What procedures and materials are needed for marriage registration?

The current marriage registration process can be roughly divided into three links: application, examination and registration.

(1) application

Those who meet the conditions for marriage registration shall bring relevant certification materials and registration photos, and both parties shall apply for marriage registration at the marriage registration office where one party's permanent residence is located, and fill in the declaration required for applying for marriage registration on the spot.

Different people have different requirements on the documents and supporting materials for applying for marriage registration. For example, when China citizens apply for marriage in China, they must hold their ID card, household registration book, marriage examination certificate, single certificate and declaration of no blood relationship (lineal blood relatives and collateral blood relatives within three generations) and other materials. Divorced, you must also hold a divorce certificate or proof materials.

Foreigners (including foreigners residing or temporarily staying in China, China people and foreigners residing in China) applying for marriage in Chinese mainland need to hold their own identity documents (passports or other nationality certificates), Alien Residence Permit issued by public security organs or valid temporary residence certificate in China, and proof of marital status issued by embassies and consulates in China.

(2) Review

The marriage registration office will examine the application of the parties to determine whether the marriage application submitted by them meets the requirements. If the application materials submitted are unclear, the marriage registration authority will generally ask the parties and ask them to provide relevant materials when necessary.

(3) Registration and licensing

The marriage registration office will register eligible couples and then issue marriage certificates; For divorced people, the marriage registration office will cancel their divorce certificates; If necessary, a written statement will be issued to those who do not meet the conditions for marriage registration, explaining the reasons for not registering.

What procedures and documents do you need for divorce?

The divorce registration process is as follows:

(1) application

If a husband and wife voluntarily divorce, they shall sign a written divorce agreement, apply to the marriage registration authority with jurisdiction, and provide the following documents and supporting materials:

1, marriage certificate issued by mainland marriage registration authority or Chinese embassy (consulate) abroad;

2. Identity documents required for divorce registration, such as household registration book, ID card, Hong Kong, Macao and Taiwan pass, passport, etc. ;

3. An application for divorce registration filled in at the marriage registration office.

(2) Accept

The staff will conduct a preliminary examination of the materials provided by the parties in accordance with the regulations. After the documents and certification materials submitted by the parties have been verified in the first instance, a "Receipt for Accepting the Application for Divorce Registration" will be issued. If the application conditions for divorce registration are not met, the divorce shall not be accepted, and if necessary, the notice of rejection of divorce registration application shall be issued at the request of the parties concerned.

(3) cooling-off period

Within 30 days from the date when the marriage registration office receives the application and issues the Receipt for Accepting the Application for Divorce Registration to the parties concerned, any party unwilling to divorce can bring his valid identity certificate and the Receipt for Accepting the Application for Divorce Registration (if lost, it is not required to provide a written explanation) to the divorce registration office that accepts the application for divorce registration, and fill out the Application for Withdrawal of Divorce Registration according to the regulations. After verification by the staff of the marriage registration office, a "Confirmation of Withdrawal of Divorce Registration" will be issued to the parties concerned, and the application for divorce registration, the application for withdrawal of divorce registration and the confirmation of withdrawal of divorce registration will be filed together. Within 30 days after the expiration of the cooling-off period for divorce, if both parties fail to jointly apply to the marriage registration authority for a divorce certificate, it shall be deemed that both parties are unwilling to divorce and withdraw their application for divorce registration.

(4) Review

Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the period expires is a holiday, the first day after the holiday will be the expiration date of the cooling-off period), both parties should bring their recent bareheaded photos, divorce agreement, marriage certificate, ID card, passport or pass and other relevant documents and materials to the marriage registration authority to jointly apply for the issuance of divorce certificates. The marriage registration authority shall conduct an examination in accordance with the provisions, and those who do not meet the requirements for divorce registration shall not be handled. If a party requests to issue a notice not to register for divorce, it shall issue it.

(5) Registration (certification)

The marriage registration authority shall carry out relevant registration in accordance with the relevant provisions and issue divorce certificates to the parties.
