Trial Measures of Qingyuan Municipality on the Management of Employees Employed by Organs and Institutions
Chapter I General Provisions
Article 1 In order to improve the efficiency of government work, control the administrative operation cost, standardize the management of employees, and protect the legitimate rights and interests of government organs, institutions directly under the municipal government and their employees, these measures are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality.
Article 2 The term "institutions directly under the municipal government" as mentioned in these Measures refers to municipal party committees, people's congresses, governments, CPPCC, procuratorial organs, judicial organs, democratic parties, federations of industry and commerce and mass organizations, as well as law enforcement organs and administrative and public welfare institutions with full financial allocations.
The term "employed personnel" as mentioned in these Measures refers to the full-time personnel who serve the employing unit, implement contract management within the approved quota of employed personnel, and engage in technical, administrative assistance and logistics services.
Hired personnel are not included in the staffing sequence of the employing unit, do not hold administrative positions, do not exercise law enforcement rights, and do not involve state secrets. Unless otherwise stipulated by the state or province, such provisions shall prevail.
Article 3 These Measures shall apply to the conclusion, performance, alteration, dissolution or termination of labor contracts between the employing units and employees who have established labor relations with them.
Article 4 The Office of the Municipal Organization Establishment Committee (hereinafter referred to as the Municipal Organization Establishment Office) is responsible for verifying the categories and quantities of employees employed by the employing units; Municipal Human Resources and Social Security Bureau (hereinafter referred to as the Municipal Bureau of Human Resources and Social Security) is responsible for the supervision of employee recruitment; The Municipal People's Social Security Bureau and the Municipal Finance Bureau are responsible for formulating the annual salary standards for employees and reporting them to the municipal government for approval. The Municipal Finance Bureau is responsible for the implementation of the corresponding funds.
Chapter II Classification and Distribution of Tenants
Article 5 The hirer is divided into three categories: the first category refers to the professional and technical category; The second category refers to the administrative assistance category; The third category refers to the logistics service category.
The first type of professional technology is divided into five grades: the first grade is the personnel with positive and senior professional titles; The second file is the deputy senior professional and technical title; The third file is the personnel with intermediate titles; The fourth file is the assistant professional and technical title; The fifth file is the personnel with professional and technical titles.
The second kind of administrative assistance is divided into four grades: the first grade is for people who have obtained doctoral degrees; The second file is those who have obtained a master's degree; The third file is undergraduates; The fourth file is people with college education.
The third kind of logistics services: personnel above high school, mainly including drivers, typists and public security auxiliary police.
Professional and technical personnel and administrative support personnel shall be openly recruited, and logistics service personnel shall be employed by the employing units themselves.
Article 6 The Municipal Editorial Office shall scientifically verify the categories and quantity of employees according to the standards determined by the Municipal Organization Establishment Committee (see Table 1 for details).
Article 7 The Municipal Editorial Office shall, according to the changes in the functions and staffing of the employing unit, adjust the number of employees in a timely manner and establish a dynamic management mechanism for the approved number of employees.
Chapter III Employment Conditions and Recruitment Procedures
Article 8 Employees shall meet the following conditions:
(1) Abide by the Constitution, laws and regulations of People's Republic of China (PRC);
(2) Good conduct, good professional ethics and willingness to perform employment obligations;
(3) Being in good health;
(4) Having professional and technical titles and academic qualifications specified in the employment post;
(five) other qualifications that meet the requirements of the employment position.
Article 9 An employing unit shall employ personnel according to the following procedures:
(1) declaration. The employing unit shall apply for the number of employees according to the needs of the work, explain the reasons for employment, the number of employees, the categories of personnel, jobs and the use of the staffing of the unit, and report the categories and numbers of employees to the municipal office.
(2) approval. Within the total number of employees determined by the Municipal Organization Committee, the Municipal Organization Office shall, according to the needs of unit establishment and actual work, verify the category and quantity of employees of the employing unit, and send a copy to the Municipal Human Resources and Social Security Bureau and the Finance Bureau. For departments with special work nature or large business volume, the number of employees shall be approved by the method of "one thing, one discussion" and reported to the municipal editorial board for study and determination.
(3) recruitment. The employing unit conducts open recruitment according to the categories and quantity of employees approved by the Municipal Office, referring to the Implementation Measures for Open Recruitment of Public Institutions in Qingyuan City, and according to the principles of openness, equality and merit. The open recruitment plan is reported to the Municipal Human Resources and Social Security Bureau for the record and implemented under the supervision and guidance of the Municipal Human Resources and Social Security Bureau.
