Yunnan Longling Huang Longyu Resources Management Regulations

Article 1 In order to strengthen and standardize the management of resources in Longling Huang Longyu, rationally develop and utilize resources, protect the ecological environment and promote sustainable economic and social development, these Regulations are formulated in accordance with the Mineral Resources Law of People's Republic of China (PRC) and other relevant laws and administrative regulations. Article 2 The resources of Longling Huang Longyu mentioned in these Regulations refer to the aggregate of aphanitic and microcrystalline minerals mainly composed of silica formed by geological processes in Longling County, Yunnan Province, including Huanglong jade mine and its processed products. Article 3 These Regulations shall apply to the exploration, exploitation, processing, sales and management of Huang Longyu resources in Longling District. Fourth Longling Huang Longyu resources management should adhere to the principles of protecting resources and environment, unified planning, rational development and comprehensive utilization, and safeguard the interests of the state, the collective and the individual. Article 5 Longling County People's Government shall be responsible for the resource management of Huanglongyu within its administrative area, organize the preparation of Huang Longyu's resource development plan and annual mining plan, and formulate scientific and reasonable measures for the distribution of benefits. Sixth Longling County People's Government Huang Longyu Resource Management Agency is responsible for organizing and coordinating the Huang Longyu resource management within their respective administrative areas, and performing the following main duties:

(a) to carry out legal publicity, cultivate jade carving talents, and organize cultural research in Huang Longyu;

(two) responsible for the daily inspection of resource management in Huang Longyu, organize and coordinate relevant departments to investigate and deal with illegal cases and disputes;

(three) to provide information services for government decision-making and the rational development and utilization of Huang Longyu resources by enterprises.

Longling County People's Government development and reform, industry and information technology, land and resources, environmental protection, public security, industry and commerce, forestry, agriculture, water affairs, safety supervision, quality and technical supervision and other departments and Huanglongyu Mining Township (town) People's Government shall, according to their respective functions and duties, do a good job in resource management in Huang Longyu. Article 7 Huang Longyu Association of Longling County shall strengthen industry self-discipline, maintain industry reputation, and provide price consulting services for Longling Huang Longyu. Eighth Longling County People's Government shall formulate incentives for reporting resources management in Huang Longyu, and encourage units and individuals to report illegal acts in the management, development and utilization of resources in Huang Longyu. Article 9 An application for exploration of Huang Longyu resources in Longling shall be approved and registered by the provincial administrative department of land and resources, and an exploration license with jade (Huang Longyu) as the mineral species shall be issued. Apply for the exploitation of Longling Huang Longyu resources, and the reserve scale is medium or above, and be examined and registered by the provincial administrative department of land and resources, and issue a jade (Huang Longyu) mining license; Small reserves, by the administrative department of land and resources of Baoshan city for examination and registration, issued a jade (Huang Longyu) mining license.

The criteria for dividing the scale of small reserves of Huanglongyu in Longling are determined by the provincial administrative department of land and resources in conjunction with the Longling County People's Government.

To apply for exploration license and mining license, it shall be reported to Longling County People's Government for comments in advance. The prospecting and mining rights holders shall, within 10 days from the date of obtaining the exploration license and mining license, submit the exploration license, mining license and related materials to the administrative department of land and resources of Longling County for the record, and accept their supervision and management. Tenth exploration and exploitation of Longling Huang Longyu resources, should have legal qualifications, and according to the law for exploration license and mining license.

In violation of the provisions of the preceding paragraph, any of the following acts shall be ordered by the administrative department of land and resources of Longling County to stop the illegal act, close the mine and bury the pit, and be punished in accordance with the following provisions:

(a) without obtaining the exploration license, mining license, unauthorized exploration and mining of Huang Longyu, the mining of Huang Longyu ore and illegal income, and impose a fine of less than 50% of the illegal income;

(2) If the exploration license and mining license expire, and the Huang Longyu is not explored and mined for continuation, and the prospecting right holder has no mining right to explore instead of mining, the mined Huang Longyu ore and illegal income shall be confiscated, and a fine of less than 40% of the illegal income shall be imposed;

(three) beyond the approved scope of exploration and exploitation of Huang Longyu, the confiscation of Huang Longyu ore and illegal income, and impose a fine of less than 30% of the illegal income; Refuse to accept supervision, do not return to the mining area for exploration and mining, resulting in the destruction of mineral resources, and report to the issuing authority to revoke the exploration and mining license. Eleventh the following areas and facilities within the scope of safety prohibit the exploitation of Longling Huang Longyu resources:

(1) Schools, military camps and factories;

(two) towns and villages (residents) concentrated residential areas;

(3) roads and railways;

(4) Reservoirs, rivers, main water diversion channels and urban and rural water supply sources;

(5) Transmission lines, iron towers and oil and gas pipelines.

In violation of the provisions of the preceding paragraph, the administrative department of land and resources of Longling County shall order it to stop the illegal act, compensate for the losses, confiscate the mined Huang Longyu ore and illegal income, and impose a fine of 50,000 yuan to 6,543,800 yuan. Twelfth prohibit theft or looting of Huang Longyu ore; It is forbidden to provide construction machinery, transportation tools, power equipment and other facilities for the illegal exploitation of Huang Longyu resources; It is forbidden to occupy, trade or illegally transfer land and forest land to exploit Huang Longyu resources in other forms; It is forbidden to hinder the staff of state organs from performing their duties of resource management in Huang Longyu according to law.

Violation of the provisions of the preceding paragraph shall be punished in accordance with the following provisions:

(a) theft or looting of Huang Longyu ore, hinder the staff of state organs to perform their duties of resource management in Huang Longyu according to law, by the Longling county public security organs in accordance with the provisions of the "China people's * * * and the national public security management punishment law" shall be punished;

(II) To provide convenient conditions such as construction machinery, means of transport and electrical equipment for enterprises and individuals who illegally exploit Huang Longyu resources, the administrative department of land and resources of Longling County shall order them to stop the illegal act, seize the operating equipment, confiscate the mined Huang Longyu ore and illegal income, and impose a fine of not less than 5,000 yuan but not more than 20,000 yuan;

(3) Where Huang Longyu resources are exploited by other means by occupying, trading or illegally transferring land and forest land, the administrative department of land and resources of Longling County shall order it to stop the illegal act, confiscate the illegal income and may impose a fine of less than 50% of the illegal income.
