Chapter I General Provisions Article 1 In order to standardize property management activities, safeguard the legitimate rights and interests of owners and property service enterprises, and establish a civilized and harmonious living environment, these Regulations are formulated in accordance with People's Republic of China (PRC) Property Law, the State Council Property Management Regulations, Shaanxi Property Management Regulations and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to residential property management and its supervision and management activities within the administrative area of this Municipality. Article 3 The term "residential property management" as mentioned in these Regulations refers to the activities that the owners of residential areas select property service enterprises, and the owners and the property service enterprises maintain, conserve and manage the houses and their supporting facilities and related sites in accordance with the property service contract, so as to maintain the environmental sanitation and order in the property management area. Article 4 The people's governments of cities and counties (cities, districts) shall strengthen the organization and leadership of property management, incorporate property management into the urban governance system, and establish and improve the comprehensive coordination mechanism of property management. Article 5 The municipal administrative department of housing and urban and rural construction is the administrative department in charge of property management in this Municipality, and shall supervise and manage the property management activities in this Municipality.

County (city, district) property management administrative department is responsible for the supervision and management of property management activities in this area.

City, county (city, district) people's government civil affairs, public security, planning, environmental protection, price, urban management and other departments. , should do a good job in the supervision and management of property management activities in accordance with their duties.

Street offices and town people's governments shall be responsible for the guidance, coordination and supervision of property management activities within their respective jurisdictions in accordance with the prescribed duties. Sixth neighborhood (village) committees shall assist the neighborhood offices and the town people's government to carry out property management related work. Seventh to encourage the establishment of property management associations in the property service industry, to carry out services, self-discipline and coordination in the property industry, and to maintain a good order in the property market. Article 8 The people's governments of cities and counties (cities, districts) shall speed up the construction of the credit system of the realty service industry, establish a credit information sharing platform, and regularly announce the credit status of realty service enterprises to the public. Chapter II Owners' Congress and Owners' Committee Article 9 If the conditions for the establishment of the owners' congress are met, the subdistrict office and the Town People's Government shall organize the establishment of the preparatory group for the first owners' congress within 30 days from the date of receiving the written application jointly signed by the construction unit or 10 or more owners.

The preparatory group consists of a staff member of the subdistrict office and the town people's government, a representative of the construction unit and five to seven owners' representatives.

The head of the preparatory group is the staff of the subdistrict office and the town people's government, and the members are recommended by the subdistrict office and the town people's government. If the owners have any objection to the members of the preparatory group, they shall be settled by the subdistrict office and the town people's government through coordination.

The recommendation method of the members of the owners in the preparatory group shall be determined by the sub-district office and the town people's government, and all owners shall be informed in advance. Tenth members of the preparatory group shall meet the following conditions:

In addition to the conditions specified in the preceding paragraph, the owners in the preparatory group shall also abide by the temporary management regulations and pay the property service fee. Eleventh the preparatory group of the owners' congress shall organize the first meeting of the owners' congress within 60 days from the date of its establishment.

The first meeting of the owners' congress shall vote on the management statute, the rules of procedure of the owners' congress and the election method of the owners' committee, and elect the owners' committee. Article 12 The administrative department in charge of property management shall provide training on property management law and business knowledge to the property management staff of subdistrict offices and town people's governments, members of the preparatory group of the owners' congress and members of the owners' committee, so as to improve the level of property management. Thirteenth owners' congress and owners' committee shall perform their duties in accordance with the relevant laws and regulations of property management and the relevant provisions of this Ordinance. Fourteenth owners' meeting, it shall notify all owners fifteen days before the meeting, neighborhood offices, Town People's Government shall participate in guiding and supervising the voting work of the owners' meeting.

The owners' representatives attending the meeting of the owners' congress shall submit written opinions to the owners' congress. Written opinions shall be signed by the owner's representative. The owners' committee shall establish an information disclosure system, and timely announce the signing and performance of property service contracts, the implementation of management regulations and the revenue and expenditure of public welfare undertakings and other important matters.
