Article 2 People's Republic of China (PRC) implements socialist public ownership of land, that is, ownership by the whole people and collective ownership by working people. No unit or individual may occupy, buy, sell, lease or illegally transfer land in other forms. In order to meet the needs of public interests, the state may expropriate collectively-owned land in accordance with the law.

Article 3 People's governments at all levels must implement the policy of cherishing and rationally utilizing land, make overall plans, strengthen management, protect and develop land resources, and stop indiscriminate occupation and abuse of land.

Article 4 Units and individuals that have made outstanding achievements in the protection and development of land resources, rational use of land and related scientific research shall be rewarded by the people's government.

Article 5 The land administration department of the State Council is in charge of the unified management of land throughout the country.

The land administration department of the local people's government at or above the county level shall be in charge of the unified management of land within its administrative area, and its institutional setup shall be determined by the provinces, autonomous regions and municipalities directly under the Central Government according to the actual situation.

The people's governments at the township level shall be responsible for the land management within their respective administrative areas.
