Measures of Nanjing Municipality on the Administration of Child Care Institutions

Chapter I General Provisions Article 1 In order to standardize the management of infant care institutions and promote the healthy development of care services, these Measures are formulated in accordance with relevant laws and regulations and in light of the actual situation of this Municipality. Article 2 These Measures shall apply to the infant care institutions that provide full-time, half-day, regular care, temporary care and other care services for infants under 3 years old within the administrative area of this Municipality.

Where there are other provisions of the state and province on the management of infant care institutions (hereinafter referred to as nursing institutions), those provisions shall prevail. Article 3 The development of child care institutions shall follow the principles of public welfare orientation, universal benefit first, safety and health, scientific standardization, territorial management and classified guidance. Article 4 The Municipal People's Government shall strengthen the unified leadership of the nursery service, incorporate the nursery service into the national economic and social development plan and target responsibility assessment, guarantee relevant financial funds, and coordinate and solve major problems in the nursery service.

The District People's Government and the management institution of Jiangbei New District shall implement the responsibility of territorial management of nursery services, rationally plan the layout of nursery institutions within their jurisdiction according to the needs of economic and social development, and promote the standardized development of nursery institutions.

The town people's government and sub-district offices shall do a good job in the supervision and management of child care institutions within their respective jurisdictions, and designate responsible persons. Article 5 The municipal public health administrative department shall be responsible for the operational guidance, supervision and management of child-care institutions, organize the formulation of child-care service development plans and work implementation plans, and guide the management of child-care institutions of the District People's Government and the management institutions of Jiangbei New District.

The health administrative department of the District People's Government and the management institution of Jiangbei New District shall be responsible for the management of nurseries and kindergartens within their respective jurisdictions, and guide the Town People's Government and subdistrict offices to carry out relevant supervision and management work.

Other relevant administrative departments, women's federations, trade unions and other mass organizations shall, in accordance with their respective functions and duties, jointly do a good job in the supervision and management of child care institutions. Sixth support the early development of infant industry associations to carry out industry evaluation, notification, training and other work, standardize the practice behavior, strengthen industry self-discipline, and promote the management level of members and industries. Article 7 Child care institutions shall adhere to the principle of taking infants as the center, follow the laws and characteristics of physical and mental development of infants, improve the level of child care services, ensure the safety and health of infants, and promote their all-round physical and mental development. Chapter II Establishment and Management Article 8 The establishment of child care institutions shall comply with relevant laws and regulations on fire control, production safety, food safety and environmental protection, conform to relevant national standards and norms, and be equipped with equipment, facilities and personnel according to the laws and characteristics of physical and mental development of infants. Ninth for-profit child care institutions shall be registered by the market supervision and management department according to law. An application for registration as a private non-enterprise unit of child care institutions shall be registered by the competent administrative department of civil affairs according to law. Before registration, the health administrative department shall issue examination opinions according to the relevant provisions of the registration management of private non-enterprise units.

After registering in accordance with the law, child care institutions shall promptly file with the local health administrative department in accordance with relevant state regulations. Where a child care institution changes its registered items, it shall apply to the original registration authority for registration of change according to law.

The registration authority shall promptly push the registration information of child care institutions to the administrative department of health. Article 10 The administrative department of health shall build an information management platform for nurseries and kindergartens, regularly publish and update relevant laws, regulations and policies on the management of nurseries and kindergartens within its jurisdiction, and record information of nurseries and kindergartens, so as to provide efficient and convenient inquiry services for the public.

Market supervision and the management information of nursery institutions registered by the civil affairs department shall be incorporated into the information management platform of nursery institutions in a timely manner. Eleventh child care institutions shall bear the main responsibility of safety management and perform the following safety management duties:

(a) in accordance with the relevant provisions of fire laws, regulations, rules and policy documents, fully implement the main responsibility of fire safety and perform various fire safety duties;

(two) in accordance with the relevant provisions of internal security laws, regulations, rules and policy documents, establish and implement the responsibility system for internal security work, incorporate internal security work into the management objectives of the unit, and ensure the necessary personnel, funds and equipment for safety work;

(three) to establish a safety management system, strengthen safety inspection, and shall not set up or place equipment, facilities and articles that endanger the safety of infants and young children;

(four) to formulate emergency plans and organize emergency drills on a regular basis;

(five) in the main entrances and exits and infant life activities area, the installation of video security monitoring system, to ensure full coverage of monitoring, and in accordance with the provisions of the time to save video data;

(six) the establishment of a baby transport system, by the baby guardian or its entrusted adults to transport the baby;

(seven) other safety management duties as prescribed by laws and regulations. Twelfth nursery staff should master the basic skills of first aid and the basic methods of prevention, avoidance, escape and self-help, and give priority to ensuring the safety of infants and young children in emergencies. Thirteenth child care institutions shall perform the following duties of health care management:

(a) the establishment of health disinfection, disease prevention and control system. Carry out daily health examination and health observation on infants and children, and report to the relevant administrative departments in accordance with the regulations after finding children with infectious diseases. It is found that staff members suffer from diseases that endanger the health of infants and young children, and effective measures should be taken to avoid infant infection;

(two) according to the characteristics of infants of different ages, establish a scientific and reasonable work and rest system, physical exercise plan, strengthen daily care and nursing, and carry out project management for frail children;

(3) Establish a food safety management system. According to the growth and development needs and nutritional standards of infants, scientifically compile daily recipes, publicize them to parents, and make dietary samples according to regulations;

(four) to understand the health status and vaccination of infants entering the park, and to assist in the implementation of the national immunization program;

(five) other health care management responsibilities as prescribed by laws and regulations.
