Legal analysis: there is no special situation in the homestead. If the construction has not started for two years since the date of approval, it can be cancelled with the approval of the county people's government, and the village collective can recover the right to use the homestead.

Under any of the following circumstances, with the approval of the county people's government, the land use right certificate or relevant approval documents may be cancelled, and the village collective may recover the right to use the homestead:

(a) the homestead has not started construction for two years from the date of approval (except in special circumstances);

(two) when the homestead is submitted for approval, it promises to build a new house or demolish an old house to the village collective without demolishing the old house by itself;

(three) the village that has been approved to implement the transformation of the old village or the migration down the mountain has moved into the original homestead where the new house (village) lives;

(four) obtaining approval or illegally transferring the homestead;

(five) other circumstances in which the right to use the homestead should be recovered.

Legal basis: Article 62 of the Land Administration Law of the People's Republic of China, rural villagers can only own one homestead, and the area of the homestead shall not exceed the standards set by provinces, autonomous regions and municipalities directly under the Central Government. Rural villagers should build houses in accordance with the overall land use planning of townships (towns), and try their best to make use of the original homestead in the village. Rural villagers' residential land shall be audited by the township (town) people's government and reported to the county-level people's government for approval; Among them, those involving the occupation of agricultural land shall go through the examination and approval procedures in accordance with the provisions of Article 44 of this Law. Rural villagers who apply for homestead after selling or renting houses shall not be approved.
