Legal analysis: The administrative department of construction in the State Council supervises and manages the urban house demolition in China. The local people's governments at or above the county level shall be responsible for the management of house demolition (hereinafter referred to as the house demolition management department) to supervise and manage the urban house demolition work within their respective administrative areas.

House demolition refers to the activities that the construction unit or individual demolishes the houses on the existing construction land, resettles the owners or users of the houses and gives some compensation according to the needs of national construction, urban transformation, city appearance improvement and environmental protection.

Article 28 If the expropriated person does not apply for administrative reconsideration or bring an administrative lawsuit within the statutory time limit, and does not move within the time limit stipulated in the compensation decision, the people's government at the city or county level that made the decision on house expropriation shall apply to the people's court for compulsory execution according to law.

The application for compulsory execution shall be accompanied by the amount of compensation, the account number of the special account, the location and area of the property right exchange house and the turnover house.
