Street offices and Township People's governments shall guide, assist and supervise property management; Coordinate the relationship between property management and community management, community service, the relationship between the construction unit and the early property service enterprise, and the relationship between the owner and the property service enterprise; Implement the management of old residential quarters.
Urban communities and rural villagers' committees shall assist and cooperate with neighborhood offices and township people's governments to carry out property management-related work. Fourth city and county (District) people's government property administrative departments responsible for the supervision and management of property management activities within their respective administrative areas.
City and county (District) property management agencies are responsible for the daily supervision and management of property management activities.
Other relevant administrative departments of the municipal and county (District) people's governments shall be responsible for the supervision and management of property management activities within their respective functions and duties. Article 5 Property administrative departments shall carry out publicity and training on property management laws, regulations, rules and related policies, establish integrity files of property service enterprises and their managers, and guide owners and property service enterprises to exercise their rights and perform their obligations according to law. Article 6 The municipal property management industry association shall strengthen the self-discipline management of the industry according to law, standardize the behavior of the industry, maintain market order and fair competition, promote the property service enterprises and employees to operate according to law and provide honest services, and promote the healthy development of the property management industry. Chapter II Owners' Congress and Owners' Committee Article 7 The owner of a house is the owner.
A person who legally occupies a house due to legal relations such as sale, gift and inheritance, but fails to register the change of ownership according to law, enjoys the rights of the owner in property management and undertakes the corresponding obligations of the owner.
The owner shall not refuse to perform the owner's obligations on the grounds of giving up his rights. Article 8 Tenants, borrowers and other users of houses shall enjoy corresponding rights and undertake corresponding obligations in accordance with laws, regulations, management regulations, decisions made by the owners' assembly according to law and agreements with the owners. If the owner is unable to attend the meeting of the owners' congress for some reason, he may entrust an agent to attend in writing according to law, or participate in the discussion and voting by electronic means. Article 10 If the construction area of the exclusive part delivered for use reaches more than 50% of the total construction area in the property management area, or if the first house has been delivered for two years, the development and construction unit shall report in writing to the county (district) property administrative department where the property is located within 30 days. The report shall include the following materials needed to prepare for the first owners' meeting:
(a) the division of property management areas;

(three) a copy of the construction land planning permit and the construction project planning permit;
(four) the record form for the completion and acceptance of housing construction projects and the certificate of delivery and use of ancillary facilities and equipment;
(five) property service configuration information;
(6) List of owners.
If the development and construction unit fails to submit a written report in time, the owner who has delivered the exclusive part may jointly submit a written request to the neighborhood office and the Township People's Government where the property is located to hold the first meeting of the owners' assembly.
Neighborhood offices and township people's governments shall, after receiving the written report of the development and construction unit or the written request of the owners, prepare for the first meeting of the owners' congress in accordance with the provisions. Eleventh the following matters shall be decided by the owners' meeting:
(a) to formulate and modify the management statute and the rules of procedure of the owners' congress;
(two) to elect the owners' committee or replace the members of the owners' committee;
(three) the selection and dismissal of property services companies;
(four) to raise and use special maintenance funds;
(five) the renovation of buildings and their ancillary facilities;
(six) to determine the content, standard and charging scheme of property services;

(eight) the distribution and use of * * * part of the business and operating income;
(nine) the use of all roads and venues owned by the owners to set up parking spaces and manage the charging matters;
(ten) to approve the rules of procedure of the owners' committee;
(eleven) the raising, management and use of the working funds of the owners' congress and the owners' committee;
(twelve) to change and cancel the inappropriate decisions of the owners' committee;
(thirteen) other matters that should be decided by the owners' meeting as stipulated by laws, regulations or management regulations.
Decide that the exclusive part of the matters specified in Items (4) and (5) of the preceding paragraph shall account for more than two thirds of the total construction area.
More than two-thirds of the total number of owners agree; Decisions on other matters specified in the preceding paragraph shall be subject to the consent of the owners whose exclusive parts account for more than half of the total building area and more than half of the total number of people.
If the owners can't convene the owners' meeting because they can't reach a quorum, they can convene the owners' meeting to decide other matters other than items (4) and (5) of the first paragraph of this article with the consent of the subdistrict office and the township people's government. Representatives of the owners' congress can be elected according to buildings, units and floors. , and the members of the owners' congress shall not be less than thirty.
