These Measures provide detailed explanations on the subjects, payment methods, payment standards and pension insurance benefits of Changsha’s basic pension insurance for urban and rural residents. Policy document: Changsha Basic Pension Insurance Measures for Urban and Rural Residents Implementation date: July 1, 2010 Chapter 1 General Provisions Article 1 is to further improve and coordinate the social pension security system for urban and rural areas, and gradually realize the social construction goal of urban and rural residents being provided for in old age. , According to the "Guiding Opinions of the State Council on Launching the Pilot Project of New Rural Social Pension Insurance" (Guofa [2009] No. 32) and the "Implementation Opinions of the People's Government of Hunan Province on Launching the Pilot Project of New Rural Social Pension Insurance" (Hunan Zhengfa [2009] No. 38) and other relevant regulations, these measures are formulated based on the actual situation of our city. Article 2 Urban and rural residents who have household registration in this city, are over 16 years old (excluding school students), and have not participated in the basic pension insurance for employees of government agencies, institutions and urban enterprises, can participate in the basic pension insurance for urban and rural residents. Article 3 The basic pension insurance system for urban and rural residents adheres to the principles of “guaranteeing basic basics, wide coverage, flexibility and sustainability”. Article 4 The basic pension insurance for urban and rural residents implements a system model that combines personal accounts with basic pensions, and combines individual contributions, collective subsidies and government subsidies. Article 5 The basic pension insurance system software for urban and rural residents is unified throughout the city, and the data is centralized and managed at the municipal level. Chapter 2 Organizational Structure and Main Responsibilities Article 6 The municipal human resources and social security administrative department is in charge of the city’s basic pension insurance work for urban and rural residents, and is responsible for formulating the development plan for the basic pension insurance for urban and rural residents; formulating supporting policies related to the basic pension insurance for urban and rural residents; organizing Promote the basic pension insurance policy for urban and rural residents; carry out business training; review the budget and final accounts of the basic pension insurance for urban and rural residents together with relevant departments; supervise the revenue, expenditure and operation of the basic pension insurance fund for urban and rural residents. The district, county (city) human resources and social security administrative departments are responsible for the organization and implementation of the basic pension insurance for urban and rural residents within their respective administrative regions. The municipal social insurance agency for urban and rural residents (hereinafter referred to as the municipal agency) is responsible for formulating operating procedures and management systems for the city's basic pension insurance for urban and rural residents; undertaking business guidance for the city's basic pension insurance agency for urban and rural residents; and formulating the city's basic pension insurance agency for urban and rural residents. Responsible for the budget and final accounts of the basic pension insurance funds; responsible for the informatization construction and management of the basic pension insurance for urban and rural residents; compilation and reporting of financial accounting and related statistical reports for the basic pension insurance for urban and rural residents, and responsible for the summary and reporting of information statistics. Article 7 Each district, county (city) government establishes a basic pension insurance management service agency for urban and rural residents (hereinafter referred to as the district, county (city) agency), and must include the basic pension insurance work for urban and rural residents in the economic and social development plan, urban and rural residents Government subsidy funds for basic pension insurance are included in the annual special fiscal budget, and the status of pension insurance for urban and rural residents and the availability of financial subsidy funds are included in the annual target management and assessment system. The district and county (city) agencies are specifically responsible for the basic pension insurance registration for urban and rural residents within their jurisdiction, fund collection, benefit assessment and payment, and annual budget and final account preparation, etc.; they are responsible for the implementation of the basic pension insurance for towns (streets) and villages (communities). Business guidance and training, etc. Article 8 Each township (street) must assign dedicated personnel to be responsible for basic pension insurance affairs for urban and rural residents, and the district and county (city) finances must allocate sufficient funds for work and include them in the annual special budget. Article 9 Finance, supervision, auditing and other departments shall, in accordance with their respective responsibilities, jointly carry out the supervision and management of the basic pension insurance funds for urban and rural residents. The financial department incorporates government subsidy funds into the annual special budget to ensure that funds are received on time. The public security, civil affairs and other departments shall, in accordance with their respective responsibilities, work together to collect data on basic pension insurance for urban and rural residents. Chapter 3 Payment of Pension Insurance Premiums Article 10 Basic pension insurance premiums for urban and rural residents shall be paid on an annual basis.
