The contents of the Interim Measures for the Administration of Synchronous Delivery of Newly-built Commercial Residential Quarters and Municipal Public Infrastructure and Public Service Facilities in
Article 1 These Measures are formulated in accordance with the relevant laws, regulations and rules, combined with the actual situation of this Municipality, in order to strengthen the management of the simultaneous delivery and use of newly-built commercial residential quarters, municipal public infrastructure and public service facilities, standardize the behaviors of all parties involved in the construction of newly-built commercial residential quarters, and ensure the normal use of houses.
Article 2 These Measures shall apply to the synchronous debugging, supervision and management of newly-built commercial residential quarters, municipal public infrastructure and public service facilities within the administrative area of this Municipality.
Article 3 The municipal administrative department of land and resources, planning and construction shall be responsible for the supervision and management of the simultaneous delivery of residential quarters, municipal public infrastructure and public service facilities in this Municipality.
County land and resources, planning sub-bureau and construction administrative department are responsible for the specific supervision and management of synchronous delivery of residential quarters, municipal public infrastructure and public service facilities within their respective jurisdictions.
Article 4 Real estate development enterprises shall, in accordance with the requirements of planning opinions, allocate municipal public infrastructure and public service facilities in residential quarters, and build and deliver them simultaneously with residential buildings.
Public service facilities such as education, medical and health care, and community management services should be built and delivered before 50% of the total residential scale is completed; Other * * * public service facilities should be built and delivered before the total residential scale reaches 80%.
Article 5 When the administrative departments of land and resources of cities, districts and counties sign a contract with the land users for the assignment of the land use right for the development of residential quarters, they shall take the municipal public infrastructure, public service facilities and their construction sequence specified in the planning opinions as the assignment conditions, and stipulate that the land transferee shall go through the relevant examination and approval procedures with the relevant planning and construction administrative departments on the basis of the residential quarter construction plan (hereinafter referred to as the construction plan).
When there is a major change in the content of the construction scheme, the transferee shall inform the relevant administrative departments of land and resources, planning and construction within 10 working days after the change.
Article 6 A construction plan shall include the following main contents:
(a) the basic situation of residential district construction projects (table).
(two) the construction project schedule and safeguard measures.
(three) the construction of residential areas by stages, the construction plan should also include:
1, regional division by stages, regional boundaries and construction sequence;
2. The number of houses in each period and the construction area of each building;
3. The public service facilities, functions and building names in each stage of the project;
4, each phase of municipal public infrastructure projects and construction progress;
5, each stage of the project bidding and completion acceptance plan.
Article 7 A construction plan shall meet the following requirements:
(a) each phase of construction should include residential buildings, municipal public infrastructure (including roads and green spaces) and public * * * service facilities that meet the requirements of the second paragraph of Article 4 of these Measures, and the construction progress is reasonable.
(two) the project bidding and completion acceptance plan can ensure the simultaneous construction and delivery of residential and municipal public infrastructure and public service facilities.
(three) the regional boundary of the stage is roads or green spaces, and roads, road lighting and green spaces should be included in the construction scope of the previous stage.
(4) Each stage of construction shall include roads connected with main traffic roads and effective temporary isolation measures for the next stage of construction.
Article 8 A real estate development enterprise shall submit a building plan when applying for a construction project planning permit. The planning administrative department shall examine whether the application submitted by the real estate development enterprise meets the requirements of the planning opinions when handling the planning permit for the construction project of residential quarters, and indicate the public service facilities that are accepted at the same time with the residence.
Ninth construction administrative departments shall, when handling the bidding documents for the construction of residential quarters, examine whether the scope of construction bidding conforms to the construction plan.
The construction administrative department shall issue the construction permit according to the construction bidding scope determined by the construction drawing.
Article 10 When handling the pre-sale permit of commercial housing, the construction administrative department shall examine whether the pre-sale plan declared by the real estate development enterprise conforms to the construction plan.
Real estate development enterprises shall publicize the construction plan when pre-selling commercial housing, and write the construction plan and Article 13 of these Measures into the pre-selling contract of commercial housing as the delivery conditions agreed in the contract.
Eleventh construction engineering quality supervision institutions shall, in accordance with the scope of construction permits, supervise the quality of construction projects for residential buildings, municipal public infrastructure and public service facilities, and include the implementation of construction projects in the quality supervision report.
