Relevant municipal and county people's governments and relevant departments of the provincial people's government:

In order to further promote the renovation of clay wall materials enterprises in the Yellow River beach, implement the deployment of saving energy and reducing emissions and prohibiting the use of solid clay bricks in the whole province, improve the ecological environment in the Yellow River beach, and effectively ensure the safety of flood discharge and dikes in the Yellow River, the provincial government decided to completely close down and eliminate clay wall materials enterprises in the Yellow River beach before the end of 20 12. We hereby put forward the following implementation opinions, please implement them carefully.

First, unify thinking and understanding.

Setting up clay wall materials enterprises and developing clay wall materials industry in the beach area of the Yellow River will not only affect the ecological environment of the Yellow River and interfere with the "forbidden real estate" in the whole province, but also cause hidden dangers to the flood control safety of the Yellow River. In recent years, with the vigorous promotion of governments at all levels and relevant departments, the promotion of clay wall materials enterprises in the Yellow River beach area of our province has achieved remarkable results. Especially since the provincial party committee and the provincial government decided to comprehensively rectify the clay wall materials enterprises in the Yellow River beach in August 2009, 563 production lines of clay wall materials in the Yellow River beach, which affected the flood safety of the Yellow River and occupied basic farmland or cultivated land, have been dismantled, reducing the production capacity by 8 billion standard bricks, effectively curbing the momentum of disorderly development and blind construction of clay wall materials enterprises in the Yellow River beach. All levels and relevant departments should deeply understand the necessity and urgency of completely closing and eliminating clay wall materials enterprises in the Yellow River beach area from the perspective of realizing scientific development, improving people's livelihood and ensuring ecological security, further unify their thinking, clarify their responsibilities, speed up the closure and elimination of clay wall materials enterprises in the Yellow River beach area, and finally ban the clay wall materials industry in the Yellow River beach area. Completely eliminate the adverse impact on the flood control safety and ecological environment of the Yellow River and realize the goal of "banning real estate" in the province. At the same time, support the people in the Yellow River beach area to open up channels for getting rich such as efficient planting, effectively get rid of the status quo of relying on clay wall materials industry, and guide the Yellow River beach area to embark on the scientific development path of production development, affluent life and good ecology.

Second, clear the task.

(1) General requirements

Adhering to the guidance of Scientific Outlook on Development, and in accordance with the requirements of "strengthening guidance, managing according to law, standardizing operation, phasing out and finally banning", we will implement the working mechanism that the municipal and county (city, district) governments under the provincial jurisdiction take overall responsibility and departments cooperate to promote, fully implement the objectives and tasks set by the provincial government to eliminate backward production capacity and promote energy conservation and emission reduction, ensure the complete closure and elimination of clay wall materials enterprises in the Yellow River beach area within three years, and ensure the smooth closure and elimination and the overall social stability.

(2) Close the elimination scope.

The specific scope of the Yellow River beach area is: from the lower end of Wenmengtan resettlement area on the left bank to Taiqian reach, and from the crane control project on the right bank to Lankao reach. The total beach area is 1808. 1 km2, including 6 cities of Zhengzhou, Kaifeng, Luoyang, Xinxiang, Jiaozuo and Puyang 17 counties (cities, districts). Among them, Zhengzhou, Kaifeng, Xinxiang, Jiaozuo and Puyang are 12 counties (districts).

By the end of 20 12, all clay wall materials enterprises in the Yellow River beach area will be shut down and eliminated, realizing the goal of completely withdrawing from the Yellow River beach area. Among them, before the end of 20 10, the rotary kiln production line with an annual output of 30 million or less clay bricks will be closed and dismantled; 20 1 1 before the end of the year, shut down and dismantle all kinds of wheel kiln production lines with an annual output of 60 million pieces or less; Before the end of 20 12, the production line for dismantling clay wall materials in the yellow river beach area will be completely closed.

(4) standardized operation requirements

-strict standards. All localities should formulate elimination implementation plans and annual plans in strict accordance with the above standards, and shall not lower the threshold standards at will. The annual list of eliminated enterprises is put forward by the county (district) government, verified and confirmed by the municipal government under the provincial jurisdiction, and submitted to the office of the joint meeting of the provincial governance and rectification clay brick and tile kiln factory (hereinafter referred to as the joint meeting) for the record before implementation.

-management according to law. Strictly implement the national and provincial laws, regulations and policies on Yellow River protection, cultivated land protection and environmental protection. In August 2009, the joint meeting of the province required the brick and tile kiln factory to be dismantled within a time limit. The municipal and county (district) governments under the jurisdiction of each province should organize relevant departments to inspect according to laws and regulations to ensure that all the bricks and tiles kiln factories are dismantled in place. The local county government will immediately and unconditionally dismantle those that have not been dismantled, resumed production or expanded, rebuilt or built without authorization.

