According to the spirit of the Notice of Chongqing Municipal People's Government on Relevant Matters Concerning the Adjustment of Land Acquisition Compensation and Resettlement Policy (Yu Fu Fa [2008] No.45), combined with the reality of Yubei District, the following implementation opinions are formulated.
First, the regional division of land acquisition compensation and resettlement standards
According to the economic and social development of towns and streets in Yubei District (excluding the northern new district), the regional categories of land acquisition compensation and resettlement standards in the whole district are adjusted to two categories.
Class I areas: Longxi Street, Long Ta Street, Longshan Street, Huixing Street, Shuangfengqiao Street, Shuanglong Lake Street, Yuelai Street, Muer Town, Gulu Town and Yufeng Mountain Town.
Category II: Dawan Town, Cizhu Town, Xinglong Town, Tongjing Town, Longxing Town, Luo Qi Town, Shichuan Town and Sheng Da Town.
Second, land compensation and resettlement subsidies.
Land compensation fees and resettlement subsidies are calculated separately. The land compensation fee is calculated according to the area of the expropriated land regardless of land type, and the standard of land compensation fee in the first-class area is per mu 16000 yuan; The land compensation standard for the second-class area is per mu 15000 yuan. The resettlement subsidy is calculated according to the number of non-resettlement agricultural population, and the resettlement subsidy standard for each non-resettlement agricultural population is 28,000 yuan.
Land compensation fee is the compensation obtained by rural collective economic organizations whose land has been expropriated. 80% of the total land compensation fee is first used as a whole for landless farmers to participate in the basic old-age insurance for urban enterprise employees, and the land administrative department will allocate it to the labor and social security department on their behalf; The remaining 20% is paid to the rural collective economic organizations whose land has been expropriated, which is used to develop the collective economy and arrange the production and life of the members of the collective economic organizations.
The payment of resettlement subsidies is determined according to the different age groups of landless farmers. If the land acquisition compensation and resettlement plan is approved according to law, the resettlement subsidy will be paid in full to individuals under the age of 16. Individuals who have reached the age of 16 and above shall pay 50% of the total cost of participating in the basic old-age insurance for employees of urban enterprises in accordance with relevant regulations, and the land administrative departments shall allocate it to the labor and social security departments from their resettlement subsidies to be earmarked for the basic old-age insurance for landless farmers, and the rest of the resettlement subsidies shall be paid to individuals to arrange their production and life.
If 80% of the land compensation fee and the monks who pay the basic old-age insurance fee can't meet the capital demand of the landless peasants to participate in the basic old-age insurance, the difference will be made up by the land-expropriated units until the capital demand of the landless peasants to participate in the basic old-age insurance is met.
Third, young crops compensation.
The young crops compensation standard shall be implemented according to the young crops compensation standard for land requisition in Yubei District (see attached table 1).
Fourth, the structure (attachment) compensation
Within the scope of land acquisition, the structures (attachments) on the collective land owned by the town street and village collective economic organizations shall be compensated according to the facts; The structures (attached) on the collective land (including the homestead) of the villagers' group can be cleaned up according to the facts or compensated in a comprehensive quota, and the villagers' group can choose one of them uniformly.
(a) according to the facts to clean up the compensation. Clean up and register in accordance with the relevant documents, and calculate the compensation according to the Compensation Standard for Scattered Planting of Trees and Flowers in Yubei District (see Schedule 2) and the Compensation Standard for Land Acquisition in Yubei District (see Schedule 3).
(2) Comprehensive quota compensation
1. Comprehensive fixed compensation for buildings (attachments) owned by villagers' groups. According to the approved land area, the compensation is calculated according to the standard of 2200 yuan/mu. Compensation fees shall be directly allocated to villagers' groups by land administrative departments, and shall be allocated and managed according to regulations.
2. The comprehensive fixed compensation for buildings (attachments) on the expropriated collective land is calculated according to the Comprehensive Fixed Compensation Standard for Buildings (Attachments) on the expropriated land in Yubei District (see Table 4) based on the per capita land area of the expropriated villagers' group and combined with the regional categories. The compensation fee shall be paid by the land administrative department to the villagers' group, and the villagers' group shall make compensation according to the regulations.
3. Personal living facilities within the scope of land acquisition shall be compensated according to the standard of 2000 yuan per household.
Verb (abbreviation of verb) housing compensation
(a) housing compensation standards according to the "Yubei District land acquisition housing demolition compensation standards" (see Annex 5).
(II) If the houses of the land-expropriated farmers have not been demolished and are not included in the housing resettlement targets, the land-expropriated units shall pay a one-time comprehensive compensation for the occupation of the homestead to the land-expropriated villagers' groups according to the area of the homestead registered with the ownership certificate of the land and houses held by the farmers and the standard of 16000 yuan/mu.

(a) the per capita construction area of rural residents' housing resettlement for land acquisition and demolition is 30 square meters. 1 The resettlement standard for natural houses is the building area15m2.
(two) housing placement can take the form of unified preferential housing placement and monetary placement, and the housing placement object can apply for one of them on a household basis.
(3) Actively promote housing monetary resettlement. The housing monetary resettlement fund is equal to the housing monetary resettlement price of the town (street) where the land is expropriated when performing the housing monetary resettlement contract multiplied by the construction area to be resettled.
