Chapter I General Provisions Article 1 These Measures are formulated in accordance with the provisions of relevant laws and regulations and in the light of the actual situation of this Municipality in order to strengthen the management of urban housing use safety, safeguard public safety and ensure the safety of people and property. Article 2 These Measures shall apply to the housing safety management activities that are legally built on state-owned land within the administrative area of this Municipality and completed, accepted and delivered for use.

The use safety management of houses, fire safety of houses, elevators, gas, water supply and other professional facilities and equipment of the military, religious groups, historical buildings and cultural relics protection units shall be implemented in accordance with the provisions of relevant laws and regulations. Article 3 The term "house use safety management" as mentioned in these Measures refers to the management activities to ensure the safe use of houses, including the safe use of houses, the appraisal of house safety, the management of dangerous houses and the supervision and inspection of dangerous houses. Article 4 The safety management of house use shall follow the principles of territorial management, prevention first, rational use and standardized governance to ensure the safety of house use. Article 5 The people's governments of cities and counties (districts) shall strengthen the organization, leadership and comprehensive coordination of housing use safety management within their respective administrative areas, formulate the housing use safety supervision and management system and emergency plan, and organize to deal with housing use safety emergencies.

City, county (District) housing and urban and rural construction administrative departments are the administrative departments in charge of housing safety supervision and management within their respective administrative areas.

Finance, natural resources, urban management, market supervision, commerce, emergency management and other departments shall, in accordance with their respective responsibilities, do a good job in the safety management of housing use.

Township (town) people's governments and sub-district offices shall cooperate with the administrative departments of housing and urban and rural construction to do a good job in the safety management of housing use. Article 6 The people's governments of cities and counties (districts) shall include the funds for the management of housing use safety in their financial budgets, and ensure the smooth development of housing use safety investigation, safety appraisal, crisis relief subsidies and emergency rescue work. Seventh housing and urban and rural construction administrative departments shall regularly organize the safety inspection of housing use, establish the archives of housing use safety management, build an information platform, implement dynamic management and enjoy information. Township (town) people's governments and sub-district offices shall assist in the safety investigation of housing use. Eighth housing and urban and rural construction administrative departments should strengthen the guidance and supervision of property management, housing safety appraisal and other units; The construction administrative department shall strengthen the guidance and supervision of the work of the construction industry, decoration and other industry associations. , support trade associations to carry out their work according to law, and give play to the role of trade associations in the safety management of housing use. Article 9 The acts and related information of housing survey, design, construction and supervision units, housing decoration enterprises, housing use safety appraisal institutions and property service enterprises that violate laws, regulations and the provisions of these Measures shall be loaded into their credit files by the administrative departments of housing and urban and rural construction and announced to the public. Tenth housing and urban and rural construction administrative departments, news media, property service enterprises and other units should take various forms to carry out publicity and education, popularize the laws, regulations and knowledge of housing use safety management, and improve public safety awareness. Eleventh any unit or individual has the right to report and complain about acts that endanger the safety of the use of houses or houses with major security risks. After receiving reports and complaints, the administrative department of housing and urban and rural construction in the area shall register and accept them, and inform the informants and complainants of the handling situation within ten working days. Chapter II Safety Management of House Use Article 12 The owner of a house is the person responsible for the safety of house use and is responsible for the safety of house use. If the owner of the house is inconsistent with the actual user and manager, the owner of the house shall not refuse to bear the responsibility for the safety of the use of the house on the grounds that there is an agreement with the actual user and manager.

Because the property right is unclear or the whereabouts of the owner of the house are unknown, the owner of the house cannot bear the responsibility for the use of the house, and the actual user and manager of the house shall fulfill the responsibility of the person responsible for the use of the house.

If there are problems in the main structure and foundation of the house, causing hidden dangers in the use of the house, it shall bear the responsibility for the use of the house in accordance with the following provisions:

(a) the state-owned public houses directly managed by the state-owned public houses directly managed by the management unit shall bear the responsibility for housing safety;

(two) the development unit, the construction unit, the construction unit and the management unit shall bear the responsibility for the use safety within the service life of the house;

(three) the relevant responsible units are lost, but there is a successor unit or a higher-level competent department, and the successor unit or the higher-level competent department shall bear the responsibility for the safety of housing use;

(four) the relevant responsible units are lost, and there are no successor units and higher authorities or houses that have exceeded the service life. The local county (district) people's government shall bear the responsibility for the safety of housing use. Thirteenth people responsible for the use of housing safety shall bear the following responsibilities for the use of housing safety:

(a) the rational use of the house according to the design purpose, the nature of the use of the building and the purpose of the house recorded in the house ownership certificate;

(two) inspection and maintenance of houses, timely management of housing security risks;

(three) the decoration of the house shall not affect the use of the house, and shall not endanger the safety of the use of the house and the safety of the adjacent houses;

(four) commissioned by the housing safety appraisal;

(5) Take other necessary measures to ensure the safe use of the house.