Twelfth real estate development enterprises shall, in accordance with the completion acceptance plan determined by the construction drawing, organize the design, construction and supervision units to carry out the completion acceptance of the residential district project.
Thirteenth residential areas in the construction of municipal public infrastructure and public service facilities and other projects meet the following requirements, real estate development enterprises can organize the completion and acceptance of residential projects:
(a) in accordance with the contents of the construction plan, complete the construction of municipal public infrastructure and public service facilities, and pass the completion acceptance.
(two) the planning and acceptance of public service facilities, with the conditions for putting into use, clear property rights, management rights and their relationships, and clear management responsibilities in writing.
(three) municipal public infrastructure projects meet the following requirements:
1, domestic water and water-saving facilities are complete, and the water quality meets relevant standards. Domestic water entering the urban and rural water supply network must be approved by the water supply professional unit. For residential quarters with their own water sources, the water supply equipment shall conform to the water supply design specifications and be in good condition.
2. Domestic electricity shall be incorporated into the urban power supply network according to the power supply scheme of the relevant departments, and temporary construction electricity and other electricity that does not meet the requirements shall not be used. If permanent power supply cannot be provided temporarily due to phased construction, it must be approved by the power supply professional unit, and transitional power supply measures shall be taken within the prescribed time limit to ensure functional requirements and electricity safety.
3, the use of municipal pipeline gas residential areas, should be in accordance with the development and construction units and gas supply enterprises to determine the gas supply scheme to complete the laying and connection of indoor and outdoor gas pipelines, and confirmed by the gas supply enterprises. If the gas supply cannot be realized temporarily due to objective conditions, the real estate development enterprise shall jointly propose a transitional solution with the gas supply enterprise. For residential quarters with self-built pipeline gas supply stations, the completion acceptance report of self-built pipeline gas supply stations and Beijing gas business license shall be provided.
4. The heating system shall meet the heating configuration and construction standards, and meet the requirements of building energy-saving design. The use of urban central heating system must obtain the approval documents with heating conditions issued by heating professional units.
5. Telephone communication lines and cable TV lines should be laid to households according to the design requirements.
6. Road construction meets the planning requirements, with roads connected with external traffic trunk roads, and corresponding public lighting facilities are completed according to the design requirements.
7. Complete the corresponding greening construction of residential quarters. If the greening is not completed due to seasonal reasons, dust prevention measures should be taken.
8. The ground around the house is clean and the roads are smooth. Take temporary isolation measures that are effective from the next stage of the construction site and have been built in stages. If the segmented boundary is a road or green space, the construction of the road, road lighting or green space has been completed.
Fourteenth real estate development enterprises in accordance with the law to hire residential property management enterprises, should participate in the completion and acceptance of various stages of residential construction.
Real estate development enterprises and property management enterprises shall not go through the check-in formalities before the municipal public infrastructure and public service facilities are completed and accepted according to the construction plan.
Fifteenth real estate development enterprises shall hand over the public service facilities in residential quarters to the relevant units according to law, and go through the handover procedures.
Article 16 If a real estate development enterprise fails to bid for residential and municipal public infrastructure and public service facilities in accordance with the construction plan, the construction administrative department shall not handle the filing procedures of the project bidding documents.
Seventeenth real estate development enterprises did not carry out the completion acceptance in accordance with the construction plan, or municipal public infrastructure and public service facilities do not meet the conditions stipulated in Article 13, and the construction project quality supervision institution shall order them to make corrections.
Eighteenth real estate development enterprises in the construction process in violation of the provisions of these measures or fraudulent delivery, the construction administrative department shall order it to correct, and as a bad business behavior recorded in the development enterprise credit information system, to the public. If the circumstances are serious, the construction administrative department shall reduce or cancel the qualification of real estate development enterprises according to law. Suspected of a crime, the construction administrative department will hand over the case clues to the public security procuratorial organs for investigation.
Nineteenth residential and municipal public infrastructure and public service facilities in affordable housing residential areas shall be implemented with reference to these measures.
Twentieth in March 2007 1 later (including March 1) signed a contract for the assignment of land use rights of residential projects, these measures shall be applicable.
On March 1 day, 2007, all residential projects in the city that have signed the land use right transfer contract but have not started the construction bidding should carry out supplementary construction plans according to these measures, and carry out bidding, construction permit, house pre-sale and completion acceptance according to these measures.
