Procedures for renewal of property contract upon expiration

Legal analysis: the property management company should apply to the community industry Committee for renewal three months before the termination of the original property management service contract, and submit the draft renewal contract; The owners' committee shall, within 30 days after receiving the application for renewal of the contract from the property company, convene the owners' meeting to discuss and vote whether to continue to sign the contract with the current property service enterprise; Agree to update the draft text and submit it to the owners' meeting for consideration; After deliberation and approval, the industry committee will notify the realty service enterprise to sign the contract and put it on record.

Legal basis: Article 947 of the Civil Code of People's Republic of China (PRC).

Before the expiration of the realty service period, if the owners decide to renew their employment according to law, they shall renew the realty service contract with the original realty service provider before the expiration of the contract period. If the realty service provider does not agree to renew the employment before the expiration of the realty service period, it shall notify the owner or the owners' committee in writing 90 days before the expiration of the contract period, unless the notice period is otherwise stipulated in the contract.