The payment standards are five levels: 100 yuan, 200 yuan, 300 yuan, 400 yuan, and 500 yuan***, which will be adjusted in time in the future according to relevant regulations of the national and provincial governments. The insured can choose the payment level independently, and the more he pays, the more he gets. Article 11 Conditional collective economic organizations may provide subsidies to those who participate in the basic pension insurance for urban and rural residents. The subsidy standards shall be democratically determined by the village (resident) committee convening a village (resident) meeting (or village representative meeting). More than 3 times the maximum payment level of the insured person. Encourage other economic organizations, social welfare organizations, and individuals to provide subsidies for insured persons’ payment. Article 12 The personal account funds of the insured persons are fully accumulated, including: (1) Pension insurance premiums and interest paid by individuals; (2) Collective subsidies and interest; (3) Government subsidies and interest; (4) Other income and Interest. Article 13 Participants shall pay annual premiums, and the cumulative payment period shall be no less than 15 years. However, on the date of implementation of these measures, if the insured person is over 60 years old, he does not need to pay the pension insurance premium. If conditions permit, he can pay 15 years of pension insurance premiums in one lump sum according to the above payment grades and standards; the insured person is over 45 years old. Those under 60 years old should pay annually, and supplementary payments are allowed, but the cumulative payment period shall not exceed 15 years. Article 14 The personal account of the basic pension insurance for urban and rural residents shall calculate interest every year during the accumulation period with reference to the one-year RMB time deposit interest rate of financial institutions announced by the People's Bank of China. Article 15 The government provides subsidies for insured persons’ premium payments (excluding supplementary payments). The subsidy standard is 30 yuan per person per year. For each higher level of payment, the district, county (city) government will increase the payment subsidy by 5 yuan. Article 16 For urban and rural people without income, the district, county (city) government shall pay an annual pension insurance premium of 100 yuan on their behalf. Article 17 For severely disabled people in urban and rural subsistence allowance households, the district, county (city) government shall pay an annual pension insurance premium of 100 yuan on their behalf with the "Minimum Guarantee" and "Disability Certificate". For other severely disabled persons, the district and county (city) governments shall pay part of the pension insurance premiums on their behalf based on the "Disability Certificate". The specific standards shall be determined by the respective district, county (city) governments. Chapter 4 Pension Insurance Benefits Article 18 Participants who meet one of the following conditions will enjoy basic pension insurance benefits for urban and rural residents on a monthly basis starting from the month following the month after reaching the age of 60. (1) The cumulative payment period reaches 15 years; (2) Persons who have reached the age of 45 on the date of implementation of these measures must pay insurance premiums on an annual basis. (3) Urban and rural elderly who have reached the age of 60 on the date of implementation of these measures and do not enjoy basic pension insurance benefits for urban enterprise employees and other retirement benefits do not have to pay and can receive basic pensions on a monthly basis, but they meet the insurance conditions The children should be insured and pay premiums. Article 19 The basic pension insurance benefits for urban and rural residents consist of personal account pension and basic pension. Personal account pensions are paid from personal accounts. The standard for monthly payment of personal account pensions is: the amount of personal account savings divided by the number of months (139 months) for basic pension insurance personal account pensions stipulated by the state. The city implements a unified basic pension standard of 60 yuan per person per month. Encourage insured persons to pay premiums for a long time, and they will get more benefits if they pay for a long time. If the insured has paid for more than 15 years in total, for every additional year of payment, his basic pension will increase by 0.5 yuan per month (excluding the period of supplementary payment). Article 20: Establish an adjustment mechanism for basic pensions. The specific adjustment plan shall be proposed by the municipal human resources and social security department in conjunction with the municipal finance department in accordance with relevant national and provincial regulations, and shall be implemented after approval by the municipal government. Article 21 If an insured person fails to pay pension insurance premiums in accordance with Article 13 of these Measures and does not meet the conditions for receiving pensions as stipulated in Article 18, the funds in his or her personal account will be refunded in one go. Article 22 If an insured person dies during the payment period, the funds in his personal account will be returned to his legal heir or designated beneficiary in one lump sum. Article 23 If an insured person dies during the period of receiving pension, the pension benefits will be stopped in the month following the death, and the balance of the funds in his personal account will be returned to his legal heir or designated beneficiary in one go. Article 24 The basic pension insurance benefits for urban and rural residents shall be distributed on a monthly basis on a social basis. Persons receiving benefits should be identified for eligibility. If someone dies during the period of receiving benefits, their immediate family members or the village (community) where they live should go to the township (street) to handle relevant procedures within one month of their death to terminate the pension insurance relationship.
Article 36 Anyone who uses forged documents or other means to obtain excessive or fraudulent pension insurance benefits shall be ordered to return it by the district, county (city) human resources and social security department; if he is suspected of committing a crime, he shall be transferred to the judicial authority for handling according to law. Chapter 7 Supplementary Provisions Article 37 The implementation details and related management systems of these Measures shall be formulated separately by the Municipal Human Resources and Social Security Bureau in conjunction with the Municipal Finance Bureau. Article 38 These Measures shall come into effect on July 1, 2010.
