Shaanxi Qinling Ecological Environment Protection Regulations (revised in 219)

chapter I general provisions article 1 in order to protect the ecological environment of Qinling mountains, improve the ecological functions of Qinling mountains in regulating climate, conserving water and soil, conserving water resources and maintaining biodiversity, build an important national ecological security barrier, promote the harmonious life between man and nature, promote the construction of ecological civilization, and realize sustainable economic and social development, these regulations are formulated in accordance with relevant laws and administrative regulations and in combination with the actual situation of this province. Article 2 These Regulations shall apply to the protection, utilization and development of natural resources within the scope of ecological environment protection in Qinling Mountains.

the scope of Qinling ecological environment protection as mentioned in these regulations (hereinafter referred to as Qinling scope) refers to the area within the administrative region of this province, which is bounded by the provincial boundary from east to west and the Qinling mountain slope from north to south, including all the administrative regions of Shangluo City and some administrative regions of Xi 'an, Baoji City, Weinan City, Hanzhong City and Ankang City. Article 3 The protection of ecological environment in Qinling Mountains follows the principle of giving priority to protection, giving priority to conservation and giving priority to natural restoration, and adheres to the principles of overall planning, scientific utilization, strict supervision and public participation. Article 4 The provincial people's government shall take overall responsibility for the protection of ecological environment in Qinling Mountains.

the people's governments of cities and counties (cities, districts) divided into districts are responsible for the protection of the ecological environment in the Qinling Mountains within their respective administrative areas, determine the spatial layout of towns, agriculture and ecology in their respective administrative areas, and delimit and implement the urban development boundaries, permanent basic farmland and ecological protection red lines.

township (town) people's governments and sub-district offices should do a good job in the ecological environment protection of Qinling Mountains within their respective jurisdictions. Article 5 The provincial people's government shall set up the Qinling Ecological Environment Protection Committee, which shall be responsible for the overall planning, comprehensive coordination, supervision and inspection of Qinling Ecological Environment Protection, and organize the implementation of these Regulations. Its main duties are:

(1) to organize the compilation of the overall plan for ecological environment protection in Qinling Mountains;

(2) to guide the ecological environment protection work of the Qinling Mountains in the city with districts, and urge the relevant provincial departments to carry out the ecological environment protection work of the Qinling Mountains;

(3) to review the relevant provincial-level special plans concerning the protection of the ecological environment in Qinling Mountains;

(4) Investigate the ecological environment in Qinling Mountains and put forward suggestions on the ecological environment protection policies in Qinling Mountains;

(5) Establish a comprehensive monitoring information system for ecological environment protection in Qinling Mountains, and release relevant information on ecological environment in Qinling Mountains;

(6) Organize the supervision and inspection and special rectification of ecological environment protection in Qinling Mountains;

(7) Other duties stipulated by the provincial people's government.

The director of the Qinling Ecological Environment Protection Committee of the province is the governor, and its organizational setup and specific work responsibilities are stipulated by the provincial people's government.

the cities and counties (cities, districts) divided into districts shall set up the Qinling Ecological Environment Protection Committee, determine the offices and be responsible for the daily work of the Qinling Ecological Environment Protection Committee. Article 6 The administrative departments in charge of development and reform, science and technology, national religion, public security, civil affairs, finance, natural resources, ecological environment, housing and urban-rural construction, transportation, water conservancy, agriculture and rural areas, commerce, cultural tourism, emergency management, market supervision and management, forestry, surveying and mapping, meteorology and cultural relics of the people's governments at or above the county level shall perform their respective duties according to law, and do a good job in protecting the ecological environment of Qinling Mountains.

The management institutions of national parks, nature reserves, scenic spots, geological parks, forest parks, wetland parks and other natural parks within the Qinling Mountains, aquatic germplasm conservation zone, original habitat protection areas (spots) of wild animals, important habitats of wild animals, drinking water source protection areas, botanical gardens, state-owned forest farms, cultural relics protection units, etc., shall do a good job in ecological environment protection within their management scope according to their duties. Article 7 The people's governments at or above the county level shall incorporate the ecological environmental protection of Qinling Mountains into the national economic and social development plan, set up special funds for ecological environmental protection of Qinling Mountains, and incorporate them into the annual fiscal budget to guarantee it.

The special fund for ecological environment protection in Qinling Mountains is used for water conservation, water resources protection, soil and water conservation, biodiversity protection, vegetation restoration, mine environment management and other related ecological environment protection, ecological system monitoring, maintenance, restoration and comprehensive management in Qinling Mountains.

people's governments at or above the county level should co-ordinate relevant funds according to law for infrastructure construction of ecological environment protection in Qinling Mountains, support the development of green ecological industries and improve the production and living conditions of local residents. Article 8 The people's government of the province shall establish and improve the compensation mechanism for ecological protection according to the relevant provisions of the state, increase the financial transfer payment, give ecological protection compensation to the ecological environment protection areas in Qinling Mountains according to law, and guide and promote the establishment of horizontal compensation relationship between the areas benefiting from ecological environment and the ecological protection areas, and between the downstream and upstream of the basin. Article 9 Establish a diversified investment and financing mechanism for environmental protection, support the development of green finance, and attract domestic and foreign funds for ecological environmental protection in Qinling Mountains.

Encourage social organizations and individuals to donate and fund the ecological environment protection work in Qinling Mountains. Article 1 The people's governments at or above the county level and their administrative departments in charge of science and technology, forestry, agriculture and rural areas, water conservancy, natural resources, ecological environment, surveying and mapping, meteorology, etc. shall encourage and support the scientific research and technology popularization of ecological environmental protection in Qinling Mountains and promote the application of scientific and technological achievements. Eleventh newspapers, radio and television, press and publication, online media and other relevant departments and units of natural resources, ecological environment, cultural tourism, education, etc. shall, in combination with various environmental protection activities, organize and carry out publicity and education on the knowledge and laws and regulations of ecological environmental protection in Qinling Mountains, so as to raise citizens' awareness of ecological environmental protection in Qinling Mountains. The news media should strengthen the supervision of public opinion on the ecological environment protection in Qinling Mountains.
