How to sign a property contract

Legal analysis: the property management contract can be signed every few years, and there is no mandatory provision, which is decided by both parties through consultation.

As a property management company, it generally won't last long. Because the labor cost of property management is very high, and the labor cost rises rapidly, it is easy to cause losses if the signing time is too long.

But as the owner, it takes a relatively long time to sign the property management contract. After the property service fee is determined, if the cost of the property management company rises in the later period, as the owner, part of the property fee can be saved.

In addition, according to the different stages of service provision, it can be divided into prophase realty service contract and realty service contract. The former refers to the contract signed by the construction unit and the property service enterprise it selects before the property sales. The latter refers to the contract signed by the owners' committee and the property company selected by the owners' congress after the property sold and delivered by the construction unit reaches a certain amount. When the realty service contract signed by the owners' committee and the realty service enterprise takes effect, the prophase realty service contract is terminated.

Legal basis: Article 285 of the Civil Code. Entrusted by the owners, the realty service enterprise or other managers shall manage the buildings and their ancillary facilities within the building division in accordance with the provisions of the realty service contract in Part III of this Law, accept the supervision of the owners, and promptly answer the owners' inquiries about realty services. Property service enterprises or other managers shall implement emergency measures and other management measures implemented by the government according to law, and actively cooperate with relevant work.
