The sixth chapter is the formulation and construction of ecological environment protection regulations in Qinling Mountains of Shaanxi Province.

Article 43 The provincial development and reform, land and resources administrative departments shall, according to the overall planning of Qinling mineral resources distribution and ecological environment protection, prepare the development plan of Qinling mineral resources according to the statutory authority, and submit it to the provincial people's government for approval after being audited by the Qinling Ecological Environment Protection Committee.

The new construction, expansion and reconstruction of Qinling mineral resources development projects shall meet the requirements of Qinling mineral resources development planning and ecological environment protection.

Article 44 It is forbidden to explore and develop mineral resources in nature reserves, scenic spots, forest parks, botanical gardens, important geological relics protection areas and key cultural relics protection areas.

Forty-fifth mineral resources development units should adopt advanced technologies and processes to improve the comprehensive utilization of resources and reduce pollutant emissions.

Mineral resources development units shall not adopt backward technologies and equipment explicitly eliminated by the state. The people's governments at or above the county level shall, in accordance with the management authority, order the transformation, suspension of production or closure within a time limit if the completed projects adopt backward technologies or equipment and cause serious impact and damage to the ecological environment.

Forty-sixth due to the development of mineral resources caused by ecological environment damage and geological disasters, the development unit shall bear the responsibility of governance and compensation according to law.

If the development unit fails to perform the responsibility of governance or governance does not meet the requirements, the relevant administrative departments shall organize governance on its behalf, and the expenses required shall be borne by the development unit.

Article 47 Units that exploit mineral resources in Qinling Mountains shall conduct environmental impact assessment in accordance with the Law of the People's Republic of China on Environmental Impact Assessment. The project construction unit shall, according to the requirements of the environmental impact assessment document, prepare the ecological environment control plan, which shall be implemented after being examined and approved by the environmental protection administrative department at or above the county level in conjunction with other relevant departments.

Units engaged in the development of mineral resources in Qinling Mountains shall withdraw the environmental control deposit for the implementation of the ecological environment control plan of their own units. The environmental governance deposit shall be managed according to the principles of enterprise ownership, earmarking, special account storage and government supervision. Specific measures shall be formulated by the provincial people's government.

Article 48 The exploitation of mineral resources in Qinling Mountains shall implement the compensation system for comprehensive management of ecological environment, and the development unit shall pay compensation for comprehensive management of ecological environment for water system damage, water loss, water pollution, vegetation damage, soil erosion, ecological degradation and land damage. Compensation fees for comprehensive management of ecological environment should be included in financial budget management. Specific collection standards and management measures shall be formulated by the provincial people's government. Article 49 The construction of traffic facilities in Qinling Mountains shall conform to the requirements of the overall planning of ecological environment protection in Qinling Mountains, and the construction of highways in Qinling Mountains shall avoid or reduce the damage to the ecological environment.

Article 50 The construction of traffic facilities in Qinling Mountains shall implement various ecological environmental protection measures proposed in the environmental impact assessment document, and shall not occupy or occupy less forest land. Engineering environmental supervision shall be implemented for construction projects with long construction period and great impact on the ecological environment.

The construction unit shall do a good job in greening on both sides of the road, effectively control the borrow yard and garbage dump, and shall not dump wastes into rivers, lakes, reservoirs and other water bodies.

Article 51 When building traffic facilities, measures should be taken to protect the biodiversity and water conservation function of Qinling Mountains.

The construction of traffic facilities should take protective measures such as building wildlife passages to reduce the impact on wildlife habitat environment.

Fifty-second nature reserves, scenic spots and forest parks in the road design should be audited by the relevant administrative departments of the province. Article 53 The people's governments of cities and counties where the Qinling Mountains are located shall compile and revise the overall planning of towns and villages, and link it with the overall planning of land use and the overall planning of ecological environment protection in Qinling Mountains, and implement the management measures for prohibiting and restricting development zones in the Qinling Ecological Function Zone.

Fifty-fourth strictly control the real estate development in the Qinling Mountains. Engaged in real estate development in the restricted development zone of Qinling Ecological Function Zone and the construction control zone designated by the municipal people's government with districts shall be approved by the municipal people's government with districts and reported to the provincial construction administrative department for the record.

Article 55 The design and construction of urban and rural buildings and environmental facilities in Qinling area shall be in harmony with the local ecological environment.

Fifty-sixth real estate development and construction and other commercial projects in Qinling Mountains shall be submitted for approval in accordance with the prescribed procedures, and environmental impact assessment shall be carried out. Do not meet the requirements of environmental impact assessment, shall not be built.

Article 57 The people's governments at or above the county level where the Qinling Mountains are located shall, according to the needs of economic and social development and ecological environment protection in the Qinling Mountains, formulate plans for the relocation of immigrants, organize their implementation in a planned and step-by-step manner, and do a good job in resettlement.

Fifty-eighth towns in Qinling Mountains should gradually establish and improve public facilities such as domestic sewage treatment, harmless treatment of domestic garbage, water supply and drainage, and promote the use of biogas in rural areas in Qinling Mountains. Villages with relatively concentrated population should strengthen ecological environment protection and public health management, and make unified planning and construction of collection and treatment facilities such as domestic garbage and sewage discharge.

Article 59 Prohibited development zones, restricted development zones and construction control zones designated by the Municipal People's Government with districts in the Qinling Ecological Function Zone shall not be built or expanded, and the expansion and reconstruction of religious activities in other places shall meet the requirements of Qinling ecological environment protection and urban and rural construction planning. Article 60 The municipal people's government with districts where Qinling Mountain is located shall, according to the overall planning of Qinling Mountain's ecological environment protection, formulate a special plan for Qinling Mountain tourism in its administrative area, which shall be considered by the Qinling Mountain Ecological Environment Protection Committee and implemented after being submitted to the provincial people's government for approval.

Article 61 To engage in tourism development in Qinling Mountains, a plan for tourism development and tourism facilities construction shall be formulated according to the special tourism plan, and implemented after being submitted to the relevant administrative departments of the people's governments at or above the county level for examination and approval. If a cableway needs to be built, an environmental impact assessment shall be conducted according to law and submitted to the provincial people's government for approval.

Sixty-second Qinling scenic spots should be scientifically designed, coordinated with the local ecological environment, and rationally utilize ecological resources and tourism resources.

The people's governments at or above the county level shall order the tourist attractions and facilities harmful to the natural ecological environment and landscape to be closed or dismantled within a time limit.

Article 63 The county-level tourism administrative department where Qinling Mountain is located shall make unified planning and rational layout for rural tourism. Where rural tourism operations are concentrated, domestic garbage and sewage should be treated in a unified way.

Sixty-fourth Qinling Scenic Area should strengthen public health management, classify and collect domestic garbage, and manage it by special personnel for unified treatment. It is forbidden to discard and pile up at will.

People and tourists entering Qinling Mountain are not allowed to throw away wastes at will to pollute the environment.

Sixty-fifth Qinling Scenic Area should give priority to the use of clean energy such as electric energy, solar energy, wind energy, hydropower, natural gas and liquefied gas; Tourist buses and other service facilities shall meet the requirements of environmental protection.
