Interim Measures of Nanjing Municipality on the Administration of Designated Retail Drugstores of Basic Medical Insurance
Article 1 In order to further strengthen and standardize the management of designated retail pharmacies with basic medical insurance in this Municipality, according to the Decision of the State Council on Establishing the Basic Medical Insurance System for Urban Employees (Guo Fa [1998] No.44), the Interim Measures for the Management of Designated Retail Pharmacies with Basic Medical Insurance for Urban Employees (Ministry of Labor and Social Security 1999) and the Interim Measures for the Management of Designated Retail Pharmacies with Basic Medical Insurance for Urban Employees in Jiangsu Province.
Article 2 The designated retail pharmacies for basic medical insurance as mentioned in these Measures (hereinafter referred to as "designated retail pharmacies") refers to retail pharmacies that have obtained the Drug Business License with the approval of the food and drug supervision and administration department, and signed the designated service agreement for basic medical insurance with the medical insurance agencies in the overall planning areas of this Municipality (hereinafter referred to as "medical insurance agencies") to provide basic medical insurance medication services for the insured persons of basic medical insurance.
Article 3 The basic principles for the examination and determination of designated retail pharmacies are: total amount control, rational layout, optimal layout, and the implementation of fixed-point access and exit system; Ensure the variety and quality of basic medical insurance drugs; Introducing competition mechanism to control the cost of drug service reasonably; Take classified management services to facilitate the insured to purchase medicines.
Designated retail pharmacies choose retail pharmacies that meet the quality management standards (GSP); Chain operation is a single fixed point with facade as the unit, not a chain fixed point.
Article 4 The municipal labor security administrative department shall be responsible for the examination and approval, supervision and management of the qualifications of designated retail pharmacies within the overall planning area of this Municipality. The administrative department of labor security of the county (district) is responsible for the examination and approval, supervision and management of the qualifications of designated retail pharmacies in this overall planning area.
City, county (District) medical insurance agencies in accordance with the division of responsibilities, specifically responsible for the specific management and supervision of the designated retail pharmacies in this co-ordination area.
Article 5 The municipal labor and social security administrative department shall, according to the coverage of basic medical insurance in the overall planning area, the basic medical needs of urban workers and the computer network capacity of medical insurance, formulate the overall planning of the layout of designated retail pharmacies, and regularly or irregularly publish the application information for the qualification of designated retail pharmacies according to the regional planning and the demand of the insured for drugs, and invite public bidding.
Article 6 Designated retail pharmacies shall meet the following qualifications and conditions:
(1) Having obtained the Pharmaceutical Trading License and the business license for normal operation for more than two years, and having obtained the GSP certification.
(2) Abide by the Drug Administration Law of People's Republic of China (PRC) and relevant laws and regulations, and have a sound drug quality assurance system, which can ensure the safety, effectiveness and service quality of drug supply.
(three) strictly implement the drug price policy stipulated by the national, provincial and municipal price management departments, and pass the supervision and inspection of the price management departments.
(four) strictly implement the relevant policies of the basic medical insurance system for urban workers, have a correct business philosophy and standardized service behavior, can make three commitments to the public, and consciously accept social supervision.
(5) Having two or more licensed pharmacists or pharmacists as business leaders (non-part-time or nominal), and ensuring that no less than/kloc-0 licensed pharmacists or pharmacists are on duty during business hours, and being fully responsible for the quality of drugs they handle.
Personnel engaged in drug sales, formulation, evaluation and storage must be trained by the municipal food and drug supervision and management department and hold relevant certificates; And regular physical examination, the establishment of health records.
(6) The business area exceeds 100 square meter (including 100 square meter), and a special medical insurance service area has been established. The counters in special service areas shall not be contracted, leased or transferred to other units or individuals for operation.
(7) The varieties of drugs (excluding Chinese herbal pieces) within the scope of the basic medical insurance drug list meet the requirements of classified management, and the drugs must have a ledger of "purchase, sale and storage" and be managed by computer according to GSP requirements. Have the ability to supply drugs in the basic medical insurance drug list in time and provide 24-hour service.
(eight) equipped with the necessary computer and computer management personnel to adapt to the basic medical insurance business.
(9) The warehouses for storing drugs shall be dry, ventilated, moisture-proof, mildew-proof, rat-bite-proof, moth-eaten and pollution-proof, and have facilities for storing drugs that require special storage conditions.
