Regulations of Xuzhou Municipality on the Administration of Residential Property

Chapter I General Provisions Article 1 In order to regulate residential property management activities, safeguard the legitimate rights and interests of all parties involved in property management, create a good living environment and promote the construction of harmonious and civilized communities, these Regulations are formulated in accordance with the General Principles of the Civil Law of People's Republic of China (PRC), the Regulations on Property Management of the State Council and the Regulations on Property Management of Jiangsu Province, and in combination with the actual situation of this Municipality. Article 2 These Regulations shall apply to residential property management and its supervision and management activities within the administrative area of this Municipality.

The term "residential property management" as mentioned in these Regulations refers to the daily management of buildings, structures, supporting facilities and equipment and related sites within the residential property management area by the owners themselves or by entrusting property service enterprises and other managers, and maintaining environmental sanitation and related order. Article 3 The municipal, county (city) and district people's governments shall strengthen the organization and leadership of residential property management, incorporate residential property management into the development planning of modern service industry and the community governance system, establish and improve the working pattern of party committee leadership, government supervision, owner autonomy, multi-party participation and consensus, establish corresponding capital investment and guarantee mechanisms, and improve the management and service level of residential property.

Sub-district offices (Town People's Government) are responsible for guiding and supervising the residential property management activities within their respective jurisdictions, and assisting the people's governments at higher levels and relevant competent departments in doing a good job in residential property management.

Community residents' (village) committees shall guide and supervise the owners' autonomy, and assist and cooperate with neighborhood offices (town people's governments) to do a good job in residential property management. Fourth city, county (city), district property management department is responsible for the supervision and management of residential property management activities within their respective administrative areas.

Other relevant departments shall be responsible for the supervision and management of residential property management activities in accordance with their respective responsibilities. Fifth street offices (town people's government) shall establish a comprehensive law enforcement mechanism according to law, and strengthen the inspection, inspection and handling of illegal acts in residential areas. Article 6 During the emergency response period, the subdistrict office (town people's government) shall be responsible for implementing various emergency measures taken by the government according to law, guiding the property service enterprises to carry out the corresponding level of response work, and giving material and financial support according to law.

The realty service enterprise shall, in accordance with the requirements, obey the unified command of the government, actively cooperate with the community neighborhood (village) committees to carry out their work under the guidance of the neighborhood offices (town people's governments), and implement emergency plans and emergency measures according to law. Article 7 Establish and improve the deliberation and coordination mechanism of community party organizations, community residents' (village) committees, owners' committees and property service enterprises, and give play to the leading role of community party organizations in grassroots social governance. Eighth city, county (city), District People's government and its relevant departments, street offices (town people's government) through other means, to guide third-party institutions to participate in residential property management related activities.

Encourage owners' committees, construction units, property service enterprises and other third-party institutions to carry out activities such as project acceptance, property fee calculation and property service quality evaluation.

Third-party institutions shall follow the principles of independence, objectivity and impartiality, provide professional services according to laws, regulations and contractual agreements, and the reports issued shall be true, objective and complete, and shall be responsible for the reports issued. Article 9 Property service industry associations shall formulate industry norms according to law, strengthen industry self-discipline, standardize industry operation behavior, mediate disputes in the property service industry, organize professional training for employees in the property service industry, and urge property service enterprises and employees to operate according to law, provide honest services and improve the level of property service.

The property service industry association shall accept the guidance and supervision of the property management department. Chapter II Residential Property Management Areas and * * * Own Property Article 10 The division of residential property management areas shall follow the principles of planning first, natural zoning, improving functions and benefiting the people, and be defined according to the land use scope determined by property construction projects, taking into account the scope in which owners exercise part of * * * management rights, facilities and equipment used by the property, building scale, property type, community construction and other factors.

The administrative departments of natural resources and planning shall, when reviewing the design scheme of construction projects, consider the needs of regional division of residential property management in accordance with the principles conducive to the implementation of residential property management, and listen to the opinions of the county (city) and district property management departments where the property is located on the regional division of residential property management.

The construction unit shall delimit the residential property management area according to the scope of the red line map determined by the planning permit for land use for property construction, combined with the facilities and equipment of the property, the construction of the community and other factors. If the property, supporting facilities, equipment and related sites are developed by stages or have different property types such as residential and non-residential, it shall be designated as a residential property management area; It can be used independently and divided into different residential property management areas.

Has been put into use but has not yet delineated the residential property management area, the county (city), the district property management department in conjunction with the subdistrict office (town people's government) put forward a division plan, and determine the residential property management area after consulting the relevant owners. Eleventh new residential property sales, the construction unit shall delimit the residential property management area to the property where the county (city), the district property management department for the record, and the residential property management area for the record in the commercial housing sales contract.

If the residential property management area has been delineated and the property management has not been filed, the property service enterprise shall file with the county (city) or district property management department where the property is located.

Residential property management area shall not be changed without authorization. If it is really necessary to change, it shall comply with the provisions of laws and regulations, and re-apply for the record.
