Measures of Shenzhen Municipality on the Administration of Housing Safety

Chapter I General Provisions Article 1 In order to strengthen the management of housing safety and maintain public safety and social order, these Measures are formulated in accordance with the provisions of relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the management and supervision of the safety of houses and curtain walls that have been built and put into use within the jurisdiction of this Municipality.

The fire safety management of houses and the use and safety management of professional facilities and equipment such as elevators, gas, water supply and power supply shall be implemented in accordance with relevant laws, regulations and rules.

If there are other provisions in laws and regulations on the housing safety management of the military, cultural relics protection units, religious groups and other institutions, those provisions shall prevail. Article 3 Housing safety management shall follow the principles of putting prevention first, combining prevention with control, territorial management and subject responsibility. The fourth Municipal People's government is responsible for leading the city's housing safety management, establishing and improving the housing safety management system and mechanism, and coordinating and supervising the housing safety management.

The people's governments of all districts (including the Administrative Committee of the New District, the same below) are responsible for the organization, leadership and comprehensive coordination of housing safety management within their respective jurisdictions, ensuring the investment of housing safety management funds, strengthening law enforcement, establishing a grid-based and normalized supervision system for housing safety, and improving the emergency mechanism for housing safety emergencies. Article 5 The municipal housing administrative department is the competent department of housing safety management in the whole city (hereinafter referred to as the municipal competent department), and shall perform the following duties:

(a) to organize the drafting of policies, regulations and technical standards for housing safety management;

(two) to co-ordinate and guide the city's housing safety management;

(three) to supervise the housing safety inspection and appraisal market;

(four) the organization of housing safety publicity and training;

(five) other duties stipulated by laws, regulations and rules and the Municipal People's government. Article 6 The district housing administrative department is the competent department of housing safety management in this area (hereinafter referred to as the district competent department), and shall perform the following duties:

(a) regularly organize the investigation of housing safety and building curtain wall safety hazards;

(two) to guide and urge the street offices to carry out emergency drills and deal with housing safety emergencies;

(three) to investigate and deal with illegal acts that endanger the safety of houses;

(four) the housing safety inspection report for the record;

(five) to carry out housing safety publicity and training;

(six) other duties stipulated by laws, regulations and rules and the District People's government.

Housing safety management agencies are entrusted by the municipal and district authorities to undertake specific affairs such as housing hidden danger investigation and information management.

District authorities may entrust street comprehensive administrative law enforcement units to implement administrative law enforcement for illegal acts in the process of housing use. Article 7 The department of planning, land and resources shall be responsible for providing information such as housing land area, land use, construction area, use function, term and ownership. And update in real time, guide and assist the sub-district office to register the responsible person for housing safety within its jurisdiction.

The illegal investigation department shall, in accordance with its duties, do a good job in the safety management of illegal buildings left over from history, and dismantle illegal buildings left over from history that have serious structural safety hazards and cannot be rectified and eliminated according to law.

Education, civil affairs, transportation, culture, radio, film and television, tourism, sports, health and other departments should urge the responsible persons of public buildings in this industry to carry out regular housing safety inspections to eliminate hidden dangers in time.

Public security, finance, emergency management, market supervision, urban management, housing leasing and other departments shall, in accordance with their duties, cooperate with the housing safety management. Article 8 Sub-district offices shall, under the leadership of the District People's Government, implement the responsibility of territorial management, designate full-time personnel to implement grid and normal management of housing safety in their respective areas, and perform the following duties:

(a) responsible for the registration of housing safety responsible person;

(two) to urge the person in charge of housing safety to inspect and maintain the house, and to find and identify potential safety hazards;

(three) to urge the owners' committee and the realty service enterprise to carry out the relevant work of housing safety management;

(four) to carry out the investigation of housing safety hazards, and to be responsible for the supervision and coordination of dangerous houses;

(five) according to the law to deal with housing safety emergencies;

(six) to assist the relevant departments of the city and district to carry out housing safety publicity and training;

(seven) other duties stipulated by laws, regulations, rules and the municipal and District People's governments. Ninth housing owners, historical illegal construction parties (managers) or public housing management units are responsible for housing safety.

If the ownership of the house is unclear or the owner of the house or the party (manager) of illegal construction left over from history is missing, the actual user of the house is the person responsible for housing safety.

If the owner of the house or the party (manager) of the illegal building left over from history is inconsistent with the actual user of the house, the actual user of the house shall use the house reasonably in accordance with the provisions of laws and regulations and the contract, and bear the corresponding responsibility for housing safety. Article 10 The municipal competent department shall establish a unified housing safety information management platform for the whole city, and the information of dangerous houses involving public safety shall be made public to the public through the platform.

The district competent department shall be responsible for the management of housing safety information within its jurisdiction, supervise and guide street offices or professional institutions to input and update housing safety information as required, and regularly make statistics and publish housing safety information.

Real-time docking of housing safety information with management system information such as public security, market supervision, housing lease, real estate registration, and handling of illegal buildings left over from history will jointly realize the prevention and control of housing safety hazards in the city.
