The detailed rules for the implementation of the investigation and political examination of the people's police employed by public security organs in Zhejiang Province are hereby issued.

Detailed rules for the implementation of Zhejiang public security organs' employment of people's police for investigation and political examination

Article 1 In order to standardize the investigation and political examination of the employment of the people's police by public security organs in our province, these rules are formulated in accordance with the People's Police Law, the Civil Service Law, the Provisions on the Employment of Civil Servants (for Trial Implementation) and the Implementation Rules for the Investigation of the Employment of Civil Servants in Zhejiang Province (for Trial Implementation).

Article 2 These Rules shall apply to the investigation and political examination of the people's police employed by public security organs at all levels in our province.

Article 3 The objects of investigation and political examination refer to those who have passed the examination and passed the physical examination according to the proportion stipulated in the recruitment announcement of civil servants (people's police).

Article 4 The competent departments of civil servants at or above the county level and the public security organs at higher levels shall guide, supervise and coordinate the investigation and political examination of the employment of the people's police, and the public security organs shall organize and implement them.

Article 5 When conducting investigation and political review, the public security organ shall set up investigation and political review teams, each consisting of two or more party member policemen with strong sense of responsibility, decent style and impartiality.

Article 6 If there is husband-wife relationship, lineal consanguineous relationship, collateral consanguineous relationship within three generations, close in-laws relationship or other circumstances that need to be avoided when performing official duties, the members of the investigation and political review team shall be avoided.

Article 7 If it is really necessary to go abroad for inspection and political review, it may be entrusted to China's embassies and consulates abroad and the offices of the special commissioners of the Ministry of Foreign Affairs in Hongkong and Macao.

Article 8 The contents of inspection and political review mainly include political ideology, moral quality, law-abiding, ability and quality, work (study) performance and post qualifications, situations that should be avoided, and the situation of spouse, immediate family members and close relatives.

Ninth inspection and political examination period is generally 60 days, counting from the date of publication of the list of inspection and political examination objects. The conclusion that the inspection and political examination are qualified or unsuitable for being employed as the people's police shall be made during the inspection and political examination.

Tenth in the investigation and political examination found that one of the following circumstances, shall not be employed as the people's police:

(a) a serious violation of the party's line, principles, policies and national laws, and identified by the relevant departments;

(2) Being expelled from the Party membership of China and the Communist Youth League of China;

(3) Having received criminal punishment, public security punishment, juvenile discipline and reeducation through labor, or having been arrested in judicial custody in the past two years;

(4) Organizing and using superstitious activities to disturb social order and harm the health of others, and being punished by the relevant departments;

(5) Being warned by the Party or the Communist Youth League for less than one year or being severely warned for less than two years;

(6) Being expelled, dismissed or the labor (employment) contract is dissolved by the unit due to serious violation of discipline and rules and regulations, or being given a warning or more punishment in colleges and universities or work units due to subjective reasons, or being determined to be unqualified 1 time or more in the annual assessment of public institutions in recent two years;

(7) Having participated in gambling, cult, pornography, drug abuse, theft, corruption, bribery, fraud and other illegal and disciplinary activities, and being recognized by the relevant departments;

(8) Having participated in underworld organizations or other illegal organizations and being recognized by the relevant departments;

(9) The spouse, lineal relatives or close relatives are sentenced to death or sentenced to punishment for endangering national security, or are serving sentences for other crimes;

(10) The spouse, lineal relatives or close relatives are being investigated and controlled by political and legal organs due to serious political mistakes or criminal suspects, or there are backbone members of cult organizations who stubbornly adhere to wrong positions;

(eleven) spouse, lineal relatives, close relatives engaged in China's political activities outside the country (territory), or unable to find out the political background of people outside the country (territory) within 30 days after the expiration of the inspection period;

(twelve) do not meet the qualifications, or resort to deceit in the recruitment process;

(thirteen) there are other circumstances that are not suitable for employment as the people's police.

If an audit or disciplinary review is under way for being suspected of violating the law and discipline, or if the judicial procedure is not yet completed for being suspected of committing a crime, the investigation and political review conclusion may be suspended. Within 30 days after the end of the investigation and political examination period, if the above-mentioned examination, review or judicial procedure has not yet ended, the conclusion of the investigation and political examination is that it is not suitable to be employed as a people's police.

Eleventh main methods of investigation and political examination:

(a) to investigate the party organizations, work units (schools), personnel and security departments, as well as the domicile, residence, police station and community (village) to understand the situation;

(two) to investigate the political object of the party organization, work unit (school) personnel and social security departments, police stations and spouses, lineal relatives, close relatives of the community (village) to understand the situation;

(three) to conduct individual interviews with the person under investigation and other relevant personnel;

(four) access to the investigation and political examination object files and related materials.

Article 12 After the inspection and political examination, the inspection and political examination team shall put forward suggestions on the conclusion of the inspection and political examination, fill in the Inspection and Political Examination Form for Employed People's Police, and the employed public security organ shall study the inspection and political examination and make the conclusion of the inspection and political examination. The political examination form for employing the people's police must be signed by all members of the political examination team, and the attached certification materials should indicate the source, and the inspectors and relevant witnesses are required to sign or affix their official seals.

Article 13 after investigation and political examination, anyone who reflects or reports the object of investigation and political examination shall be openly recruited? Or the public security organ at a higher level can investigate and verify with the recruited public security organ, and the recruited public security organ will make a new investigation and political examination conclusion.

Article 14 If the conclusion of investigation and political examination is that it is not suitable to be employed as the people's police, the public security organ at the place of recruitment shall inform it in writing and inform it that if it disagrees with the conclusion of investigation and political examination, it may apply for administrative reconsideration or bring an administrative lawsuit according to law.

Article 15 The term "immediate family members" as mentioned in these Detailed Rules refers to parents (including stepparents and adoptive parents), grandparents, grandparents and children; Close relatives refer to brothers and sisters from parents (including half brothers and sisters), uncles and aunts from grandparents, and uncles and aunts from grandparents.

Sixteenth staff who violate these rules should be criticized and educated, transferred from their posts or given disciplinary sanctions according to relevant regulations.

Seventeenth transferred to the public security organs as the people's police, the inspection and political examination work in accordance with the implementation details.

Article 18 If the state has other provisions on the inspection and political review of the people's police of public security organs, those provisions shall prevail.

Article 19 These Rules shall come into force as of the date of promulgation. The Measures for the Implementation of the Examination for Recruiting People's Police issued by Zhejiang Provincial Personnel Department and Zhejiang Provincial Public Security Department in May 2007 1995+07 shall be abolished at the same time.
