Chapter I General Provisions Article 1 In order to strengthen the management of the Yellow River Project, ensure the safe and normal operation of the Yellow River Project, and give full play to the functions and comprehensive benefits of the project, these measures are formulated in accordance with the relevant laws and regulations of the state and combined with the actual situation of the Yellow River Project in this province. Article 2 The Yellow River Project as mentioned in these Measures mainly includes:

(a) dikes, dangerous work, control, culverts, dams, flood storage and detention areas and other projects (including old dikes, old dams, old dams) and their management and protection facilities, signs, protective forests and grasses and other ancillary facilities;

(2) Facilities such as measurement, monitoring, hydrology, electric power and communication related to flood control and profit promotion within the project management scope. Article 3 These Measures shall apply to the construction, management and protection of the Yellow River Project within the administrative area of this province. Article 4 The management of the Yellow River Project shall adhere to the principles of unified planning, hierarchical management, simplicity and high efficiency, and implement equal emphasis on construction and management, separation of management and maintenance, rational development and paid use. Fifth Yellow River administrative departments at or above the county level shall be responsible for the management of the Yellow River project within their respective administrative areas.

The river affairs (management) department where the sluice gate is located is responsible for the management of the Yellow River project under the leadership of the administrative department of Yellow River affairs at a higher level. Article 6 Encourage and support the popularization and application of new technologies, new materials, new processes and new methods in the construction and management of the Yellow River Project, so as to improve the scientific and technological level of the project construction and management. Article 7 All units and individuals have the obligation to protect the integrity and safety of the Yellow River Project, and have the right to stop, report and accuse acts that undermine the Yellow River Project. Chapter II Construction Article 8 The provincial administrative department of Yellow River affairs shall, according to the Yellow River regulation plan promulgated by the state and in combination with the actual situation of the Yellow River project in this province and the requirements of management and operation, formulate the construction plan of the Yellow River project and organize its implementation. Article 9 People's governments at all levels along the Yellow River shall strengthen their leadership over the construction of the Yellow River Project, organize and educate relevant departments, units and the masses to support the construction of the Yellow River Project, and coordinate and do a good job in land use for project construction, resettlement of the masses, compensation for demolition and occupation, etc. , to ensure the smooth progress of the project construction. Tenth new construction, renovation or expansion of the Yellow River project, must conform to the planning of the Yellow River project construction, strictly implement the flood control standards and relevant technical requirements stipulated by the state, and ensure the safety of the project. Eleventh ancillary facilities of the Yellow River Project shall be designed, constructed and accepted at the same time as the main project. Twelfth Yellow River project construction should strictly implement the project legal person system, bidding system and construction supervision system; Survey, design, construction and supervision units shall have corresponding qualifications and be responsible for the quality of construction projects according to law. Thirteenth yellow river diversion project construction land, should comply with the overall land use planning, and go through the formalities for examination and approval of construction land in accordance with the law, to obtain the right to use the land.

Where land is urgently needed for flood control and disaster relief, it may be used first with the consent of the local people's government at the county level, but the formalities for examination and approval of construction land shall be handled according to law. Chapter III Management Article 14 The management scope of various Yellow River projects shall be determined in accordance with the following provisions:

(1) The management scope of dike project includes: dike body (including front and rear dikes, silt-facing back areas and auxiliary roads) and dike protection land (including windbreak land);

(two) the scope of management of dangerous projects includes: dam body and dam protection land;

(3) The management scope of the control project includes: dam body, connecting dam, dam protection area and its protection area;

(4) The management scope of dam protection project includes: dam body and land for dam protection;

(5) The management scope of culvert works is: from the upstream scouring trough to the downstream scouring trough 100 m, and 25m on both sides of the outer toe of the canal embankment. Fifteenth dike protection land delineation, from the foot of the dike (slope), its width is:

(1) The Yellow River levee above the Gaocun section of Dongming County is 50 meters near the river, and behind the river 10 meters; The section from Gaocun in Lijin County to Nanlingzi and Jifeng in Kenli County is 30m away from the river and10m away from the river. Nanlingzi in Lijin County, below Jifeng in Kenli County, 50 meters away from the river and 50 meters away from the river;

(2) The dikes and Laojindian in the widening area are 7 meters near the river and 10 meters behind the river;

(3) Beijindi is 7 meters near the river and 5 meters behind the river;

(4) The Daqinghe levee faces the river15m, and faces the river 5m;

(5) Dongping Lake Dam faces the lake15m, and is 5-7m away from the lake; The secondary dike is 5m near the lake and 5m to10m behind the lake.

Where the width of the berm exceeds the provisions of the preceding paragraph, the width determined by the demarcation of rights shall prevail.

When the floodplain is silted; the width and original boundary for the berm near the river channel should remain unchanged. After the embankment is reinforced by extra training, the berm will be extended accordingly. Article 16 The width of dam protection land for dangerous work, pilot control and dam protection projects is outside the toe of the slope10m.

Where the protective land for the pilot control project is more than 30m away from the toe of the dam back slope, the width determined by the boundary demarcation on the right side shall prevail. Article 17 The people's governments at or above the county level shall delimit dike safety protection zones in areas related to the scope of project management, with the scope of 50 meters outside the river embankment and 100 meters outside the river embankment. Article 18 The land requisitioned within the management scope of the Yellow River Project belongs to the state, and no unit or individual may occupy or destroy it. Article 19 Old dikes, dams and other original engineering facilities abandoned in the Yellow River regulation plan shall be developed and utilized by the local people's government.

Old dikes, dams and other original engineering facilities of the Yellow River other than those specified in the preceding paragraph shall be repaired and maintained by the administrative department of Yellow River affairs. No unit or individual is allowed to fill in, occupy, dig or dismantle without authorization.
