Regulations of Changchun Municipality on Property Management (revised in 2022)

Chapter I General Provisions Article 1 In order to standardize property management activities, safeguard the legitimate rights and interests of owners, property users and property service providers, create a safe, comfortable, civilized and harmonious living and working environment, and build a social governance pattern of * * * construction and * * * governance, these Regulations are formulated in accordance with relevant laws and regulations and in combination with the actual situation of this Municipality. Article 2 These Regulations shall apply to property management activities and their supervision and management within the administrative area of this Municipality.

The term "property management" as mentioned in these Regulations refers to the activities of the owners to maintain, conserve and manage the houses, * * shared parts and * * shared facilities and equipment in the property management area by hiring property service providers or managing themselves, and to maintain environmental sanitation, greening and related order. Property service providers include property service enterprises and other managers. Article 3 The property management of this Municipality adheres to the principles of party building leading, government leading, owner autonomy, professional service and community governance. Establish and improve the governance structure in which residents' (village) committees, owners' committees, owners and property service providers participate under the leadership of community party organizations. Fourth city, county (city) District People's government should strengthen the leadership of property management, establish and improve the property management coordination mechanism and target responsibility system; Improve the incentive policies and measures, and establish the corresponding capital investment and guarantee mechanism. Fifth city property management department is responsible for the supervision and management of property management activities within the city limits, and perform the following duties according to law:

(1) Formulating policies related to property management, development plans and measures for the property service industry;

(two) to guide the district property management department to supervise and manage the property management activities;

(three) to establish and improve the property service standards and quality assessment system;

(four) to establish and improve the credit management system of property services;

(five) to establish and improve the electronic information platform for property management;

(six) supervision and management of property services bidding activities;

(seven) to supervise and manage the maintenance funds of buildings and their ancillary facilities (hereinafter referred to as the special maintenance funds for property);

(eight) to formulate temporary management regulations, management regulations, rules of procedure of the owners' congress, property service contracts and other model texts;

(nine) to perform other duties of property management supervision and management as prescribed by laws and regulations.

The district property management department is responsible for the supervision and management of property management activities within its jurisdiction, and shall perform the following duties according to law:

(a) to formulate policies and measures related to property management in this region;

(two) to guide the neighborhood offices and Township People's governments to supervise and manage the property management activities;

(three) to guide the neighborhood offices and Township People's governments to mediate property management disputes;

(four) to supervise and manage the bidding activities of property services within their respective jurisdictions;

(five) responsible for the relevant work of special maintenance funds for property within the jurisdiction;

(six) the organization of property management training in this area;

(seven) to perform other duties of property management supervision and management as prescribed by laws and regulations.

County (city) real estate management departments shall perform corresponding duties in accordance with the provisions of items 3 to 5 and 2 of the first paragraph of this article.

Street offices and Township People's governments are responsible for organizing, guiding and supervising the property management activities within their respective jurisdictions. Neighborhood (village) committees carry out property management related work under the guidance of neighborhood offices and township people's governments. ?

According to the authorization, the development zone management agency is responsible for the supervision and management of property management activities within its jurisdiction.

Other relevant competent departments shall, in accordance with their respective responsibilities, do a good job in property management according to law. Article 6 The Municipal Property Service Industry Association shall strengthen industry self-discipline, standardize business practices, mediate industry disputes, urge property service providers and employees to operate according to law, provide honest services, improve the level of property services, and promote the healthy development of the property service industry. Seventh property management departments and relevant departments shall establish an acceptance system for complaints and reports of violations of laws and regulations, and publish contact units, complaints and reports in a prominent position in the property management area. The relevant competent department shall, from the date of receiving the complaint and report, investigate and handle it within the prescribed time limit, and reply the results of the investigation and handling to the complainant and informant. Article 8 Sub-district offices and township people's governments shall establish a joint meeting system composed of county (city) district property management departments, sub-district offices, township people's governments, public security police stations, neighborhood (village) committees, owners' committees and property service providers to coordinate and solve major problems in property management. Chapter II Owners and Owners' Organizations Article 9 The owner of a house is the owner.

The term "owner" as mentioned in these Regulations also includes: those who have not registered the ownership of real estate according to law, but have legally occupied the house due to legal acts aimed at transferring ownership, such as buying, selling, donating, inheriting and legally building, legal documents of people's courts and arbitration institutions or expropriation decisions of people's governments, and other units or individuals who meet the requirements of laws and regulations. Article 10 Owners shall exercise their rights and undertake obligations in accordance with laws and regulations, temporary management regulations, management regulations and property service contracts, and shall not fail to perform their obligations on the grounds of giving up their rights.

If the owner transfers, rents out the exclusive part of the property, establishes the right of residence or changes the use of the * * * part and the * * * facilities and equipment according to law, it shall promptly inform the property service provider of the relevant information.