(4) signing a labor employment contract. The employer signs a labor employment contract with the employee according to the recruitment results, and reports it to the Municipal Human Resources and Social Security Bureau for contract verification. The Municipal Human Resources and Social Security Bureau will send a copy of the employment information to the Municipal Editorial Office and the Municipal Finance Bureau, and the Municipal Finance Bureau will allocate funds accordingly.
Chapter IV Wages, Welfare and Social Security
Article 10 An annual salary system shall be implemented for employees. The annual salary includes employee's salary (including tax), various insurance fees paid by individuals and housing accumulation fund. The annual salary standard is determined according to the category and grade of the employed personnel and the principle of "high is not low" (see Table 2 for details). The annual salary of employees is included in the municipal budget.
Eleventh employees to participate in the basic old-age insurance for enterprise employees, industrial injury insurance and basic medical insurance for urban employees and other social insurance, enjoy the corresponding social insurance benefits.
Article 12 Employees shall not enjoy other welfare benefits other than the wages and welfare benefits stipulated in these Measures during their employment.
Article 13 The adjustment of employees' annual salary standard shall be put forward by the Municipal Bureau of Human Resources and Social Security according to the economic and social development level and financial situation of our city, taking into account the changes of civil servants' allowances and prices, and implemented after being submitted to the Municipal Finance Bureau for approval.
Chapter V Labor Contract
Article 14 The employing unit shall sign employment contracts with employees in accordance with the principles of equality, voluntariness and consensus through consultation and other relevant provisions of the Labor Contract Law.
Article 15 The term of a labor contract shall be determined by the employing unit according to the employee's post tasks. However, the initial employment period does not exceed 3 years, and can be renewed after passing the examination.
The probation period may be agreed by the employer for the first time, but the longest probation period shall not exceed 6 months. The probation period is included in the employment period.
Article 16 A labor contract shall be terminated at the expiration of its term or when the conditions for termination agreed by the parties appear.
The labor employment contract may also be modified or terminated with the consent of both parties through consultation.
Seventeenth employers or workers need to unilaterally terminate the labor employment contract, it should meet the conditions and procedural requirements of the Labor Contract Law and other relevant provisions.
Eighteenth after the termination of the labor relationship between the employee and the employer, the employer shall handle the social insurance relationship formalities for the employee in a timely manner in accordance with the relevant provisions.
Chapter VI Management and Assessment
Nineteenth employees should strictly abide by the rules and regulations of the employer; The employing unit shall establish and improve the rules and regulations of the unit, and strengthen the work guidance, training, assessment and daily management of employees.
Twentieth staff flow management. If an employee leaves the company due to the expiration of the employment contract, normal flow, resignation, dismissal or retirement, the employing unit shall, within 5 working days after the employee leaves the company, report to the Municipal Commission Office, the Municipal Human Resources and Social Security Bureau and the Municipal Finance Bureau for handling relevant formalities. After verification by the relevant departments, the deduction and change of wages and the settlement and transfer of social insurance relations shall be handled.
The employer shall not conceal the delay in reporting the change of employee turnover, so as to prevent the occurrence of false reporting of empty salary.
Article 21 Management of employee files. During the employment period, the employment contract, annual assessment materials, reward and punishment materials, academic materials and other materials that need to be filed shall be submitted to the employing unit for personal files.
Article 22 Assessment of employed personnel. The assessment of employees is based on the employment contract, according to the performance of employees and the comments of the masses, and the specific assessment methods are formulated by the employer according to the positions of employees. The assessment of employees is divided into two grades: qualified and unqualified.
Chapter VII Supplementary Provisions
Article 23 Where a dispute arises between a laborer and an employer due to the performance of a labor contract, they may apply to a labor and personnel dispute arbitration institution for arbitration according to law.
Twenty-fourth these Measures shall be interpreted by the Municipal People's Social Security Bureau, the Municipal People's Social Security Bureau and the Municipal Finance Bureau according to their respective functions.
Article 25 These Measures shall come into force as of the date of promulgation, and the Trial Measures for the Management of Employees Employed by Administrative Organs Directly under Qingyuan Municipality (Qingji [2010] No.48) shall be abolished at the same time.
