Measures for the Administration of Water Traffic Safety in Ningxia Hui Autonomous Region (revised 20 17)

Chapter I General Provisions Article 1 In order to strengthen the management of water traffic safety and ensure the safety of people's lives and property, these measures are formulated in accordance with the relevant provisions of the state and combined with the actual situation in our region. Article 2 All vessels, rafts, facilities and personnel sailing and operating in the waters, lakes, reservoirs and rivers of the Yellow River in our region, as well as the owners of vessels, rafts and facilities, shall abide by these measures. Third people's governments at all levels should strengthen the leadership of the local water traffic safety work. The people's governments of counties and townships (towns) are responsible for the safety management of transport vessels in their townships. Fourth Autonomous Region Communications Department is the competent authority responsible for the supervision and management of water traffic safety in our region.

City and county traffic administrative departments are responsible for the supervision and management of traffic safety in the waters under their jurisdiction.

Township (town) people's governments with ships should set up township ship supervisors to be responsible for organizing the implementation of water traffic safety regulations and conducting safety inspections. Chapter II Ships Article 5 All ships sailing in the Yellow River, lakes, reservoirs and waterways in our region (except rowing boats and sports boats, the same below) shall go through the registration of ship ownership, application for ship nationality and registration of ship mortgage with the maritime administrative agency where the port of registry is located according to law. Article 6 All ships sailing in the waters of our region must meet the following seaworthiness conditions, pass the inspection by the ship inspection authority, and hold the ship inspection certificate book, navigation certificate and ship license before sailing.

(a) to verify the passenger and cargo quota, delimit the navigation area and draw the load line sign;

(2) The hull structure is reasonable, and the watertightness and stability are good;

(3) The main engine, auxiliary engine and shafting are operating normally (gasoline engines are prohibited for main engine and auxiliary engine);

(4) The driving control equipment and transmission system have good performance;

(5) The mooring lines and piles of the motor boat and the towed boat are firm and reliable;

(six) motor boats (including paddle boats) must be equipped with iron anchors and anchor chains suitable for their ship types.

(seven) marine tools and accessories should be fully equipped, and equipped with a specified number of life-saving fire fighting equipment. Seventh ship construction, modification and scrapping must go through the approval procedures in accordance with the following provisions:

(1) All units and individuals that need to build steel motorboats or barges must obtain the consent of the competent department and the transportation department, and submit the design drawings for review according to the provisions of the Regulations on Ship Construction Inspection, and can start construction only after being approved by the Ship Inspection Office of the autonomous region.

(II) Where it is necessary to build a small steel paddle boat with a captain16m or less (if it exceeds16m, it shall be handled according to Item (1)), the units and individuals shall obtain the consent of the competent department and the county transportation department, and submit the design drawings for review according to the Interim Provisions on Inspection of Inland River Paddle Boat, and the construction can only be started after being approved by the municipal transportation department and supervised by personnel;

(3) The construction of wooden paddle boats and wooden sailboats shall be approved by the township (town) people's government, and the construction shall be approved by the county department in charge of transportation upon submission of information such as qualification, technical conditions, ship drawings, main dimensions and shipbuilding materials;

(four) the modification and scrapping of various ships shall be approved by the above-mentioned approved construction departments respectively. Article 8 The sale of ships must be handled in accordance with the following provisions:

(1) When selling steel motor boats, the seller shall provide the buyer with design drawings, documents approved by the ship inspection department, construction inspection certificates, ship quality certificates, etc. ;

(2) When buying and selling wooden paddle sailboats and wooden sailboats, the seller shall provide the buyer with the inspection certificate of the ship inspection department, and the steel paddle sailboats shall also provide the design and construction drawings;

(3) The buyer shall go through the formalities of registration, transfer of ownership or nationality transfer with the local transportation department on the basis of the certificate that the competent authority or the people's government at or above the township level has approved the purchase of the ship and the relevant information provided by the seller. Article 9 All national, collective and individual shipbuilders from other provinces and regions, such as steel motor boats, passenger ships, cruise ships, etc., must submit the qualification certificates of their shipbuilders' production conditions and technical level, and can only engage in shipbuilding within the approved scope after being examined and approved by the ship inspection authorities of the autonomous region. When the ship is delivered, the contractor shall submit the ship drawings, repair quality certificates and inspection certificates of the ship inspection department to the ordering party. Chapter III Crewmen Article 10 Crewmen operating a ship shall receive training in water traffic safety, pass the examination by the maritime administrative agency and obtain corresponding certificates of competency or other certificates of competency before taking up their posts or operating.

The shipowner (or his ship operator or ship manager) shall equip his ship with qualified crew according to the requirements of People's Republic of China (PRC) Minimum Safe Manning Rules. Chapter IV Navigation Article 11 Vessels and rafts must abide by the following provisions when navigating, operating and berthing in the waters of our region:

(1) Obeying the command and inspection of the maritime administrative agency;

(two) shall not be overloaded;

(3) Non-ferries and passenger ships are not allowed to cross passengers;

(four) the ship is damaged and the accessories are defective, and it is not allowed to sail;

(5) If there are not enough certified crew members (not less than 2 crew members for single-paddle boats, not less than 3 crew members for double-paddle boats and not less than 5 crew members for long-distance wooden sailboats), they shall not sail;

(6) Passengers or goods are not balanced (inclined or obviously inclined) and are not allowed to sail;

(seven) all kinds of sailing ships should pay close attention to the movements of ships coming and going, and take the initiative to take evasive measures according to the channel conditions. Generally speaking, it is necessary to follow the principle that non-motorized boats let motorized boats, small boats let big boats, water boats let launching boats, single boats let fleets, and horizontal boats let straight boats.

(eight) township transport vessels shall not carry inflammable, explosive, toxic and harmful dangerous goods. No unit or individual may rent or entrust a township transport ship to transport dangerous goods without authorization.
