The Rules for the Judicial Police of the People's Procuratorate to Perform Their Duties and the Opinions of the Supreme People's Procuratorate on Further Strengthening and Improving the Judicial Police Work of Procuratorial Organs, combined with the actual work of judicial police in procuratorial organs in our province, Article 2 Police transfer refers to the behavior of uniformly mobilizing the judicial police force within the jurisdiction when the people's procuratorates at or above the city, state and branch level need support in handling major and complex cases. Police assistance refers to the behavior that the judicial police of people's procuratorates at all levels need assistance when the cross-regional case-handling task is insufficient in this province, and the bailiff department of the local people's procuratorate sends police to coordinate, assist and cooperate. Article 3 Police cooperation shall follow the following principles: (1) The principle of prudent use of police force. (2) The principle of strict procedures and responsibilities. (3) The principle of close cooperation and obedience. (4) Strict confidentiality principle. Chapter II Police Force Dispatch Article 4 When the provincial people's procuratorate needs to mobilize police force in handling major and complex cases, the bailiff corps shall fill in the Approval Form for Calling Police Force of Hubei Provincial People's Procuratorate according to the application for police force use, and after the approval of the chief procurator or deputy chief procurator in charge, it may issue a police force dispatch order for the judicial police of Hubei Provincial People's Procuratorate to perform their duties. Article 5 When a city, state or branch needs to mobilize the police force in handling major and complicated cases, the bailiff detachment shall fill in the Approval Form for Calling the Police Force by the People's Procuratorate of XX City (state) according to the application for using the police force, and after the approval of the chief procurator or the deputy chief procurator in charge, the Judicial Police Force Adjustment Order of the People's Procuratorate of XX City (state) can be issued. Article 6 The people's procuratorates at lower levels concerned shall, after receiving the police orders from the judicial police of the people's procuratorates to perform their duties, quickly organize the police to arrive at the designated places as required. Article 7 The mobilized police force shall be used by the people's procuratorate that uses the police, under the leadership of the judicial police department of the people's procuratorate that uses the police, and subject to the command of the prosecutor when performing the duties of the judicial police. Chapter III Police Cooperation Article 8 With the consent of the Deputy Procurator-General in charge of the people's procuratorate at the corresponding level, the judicial police department (hereinafter referred to as the requesting party) shall directly submit a police cooperation letter (stamped with the seal of the court), the valid work certificate of the undertaker and a copy of the relevant legal documents of the case to the judicial police department of the local people's procuratorate (hereinafter referred to as the cooperating party). (1) If the legal procedures and materials related to the case are true and complete, they shall be reported to the Deputy Procurator-General in charge for approval, assist in police dispatch and issue a police dispatch order for execution. (2) If the legal procedures and materials related to the case are untrue or incomplete, the requesting party shall be informed to supplement them. (three) do not assist the police, it shall explain the reasons and return the relevant materials to the requesting party. Article 9 If the requesting party cannot handle the written letter of police assistance in time due to an emergency when carrying out cross-regional case handling tasks in this province, it may consult the cooperating party for emergency police assistance, but it must provide the valid work certificate of the undertaker and a copy of the relevant legal documents of the case. After examination, the partner can send police to coordinate, assist and cooperate with the deputy attorney general in charge. After the task of assisting the police is completed, the written procedures related to assisting the police by the requesting party shall be completed in time. Article 10 If the requesting party assists in the execution of detention, arrest and pursuit of criminal suspects across regions in this province, in principle, the requesting party shall contact and cooperate with local public security organs through public security organs. If necessary, the collaborators can assist the police. When the requesting party performs cross-regional search, escort and escort tasks in this province, when the police force is insufficient, it may request the cooperating party to assist the police. Eleventh after the completion of the task of assisting the police, the cooperative party shall report the situation of assisting the police to the judicial police department of the people's procuratorate at the next higher level for the record. Chapter IV Responsibility for Police Cooperation Article 12 When using police force, the people's procuratorate shall bear the legal consequences caused by police cooperation in the execution of police affairs. When assisting the police to perform police duties, the cooperating party shall perform police duties according to the matters requested to assist the police, and the legal consequences arising therefrom shall be borne by the requesting party; The legal consequences arising from the partner's behavior beyond the scope of requesting police assistance shall be borne by the partner. Thirteenth people's procuratorates at all levels and the judicial police departments shall not charge fees for the implementation of police cooperation. The normal expenses incurred in police coordination and police work shall be paid by the public security people's procuratorate for handling cases. Fourteenth police coordination should be included in the performance appraisal system of the judicial police department. Fifteenth the judicial police department of the people's procuratorate at a higher level shall strengthen the guidance, coordination and inspection of the police coordination and police cooperation work of the judicial police department of the people's procuratorate at a lower level.