(4) The construction and installation cost, comprehensive cost, ordinary commercial housing price and housing monetary resettlement price of resettlement houses shall be approved and published by the district construction, housing management, price and land departments.
(five) in the city (town) planning area, the self-built housing placement is not implemented.
Seven, the method to determine the amount of land acquisition.
If all the land of a collective economic organization is expropriated, all members of the collective economic organization will move from rural areas to cities and towns; If the land of collective economic organizations is partially expropriated, the number of farmers converted to non-agriculture shall be calculated and determined according to the sum of the expropriated cultivated land area (the area of orchards and pastures is calculated according to the cultivated land area, the same below) multiplied by the non-cultivated land area divided by 0.5 times the per capita cultivated land area of the expropriated collective economic organizations. The per capita cultivated land area is the cultivated land area recorded in the collective land ownership certificate (excluding the expropriated cultivated land area) divided by the total population of rural collective economic organizations.
When the land of the collective economic organization is partially expropriated, and the contracted farmland of the landless farmers is expropriated, and the remaining cultivated land area is less than 0.5 mu per household, the landless farmers may separately apply to increase the number of farmers in rural areas in accordance with the above provisions until the remaining cultivated land area of the household reaches more than 0.5 mu per household. Land-expropriated farmers have not applied for conversion from rural areas to non-rural areas, and rural collective economic organizations should adjust their contracted cultivated land if conditions permit.
In the urban (town) planning area, if houses are demolished, the relocated households can apply for all farmers to transfer to the countryside.
Eight, the establishment of the basic living security system for landless farmers.
(A) to promote the employment of land-expropriated personnel
The labor and social security departments of towns, streets and districts should establish and improve the unemployment registration system and employment service system for working-age land-expropriated farmers, actively provide services such as policy consultation, employment guidance, employment training and employment introduction, develop jobs through multiple channels, enhance employment absorption capacity, improve and optimize the employment environment, and promote the employment of working-age land-expropriated farmers with employment aspirations. Land-expropriated farmers of working age enjoy relevant preferential policies for the employment of urban registered unemployed people. Land-expropriated farmers or children of land-expropriated farmers attending all kinds of secondary vocational schools within the administrative area of this Municipality can enjoy the subsidy policy for studying with reference to the relevant provisions of Chongqing Municipal Committee's Decision on Accelerating the Industrial Development of the Reservoir Area, Focusing on Solving the Employment of Immigrants and Promoting the Prosperity and Stability of the Reservoir Area (Chongqing Municipal Committee [2006]18).
(B) the establishment of a basic old-age insurance system
After the rural residents whose land has been expropriated are registered as urban residents according to law, they will be included in the basic old-age insurance system for urban enterprise employees in accordance with relevant regulations. Land-expropriated farmers and farmers participate in the basic old-age insurance in accordance with the Notice of Chongqing Municipal People's Government on Printing and Distributing the Trial Measures for the Basic Old-age Insurance for Land-expropriated Farmers and Farmers before February 2007 1 and the Trial Measures for the New Basic Old-age Insurance for Land-expropriated Farmers and Farmers after February 2008 1 (Yu Fu Fa [2008] No.26).
If the land is expropriated after June 65438+1 October1in 2008, the savings endowment insurance method will no longer be implemented.
(C) the establishment of life difficulties relief system
Families of landless farmers who have difficulties in living and meet the minimum living guarantee conditions for urban residents shall be handled by the civil affairs department in accordance with the relevant provisions of the minimum living guarantee for urban residents.
Nine, strengthen leadership, clear responsibility
Land administrative departments are responsible for the implementation of land acquisition compensation and resettlement work. Town People's Government (street offices), District Land Requisition Office, Park (scenic spot, new town) Administrative Committee and relevant functional departments at the district level should actively assist the land administrative departments to do a good job in compensation and resettlement for land acquisition and demolition.
Labor and social security departments are specifically responsible for the employment training of landless farmers, and establish and improve employment services and social security systems.
The civil affairs department is specifically responsible for the minimum living guarantee for the families of landless farmers and the resettlement of civil resettlement objects that meet the requirements.
The public security organs are specifically responsible for providing household registration information of rural residents whose land has been expropriated, doing a good job in household registration examination, approval and statistics, and handling rural residents' household registration according to regulations.
The agricultural department is specifically responsible for guiding and supervising the property distribution, use and management of collective economic organizations with expropriated land, as well as the adjustment of land contractual management rights.
The finance department is specifically responsible for the collection, transfer and management of taxes and fees related to land acquisition.
Audit and supervision departments are specifically responsible for the implementation of land acquisition compensation and resettlement policies and the supervision and inspection of the management of land acquisition and use.
The petition department is specifically responsible for coordinating relevant departments to do a good job in compensation, resettlement and stability of land acquisition and demolition.
Planning, construction, housing management departments to assist in the housing placement of landless farmers.
The education department is specifically responsible for the enrollment of landless farmers (children).
The forestry department is specifically responsible for the examination and approval of requisition and occupation of forest land and the definition of rare trees.
X. this implementation opinion will be implemented on June 65438+1 October1day, 2008. Where the original provisions on compensation and resettlement for land acquisition and demolition are inconsistent with these implementation opinions, these implementation opinions shall prevail.
Compensation and resettlement for land requisition implemented before June 65438+1 October12008 shall be handled according to the original regulations.
