Article 944 of the Civil Code stipulates that the owner shall pay the property fee to the property service provider as agreed.
If the property service provider has provided services in accordance with the agreement and relevant regulations, the owner shall not refuse to pay the property fee on the grounds that he has not accepted or does not need to accept the relevant property services.
The services provided by property service providers to owners include the maintenance of buildings and their ancillary facilities, the management and maintenance of environmental sanitation and related order. Most of the services are aimed at all the owners of the whole community, not specifically at one owner.
Owners have both rights and obligations to the public part of the community, and may not fail to perform their obligations on the grounds of giving up their rights. So whether you live in a house or not, you have to pay the property fee.
Of course, for the sake of fairness, local laws and regulations or property management measures may allow owners to pay less property fees according to a certain proportion when they live for a short time.
For example, Item (5) of Article 5 of the Notice of the General Office of Ningbo Municipal Government on Printing and Distributing the Implementation Opinions of Ningbo Residential Property Management Regulations stipulates that in the second year, the owner shall submit a written application to the property service enterprise for the start and end time of the empty house, and after verification by the property service enterprise, the property service fee shall be paid at the rate of 80% from the second year.
In addition, if there is a clear agreement in the property management service contract on the reduction and exemption of property fees when the owner does not live, it shall be performed in accordance with the contract.
