It is not illegal for the property to stop my electricity. How should I solve it?

According to China's civil code, property management regulations and other relevant laws and regulations, it is the owner's obligation to pay property fees on time. Failure to pay property fees not only infringes on the interests of property companies, but also infringes on the interests of owners who have paid property fees. The owner's failure to pay the property service fee on time is a violation of the agreement in the property service contract. For owners who breach the contract, the property can urge them to pay fees or solve them through legal channels.

However, the use of electricity, water and heating is in a supply contract relationship with the departments of power supply, water supply and gas supply. Property fee is the fee charged by the property company to the owner or user according to the property service contract. These two things are completely different, and the law does not give property companies the right to cut off water and electricity.

Property companies can't cut off water and electricity just because owners are in arrears with property fees. This way violates the rights and interests of residents and is illegal. If water supply and power failure cause losses to the owner, the owner may claim tort liability from the property company according to the Civil Code.

Because according to Article 45 of the Property Management Regulations: "In the property management area, water supply, power supply, gas supply, heating, communication, cable TV and other units shall charge relevant fees to the end users. If the realty service enterprise accepts the entrustment to collect the fees mentioned in the preceding paragraph, it shall not charge the owners any additional fees such as handling fees. " In other words, the contract subjects of the owner's electricity and water use are water supply companies and power supply companies, involving different contract parties. If the owner has paid the corresponding fee to the water and electricity supply company, the property management company has no right to interrupt the water and electricity supply to the owner without authorization.

If the owner finds that the property company has cut off power and water supply because the owner has not paid the property fee, he can report to the property supervision department on the premise of mastering the exact evidence, and the owner can also bring a lawsuit to the court to demand compensation from the property company.
