and realize the harmonious coexistence between man and nature, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Protection of the Yangtze River and the Law of People's Republic of China (PRC) on the Prevention and Control of Water Pollution, combined with the actual situation in Sichuan Province. Article 2 These Regulations shall apply to the protection and restoration of the ecological environment in Chishui River Basin, as well as various activities such as production, life, development and construction. Where relevant laws and regulations have other provisions on drinking water source protection areas, nature reserves and other special areas, such provisions shall prevail.

The Chishui River Basin as mentioned in these Regulations refers to the catchment area formed by the main stream of Chishui River and its tributaries within the administrative areas of Hejiang County, xuyong county County and Gulin County, Luzhou City, Sichuan Province. The specific scope is delineated by the provincial people's government and announced to the public. Article 3 The economic and social development of Chishui River Basin should actively serve and integrate into the development strategy of the Yangtze River Economic Belt, adhere to ecological priority and green development, pay attention to protection and not engage in large-scale development; The protection of Chishui River basin should adhere to overall coordination, scientific planning, innovation-driven and systematic management. Article 4 The provincial people's governments and the people's governments of Luzhou City, Hejiang County, xuyong county and Gulin County (hereinafter referred to as the local people's governments at or above the county level in Chishui River Basin) shall strengthen their leadership over the protection of Chishui River Basin, incorporate the protection of Chishui River Basin into the national economic and social development plan, and improve and implement the system of river length, lake length and forest length. Responsibility system and assessment system for ecological environmental protection, formulate and improve the protection objectives of Chishui River Basin, and incorporate the responsibility for ecological environmental protection into the work nature of people's governments at all levels.

The relevant departments of the local people's governments at or above the county level, township (town) people's governments and sub-district offices in Chishui River Basin shall do a good job in the protection of Chishui River Basin according to their respective responsibilities.

The village (neighborhood) committees in Chishui River Basin shall assist the township (town) people's governments and sub-district offices in the protection of Chishui River Basin. Article 5 The provincial people's government shall establish and improve the coordination mechanism of Chishui River Basin, coordinate and solve major problems in the protection of Chishui River Basin, and strengthen cross-regional cooperation with neighboring provinces in construction, ecological compensation, industrial cooperation, emergency response and joint law enforcement.

The relevant departments of the provincial people's government and the people's governments of Luzhou City, Hejiang County, xuyong county City and Gulin County are responsible for the implementation of the decision-making and deployment of the Chishui River Basin coordination mechanism and do a good job in related work. Article 6 The local people's governments at or above the county level in Chishui River Basin shall appropriately tilt towards Chishui River Basin when arranging funds and projects such as ecological construction, environmental protection, cultural protection, ecological migration, agriculture, water conservancy, public service facilities construction and tourism.

Actively guide and encourage social capital to participate in the protection of Chishui River Basin. Article 7 The local people's governments at or above the county level in Chishui River Basin shall implement the compensation system for ecological protection in the Yangtze River Basin according to law, explore the compensation for horizontal ecological protection in Chishui River Basin, and establish and improve a market-oriented, diversified and sustainable compensation system for ecological protection in Chishui River Basin. Article 8 The Standing Committee of the local people's congress at or above the county level in Chishui River Basin shall supervise the protection of Chishui River Basin according to law.

The local people's governments at or above the county level in Chishui River Basin shall regularly report the protection of Chishui River Basin to the people's congresses at the corresponding levels or their standing committees.

The township (town) people's government of Chishui River Basin shall report to the township (town) people's congress on the protection of Chishui River Basin. Article 9 Township (town) people's governments and sub-district offices in Chishui River Basin can strengthen the protection of Chishui River Basin by purchasing grass-roots public services and setting up public welfare posts.

Encourage village rules and regulations to make provisions for the protection of Chishui River basin. Article 10 The local people's governments at or above the county level in Chishui River Basin and their relevant departments shall disclose the relevant information on the ecological environment protection in Chishui River Basin according to law, improve the procedures for public participation, and provide convenience for citizens, legal persons and unincorporated organizations to participate in and supervise the ecological environment protection in Chishui River Basin.

Encourage and support units and individuals to participate in the activities of ecological environment protection, rational utilization of resources and promoting green development in Chishui River Basin.

Encourage and support the scientific and technological research, development, popularization and application of ecological environment protection and restoration in Chishui River Basin. Article 11 The local people's governments at or above the county level in Chishui River Basin and their relevant departments, township (town) people's governments and sub-district offices shall strengthen the publicity, education and scientific popularization of ecological environment protection and green development in Chishui River Basin, and enhance the public's awareness of ecological environment protection.

The news media should take various forms to carry out publicity and education on ecological environment protection and green development in Chishui River Basin, and supervise illegal activities by public opinion according to law.

All units and individuals have the obligation to protect the ecological environment of Chishui River basin, and have the right to dissuade, report and accuse acts that destroy the ecological environment of the basin according to law. For acts that pollute the environment, destroy the ecology and harm the public interest, the organs prescribed by the state or organizations prescribed by law may bring environmental public interest litigation to the people's court according to law.

The local people's governments at or above the county level in Chishui River Basin and their relevant departments shall, in accordance with the relevant provisions of the state and the province, commend and reward the units and individuals that have made outstanding contributions to the protection of Chishui River Basin.