(ten) strictly abide by the "Labor Law" and various laws and regulations, internal management norms, sign labor contracts with all employees according to law, participate in social insurance, and pay social insurance premiums in full and on time; Establish and improve various rules and regulations, and record the implementation and inspection of rules and regulations.
Seventh retail pharmacies that meet the conditions listed in Article 6 and are willing to undertake the designated services of basic medical insurance for urban workers may submit a written application to the administrative department of labor security in the overall planning area and provide the following materials:
(1) Application Form for Designated Retail Drugstore of Basic Medical Insurance for Urban Employees in Nanjing (see Annex).
(2) Drug business license, enterprise business license and labor security certificate, social insurance registration certificate (original and photocopy) and certification materials of qualified supervision and inspection by relevant departments.
(three) "good manufacturing practice" certification.
(four) the original and photocopy of the qualification certificate and registration certificate of licensed pharmacist or pharmacist; Registration of all employees; Drug dealer's employment certificate, original and photocopy of health certificate within the validity period, social insurance payment certificate and other related materials.
The retirees to be employed shall indicate and carry relevant labor service agreements.
(5) List of drug varieties and prices; Business purchase and sale, revenue and expenditure in the previous year.
(six) the management rules and regulations of retail pharmacies.
(seven) a copy of the property right certificate and the plan of the business place of the retail pharmacy, and indicate the location of the special medical insurance service area to be opened and the geographical location map of the pharmacy.
If the pharmacy premises are leased, a lease agreement of not less than 5 years shall be provided and the consent of the owner shall be obtained.

Article 8 If the application submitted by the administrative department of labor security for retail pharmacies is complete in content, complete in materials, standardized in management and qualified by law, it shall issue a notice of acceptance of non-administrative licensing examination and approval items within 5 days from the date of receiving the application materials; If the application materials are incomplete or do not meet the statutory qualifications, the applicant shall be informed of the reasons for rejection or the materials that need to be supplemented on the spot or within five days. Failing to inform the application materials within the time limit, it shall be deemed to be accepted as of the date of receipt of the application materials.
Article 9 After accepting the application materials submitted by the applicant, the administrative department of labor and social security shall conduct a preliminary examination of the retail pharmacies applying for designated qualifications in accordance with the provisions. On the basis of soliciting the opinions of the relevant departments, the units that have passed the preliminary examination shall assign relevant staff to conduct on-the-spot verification, and in combination with the results of regional planning verification, approve the qualifications of designated retail pharmacies on the basis of merit.
The list of retail pharmacies that meet the designated qualifications after examination and approval shall be publicized to the public for 30 days. Retail pharmacies that have no objection after publicity shall be issued with the qualification certificate of designated retail pharmacies by the administrative department of labor security.
Retail pharmacies that provide false materials, once verified, shall not apply for designated qualifications within three years.
Article 10 If, after examination, the application of a retail pharmacy does not meet the prescribed qualification conditions, the accepting organ shall make a decision to reject the application or not to designate the qualification according to law, explain the reasons, and inform the applicant that he has the right to apply for administrative reconsideration or bring an administrative lawsuit according to law.
Article 11 Medical insurance agencies shall, according to the needs of regional distribution and drug selection of insured persons, select and determine designated retail pharmacies within the scope of retail pharmacies with designated qualifications in accordance with the principle of giving priority to conditions, and uniformly announce them to the public. Retail pharmacies that have not been selected are designated as candidate retail pharmacies.
Twelfth medical insurance agencies should sign a medical insurance service agreement with the designated retail pharmacies, including the scope, content, quality, settlement method and control requirements of medical insurance, and clarify the responsibilities, rights and obligations of both parties. The agreement is valid for 1 year. If either party violates the agreement, the other party has the right to terminate the agreement, but it must notify the other party 30 days in advance and report to the local labor security administrative department and the food and drug supervision and administration department for the record.
Article 13 The medical insurance service scope of designated retail pharmacies is divided into three categories: Class A is general outpatient service; Class B is a chronic outpatient disease; Class C is a specific item of outpatient service.
The service scope of the designated retail pharmacies that signed the service agreement for the first time is Class A; If there is no violation for more than two years in a row, and the annual inspection score is 95 or above, it can apply to the medical insurance agency for the scope of B and C services. Medical insurance agencies should choose about 20% of the designated retail pharmacies to provide Class B services and 10% of the designated retail pharmacies to provide Class C services according to the drug purchase demand of the insured and the service quality and service level of the designated retail pharmacies. The service scope of Class A, B and C can be both.
