The Measures emphasize that the approval of the right to use rural residential land should follow the principles of unified planning, rational layout and economical and intensive land use. Strictly implement the system of "one household, one house", and villagers should dismantle abandoned old houses in time after building new houses, and reclaim and restore greening; It is forbidden to occupy basic farmland to build houses. Strictly control the occupation of non-basic farmland to build houses; It is forbidden for villagers to build houses in the identified hidden danger areas of geological and other natural disasters and the prohibited construction areas set by the overall land use planning; Urban residents are prohibited from buying homesteads and building houses in rural areas. Encourage villagers to make full use of the original homestead, village homestead and unused land to build houses in combination with the transformation of old villages and land improvement. There are unused land, idle homesteads and study places in the village, and it is not allowed to occupy cultivated land to build houses. The "Measures" stipulate that if one of the following conditions is met, villagers can apply for rural homesteads on a household basis: if members of village collective organizations really need to be divided into households due to marriage and other reasons (parents must have a child beside them after household separation), they need to build houses in places without homesteads after household separation; Members of village collective organizations need to build houses, and there is no homestead or the original homestead area does not meet the standard and promises to expand houses within the standard area of homestead; Due to natural disasters and accidents, new rural construction, resettlement, planning adjustment, requisition of original homestead, etc. , need to move and build new houses; Move into the village collective organization and become a full member and have no homestead in their original place; Loss of the original homestead due to irresistible factors such as natural reasons; Due to the increase of population, the existing homestead area can't meet the living demand. The area of rural homestead shall not exceed 100 square meters in plain areas and urban suburbs, and shall not exceed 150 square meters in hilly areas and mountainous areas.

Legal objectivity:

Article 13 of the Measures for the Administration of Rural Homestead may apply for a homestead under any of the following circumstances: (1) It needs to be relocated or rebuilt due to national or collective construction, relocation or disaster; (two) the implementation of city, village and market town planning or the transformation of old villages, the need to adjust the demolition; (three) the existing homestead area has not yet reached the quota standard stipulated in these measures and needs to be rebuilt or expanded; (four) with household conditions and the original homestead area has not yet reached the limit standard stipulated in these measures, which needs to be rebuilt or expanded; (five) with the approval of the county people's government, the professional and technical personnel introduced or recruited by rural collective economic organizations really need to settle in rural areas; (six) retired workers, demobilized soldiers and overseas Chinese, their relatives, Hong Kong, Macao and Taiwan compatriots with legal documents to return to their original places to settle down; (seven) as otherwise provided by laws, regulations and rules.
