Which of the following behaviors is not dereliction of duty?

Duty crime depends on what crime you are involved in. If the circumstances are serious, probation cannot be applied. If the circumstances involved are minor and the attitude of admitting mistakes is good, probation can be applied under normal circumstances.

Under normal circumstances, a duty criminal under any of the following circumstances is generally not subject to probation or exemption from criminal punishment:

(1) Failing to truthfully confess the crime;

(2) Refusing to return the stolen money or use it for illegal activities;

(3) Being the principal offender in a major crime;

(four) taking advantage of his position to commit several crimes, and combining punishment for several crimes or combining punishment for several crimes according to law;

(5) Being subject to administrative sanctions for violating discipline and law during his tenure;

(six) the property involved in the crime belongs to disaster relief, emergency rescue, flood control, special care, poverty alleviation, immigration, relief, epidemic prevention and other specific funds and materials;

(9) Other circumstances in which probation or exemption from criminal punishment is not applicable.

Legal basis:

Article 72 of the Criminal Law of People's Republic of China (PRC), a criminal sentenced to criminal detention or fixed-term imprisonment of not more than three years may be suspended if he meets the following conditions at the same time, and suspended for people under the age of 18, pregnant women and people who have reached the age of 75:

(a) the circumstances of the crime are relatively minor;

(2) showing repentance;

(3) There is no danger of committing a crime again;

(four) the announcement of probation has no significant adverse effects on the community where he lives.

Probation can be announced according to the circumstances of the crime, and criminals are prohibited from engaging in specific activities, entering specific areas, places and contacting specific personnel during the probation period of probation.

If a suspended criminal is sentenced to an additional punishment, the additional punishment shall still be executed.