-Standardize operation. Annual dismantling enterprises should be included in the list of enterprises with backward production capacity eliminated in cities under the jurisdiction of provinces, and the county-level government should organize relevant departments to revoke all permits or approvals issued to clay wall materials enterprises, organize dismantling within a time limit and clean up the blank drying field in time, and sort out the recycling kiln factory area within a time limit. Enterprises that have not reached the deadline for closure and elimination must produce non-solid products such as hollow bricks and perforated bricks. It is strictly forbidden to evade the demolition policy by expanding the existing wheel kiln, and it is strictly forbidden to build a new clay wall material production line project in the name of "big pressure and small pressure" or developing new sintered wall materials.

-Strict acceptance. The municipal government under the provincial jurisdiction is responsible for organizing the acceptance of the annual closure and elimination of counties (districts) under its jurisdiction. The office of the joint meeting of the province shall verify the acceptance results of all localities. To complete the annual task, the relevant departments of the province should honor the relevant incentive policies.

Third, implement safeguard measures.

(A) to strengthen organizational leadership

The main body of responsibility for shutting down and eliminating clay wall materials enterprises in the Yellow River beach area is the municipal and county (district) governments under the jurisdiction of the province. The municipal and county (district) governments under the provincial jurisdiction should take overall responsibility for the closure and elimination of clay wall materials enterprises in the Yellow River beach area, and the main leaders of the government are the first responsible persons. Governments at all levels should earnestly strengthen organizational leadership, formulate specific implementation plans and annual plans in strict accordance with the closing and elimination targets set by the province, clarify the division of responsibilities, conscientiously do a good job in stabilizing the closing and elimination of enterprises, and ensure that the closing and elimination work is completed on schedule.

(B) a clear division of labor

The provincial joint meeting co-ordinates the closure and elimination of clay wall materials enterprises in the Yellow River beach area, and the office of the joint meeting is responsible for the coordination and implementation of relevant tasks and policies and measures. In accordance with the division of responsibilities, all member units strengthen cooperation, make concerted efforts and make joint progress.

The department of land and resources shall be responsible for the work of the office of the joint meeting, supervise and investigate illegal soil borrowing and destruction of cultivated land, and organize reclamation in time.

The housing and urban-rural construction department is responsible for the market access and use management of clay wall materials in the Yellow River beach area, and the use of solid clay bricks in the beach area should be investigated and dealt with according to law.

The Yellow River Affairs Department is responsible for the supervision and management of flood control safety, and in conjunction with relevant departments, shut down and dismantle the production line of clay wall materials that affect the flood control safety of the Yellow River according to law.

The Department of Industry and Information Technology is responsible for bringing the closure and elimination of clay wall materials enterprises in the Yellow River beach area into the elimination of backward production capacity in the province, strengthening supervision and guidance to prevent the rebound of backward production capacity.

The development and reform department is responsible for formulating and implementing relevant policies and measures to guide the development of alternative industries in the Yellow River beach area.

The environmental protection department is responsible for supervising and managing the environmental protection work in the Yellow River beach area, and investigating and dealing with clay wall materials enterprises that destroy the ecological environment according to law.

The human resources and social security department is responsible for investigating and dealing with clay wall materials enterprises in the Yellow River beach area.

The supervision department is responsible for accepting cases, and if an administrative omission or a public official shares in a clay wall material enterprise, the corresponding disciplinary responsibility shall be investigated in accordance with the relevant provisions.

The public security department is responsible for handling illegal and disciplinary incidents of clay wall materials enterprises.

The safety supervision department is responsible for the supervision and management of the safety production of clay wall materials enterprises, and investigate and deal with the production enterprises that do not meet the conditions for safe production according to law.

The electricity regulatory department is responsible for strengthening the supervision and management of power supply for clay wall materials enterprises in the Yellow River beach area.

The electric power department is responsible for regulating the management of electricity consumption in clay wall materials enterprises, and stopping power supply on time for enterprises notified by the government to close down.

(3) Strengthen supervision and inspection.

The relevant provincial city and county (district) governments and relevant departments should earnestly strengthen the supervision and inspection of the elimination and closure of clay wall materials enterprises in the Yellow River beach area, strengthen regulatory measures, and strictly investigate the responsibilities. Those who work poorly, make slow progress or resort to deceit should be dealt with severely. For counties (districts) that have not been eliminated and closed as required, regional approval for construction land, planning permission and environmental impact assessment shall be implemented.

(D) Strengthen policy guidance

From the provincial special fund for energy conservation and emission reduction and the paid use fee for newly-added construction land, we will arrange funds of15.58 million yuan, and from the provincial and municipal wall reform funds, we will arrange funds of 5 million yuan to set up a provincial special fund to reward the closure and elimination of clay wall materials industry in the Yellow River beach area. According to the standard of eliminating and dismantling a production line, the reward is 60 thousand yuan, which is used to reward the county (district) government that completes the task of eliminating the backward production capacity of clay wall materials on schedule. The land vacated by the backward production capacity of clay wall materials in the Yellow River beach area will be given priority by counties (districts) to increase or decrease the linked indicators to reward the construction of local provincial industrial clusters.

(5) Strengthen supervision by public opinion.

Governments at all levels and relevant departments should widely publicize the significance of closing and eliminating clay wall materials enterprises in the Yellow River beach area and create a good public opinion atmosphere; Relevant information about closing and eliminating enterprises should be publicized in time and actively accept social supervision.