Fourteenth in addition to the government regulations, the designated retail pharmacies shall not change their addresses at will. If a designated retail pharmacy changes its address due to government regulations, it shall reapply for designated qualification to the administrative department of labor and social security within 15 working days from the date of change. Designated retail pharmacies that change their addresses for other reasons shall be disqualified.
If the basic information such as the name and legal representative of the designated retail pharmacy changes, it shall go through the registration formalities with the administrative department of labor and social security within 15 working days from the date of approval of the change. If the formalities are not completed within the time limit, the medical insurance agency shall suspend the settlement of its medical insurance expenses; If the formalities have not been completed for more than three months, the designated qualification will be cancelled.
Fifteenth designated retail pharmacies should strengthen the following management work: equipped with full-time (part-time) staff responsible for the management of basic medical insurance drug services in our store, and cooperate with medical insurance agencies to do a good job in various management work; Establish and improve the corresponding management system in accordance with the provisions of the basic medical insurance, and establish separate accounts for the drug circulation and drug expenses of the insured; Provide information and list of accounts related to the cost audit of medical insurance agencies, and regularly inform the medical insurance agencies of the implementation of medical insurance agreements.
Sixteenth designated retail pharmacies shall provide drug purchase services for the insured in accordance with the provisions, and shall not have any of the following acts:
(a) sales personnel who have not obtained the training certificate of the food and drug supervision and administration department sell drugs in the medicine cabinet;
(two) advertising in the name of designated retail pharmacies;
(3) No licensed pharmacist or pharmacist is on duty during the business period;
(4) Licensed pharmacists or pharmacists change prescriptions without checking prescriptions according to regulations, or there is no designated medical institution to prepare prescriptions and prescription drugs;
(5) Failing to stop drug buyers from using forged or altered medical insurance vouchers to purchase drugs;
(six) to provide labor security cards for retail pharmacies or medical institutions that have not obtained designated qualifications;
(seven) underreporting or concealing the number and base of social insurance contributions;
(eight) a lift dispensing, medicine dressing, medicine for things;
(9) Illegally obtaining a special prescription for external use of medical insurance and forging a doctor's prescription to prescribe drugs;
(10) Contract, lease or transfer our counter to other units or individuals for operation;
(eleven) failing to pay and withhold social insurance premiums in accordance with the provisions, and refusing to make rectification after being ordered to make rectification within a time limit or failing to make rectification within the time limit;
(twelve) serious violation of the relevant provisions of the basic medical insurance, resulting in fund losses and adverse social impact;
(thirteen) fraud, defrauding the basic medical insurance fund;
(fourteen) other serious violations of medical insurance regulations.
Seventeenth medical insurance agencies should strengthen the inspection and supervision of the medical insurance services of designated retail pharmacies, and the medical insurance agencies will not pay the fees in violation of the provisions. Designated retail pharmacies in violation of the provisions of article sixteenth of these measures, medical insurance agencies should be submitted to the administrative department of labor security in accordance with the relevant provisions of the investigation; If the circumstances are serious, its designated qualification shall be cancelled, and the pharmacy whose designated qualification has been cancelled shall not apply for designated qualification again within two years; Causing losses to the basic medical insurance fund, the medical insurance agency shall fully recover the expenses in violation of the provisions and deal with them according to the relevant provisions; If a crime is constituted, criminal responsibility shall be investigated according to law.
Eighteenth at the end of each year, the administrative department of labor and social security shall, jointly with the relevant departments of drug supervision and administration, health, price and finance, conduct an annual comprehensive inspection and assessment of the implementation of medical insurance regulations and service agreements in designated retail pharmacies.
If the annual inspection score is above 80, both parties can renew the service agreement. If the annual inspection score does not meet the prescribed standards, it shall be ordered to make rectification, and the service agreement shall be renewed after rectification; If the rectification is unqualified, it shall be reported to the administrative department of labor security for approval, and its designated qualification shall be suspended until its designated qualification is cancelled.

Nineteenth retail pharmacies have objections to the administrative actions of the administrative department of labor security, they may apply for administrative reconsideration or bring an administrative lawsuit according to law.
Retail pharmacies, insured persons and other citizens and organizations have objections to the administrative acts of medical insurance agencies, and may apply for review or bring an administrative reconsideration according to the provisions of the Measures for Handling Social Insurance Administrative Disputes; The applicant and the medical insurance agency have administrative cases that fall within the scope of the people's court, and the applicant may also bring an administrative lawsuit directly to the people's court according to law.
Twentieth counties (districts) that implement separate overall planning may formulate specific measures according to these measures and local conditions.
