Twenty-fourth construction units shall, before the sale of property, select and employ property service enterprises with corresponding qualifications through bidding to implement preliminary property management; With the approval of the county (city) and district real estate administrative departments, residential properties with less than three bidders or with a construction area of less than 50,000 square meters, and non-residential properties with a construction area of less than 20,000 square meters, property service enterprises with corresponding qualifications can be selected through agreement.

County (city) and district real estate administrative departments shall report the employment of property service enterprises by agreement to the municipal real estate administrative departments for the record.

Article 25 The construction unit shall refer to the model text of the prophase realty service contract formulated by the municipal real estate administrative department, sign a written prophase realty service contract with the selected prophase realty service enterprise, and report it to the county (city), district real estate administrative department, subdistrict office and township people's government for the record within 15 days after signing.

Twenty-sixth prophase realty service enterprises shall charge prophase realty service fees according to the winning bid price or the agreed price.

When the construction unit sells the property, it shall not promise to reduce or exempt the property service fee.

Article 27 After the preliminary realty service contract is signed, when the construction unit and the preliminary realty service enterprise go through the formalities for undertaking the inspection of the property, the construction unit shall hand over the following property files to the preliminary realty service enterprise and report them to the subdistrict office and the Township People's Government for the record.

(a) the property management area construction project planning general plan, completion general plan, single building, structure, equipment completion plan, supporting facilities, underground pipe network project completion plan, completion acceptance certificate and other information.

(2) Supply contracts (agreements) for water supply, power supply, gas supply, cable TV and communication, certificates of fire-fighting facilities, elevator use certificates, factory certificates and warranty cards of mechanical and electrical equipment, warranty agreements, installation, use and maintenance of facilities and equipment (including inspection reports and product certificates of manhole facilities) and other materials.

(four) other information necessary for property management, including the application for registration of housing ownership, various visas, records and certificates of project acceptance, inventory of owners and housing area, etc.

If all the materials listed in the preceding paragraph are not handed over, the construction unit shall make a detailed list of the materials that have not been handed over, and make a written commitment to make up the specific time limit.

The prophase realty service enterprise shall, when the prophase realty service contract is terminated, hand over the realty service premises and property files to the owners' committee.

Twenty-eighth prophase realty service enterprises to undertake new property projects, shall inspect the following parts and facilities of the property, and shall inform the construction unit in writing when problems are found, and the construction unit shall make timely rectification.

(1) Property part: generally including the foundation, load-bearing walls, columns, beams, floors, roofs, external walls, hallways, stairs, corridors, aisles, handrails, guardrails, elevator shafts, overhead floors and equipment rooms of buildings;

(2) Property equipment: generally including elevators, pumps, water tanks, lightning protection facilities, generators, power distribution equipment, water supply and drainage pipelines, wires, heating and air conditioning equipment, etc.

(3) Facilities used by the property: generally including roads, green spaces, artificial landscapes, fences, gates, letter boxes, billboards, street lamps, drainage ditches, ponds, sewage wells, septic tanks, garbage containers, sewage treatment facilities, parking facilities, education and entertainment facilities, fire control facilities, monitoring facilities, civil air defense facilities, garbage transfer facilities, etc.

(4) Property service rooms and other real estate facilities and equipment.

The prophase realty service enterprise shall submit the inspection in writing to the county (city), the district real estate administrative department, the subdistrict office and the township people's government for the record.

Article 29 If the prophase realty service contract is terminated in advance, the party who proposes to terminate the contract shall notify the other party in writing 90 days before proposing to terminate the contract, and the construction unit shall promptly hire a realty service enterprise with no less than the original qualification, and the realty service and charging standards shall be implemented according to the standards agreed in the original realty service contract.

The construction unit shall, within 10 days after the confirmation of the new prophase realty service enterprise, inform the property buyer in writing about the replacement of the prophase realty service enterprise, and also inform the county (city), district real estate administrative department, subdistrict office, township people's government, residents' committee and villagers' committee in writing.

Thirtieth when the construction unit records the price of commercial housing, it should be clear whether the garages, parking spaces and clubs built according to the planning requirements are included in the sales cost of commercial housing, and it should be clear when the commercial housing is sold.

Thirty-first did not obtain the "construction project planning permit (original)" of the construction project shall not be delivered, the real estate administrative departments shall not handle the registration of housing ownership.

Article 33 The construction unit shall undertake the warranty responsibility of the property according to the warranty period and scope stipulated by the state.

If the construction unit entrusts the prophase realty service enterprise to undertake the daily warranty work, it shall sign an entrustment contract.

The prophase realty service enterprise shall assist the owner or the owners' committee to contact the construction unit to implement the warranty responsibility.
