(1) The main person in charge of the construction unit or the person in charge of the project refuses to accept the management, violates the rules and regulations and operating procedures, and takes risks, thus causing certain harmful consequences. ;

(2) Punishment standard: the main person in charge of the construction unit and the person in charge of the project shall be fined from 80,000 yuan to 6,543.8+0.5 million yuan, or dismissed according to the management authority.

3, the performance of serious violations:

(1) The main person in charge of the construction unit and the person in charge of the project refuse to accept management, violate rules and regulations and operating procedures, and take risks in operation, thus causing serious harmful consequences;

(2) Punishment standard: the main person in charge of the construction unit and the person in charge of the project shall be fined from 6,543,800 yuan to 0.5 million yuan but not more than 200,000 yuan, or dismissed according to the management authority.

The full-time safety production management personnel of the safety production management institution of construction enterprises shall have the following duties in the construction site inspection:

3. Supervise the performance of full-time safety production management personnel of the project;

To sum up, the main person in charge of the construction unit generally refers to the legal representative, general manager, chief engineer (technical director) and safety director (vice president of safety). These personnel need to have a certificate, that is, the certificate of safety production assessment of the person in charge of the enterprise (a certificate).

(a) safety protection articles, machinery and equipment, construction machines and accessories are put into use without inspection or unqualified inspection before entering the construction site;

(two) the use of construction hoisting machinery and integral lifting scaffolding, templates and other jack-up erection facilities without acceptance or unqualified acceptance;

(3) Entrusting units without corresponding qualifications to undertake the installation and dismantling of construction hoisting machinery on the construction site and the overall promotion of jack-up erection facilities such as scaffolding and formwork;

(four) in the construction organization design, no safety technical measures, temporary electricity utilization scheme or special construction scheme are compiled.

Article 66

In violation of the provisions of this Ordinance, the main person in charge of the construction unit and the person in charge of the project fail to perform the duties of safety production management, and shall be ordered to make corrections within a time limit; Overdue correction, ordered the construction unit to suspend business for rectification; If a serious safety accident, serious casualty accident or other serious consequences are caused, which constitutes a crime, criminal responsibility shall be investigated in accordance with the relevant provisions of the Criminal Law. If an operator refuses to accept management and violates rules, regulations and operating rules, causing heavy casualties or other serious consequences, which constitutes a crime, he shall be investigated for criminal responsibility in accordance with the relevant provisions of the Criminal Law. The main person in charge of the construction unit and the person in charge of the project have committed the illegal acts mentioned in the preceding paragraph, which are not serious enough for criminal punishment, and shall be fined 20,000 yuan to 200,000 yuan or dismissed according to the management authority; Since the execution of the punishment or the date of punishment, he shall not be the main person in charge of any construction unit or the person in charge of the project within 5 years.
