The real estate administrative departments of the people's governments at or above the county level shall strengthen the supervision and management of the service quality of property service enterprises, establish credit files of property service enterprises, registered property managers and project managers, and promote the property management industry to improve the service level. The specific measures for the property management service project manager system shall be formulated separately by the administrative department of housing and urban and rural construction of the provincial people's government in accordance with the relevant provisions of the state. Personnel engaged in property management services shall obtain professional qualification certificates in accordance with relevant state regulations.

Property service enterprises shall employ property management service personnel in accordance with relevant regulations, and strengthen the training and performance supervision of property management service personnel. If the owners' congress decides to hire a realty service enterprise, the owners' committee shall sign a realty service contract with the selected realty service enterprise.

The following contents stipulated in the realty service contract shall be submitted to the meeting of the owners' congress for voting, unless the owners' congress authorizes the owners' committee to decide:

(1) Property services;

(two) the quality of property services and service fees;

(three) to maintain the order of the property management area;

(4) Term of the contract;

(5) Liability for breach of contract. Property services mainly include the following items:

(a) the use, management and maintenance of * * * parts and facilities of the property;

(two) the management and maintenance of public greening and environmental sanitation in the property management area;

(3) Vehicle parking management;

(four) the assistance and maintenance of fire, safety and emergency rescue in the property management area;

(six) the formulation of property maintenance, renewal, renovation and maintenance plans and cost accounting management;

(seven) keeping property service files and property files;

(eight) other property services entrusted by the owners' congress and the owners' committee. Property service charges shall be stipulated in the property service contract in accordance with the charging methods formulated by the price departments of the State Council, provincial and municipal people's governments jointly with the real estate administrative departments.

The formulation and revision of measures for charging property services shall listen to public opinions.

The owner shall pay the property service fee in accordance with the provisions of the property service contract. Three months before the expiration of the realty service contract, the owners' committee shall organize a general meeting of owners and decide to renew or hire a new realty service enterprise. The owners' committee shall inform the realty service enterprise in writing of the decision of the owners' congress.

If the owners' congress decides to renew their employment, the owners' committee shall renew the realty service contract with the realty service enterprise 30 days before the expiration of the realty service contract. If the owners' congress decides to hire a new realty service enterprise, the original realty service enterprise shall withdraw from the realty management area within 05 days from the date of termination of the realty service contract, and cooperate with the newly hired realty service enterprise to handle the handover procedures.

If the realty service enterprise decides not to renew the realty service contract, it shall inform the owners' committee in writing 3 months before the expiration of the realty service contract; If there is no owners' committee, it shall be publicized in the property management area 3 months before the expiration of the contract, and the neighborhood offices and township people's governments where the property service projects are located shall be informed in writing. If the term of the realty service contract expires or is terminated according to law, the original realty service enterprise shall withdraw from the realty management area and hand over the following matters to the owners' committee:

(a) the transfer of property acceptance and operation management, maintenance information;

(two) the transfer of property rights;

(3) Settlement of relevant expenses;

(four) other matters stipulated by laws, regulations and rules.

The original realty service enterprise shall not refuse to handle the handover on the grounds that the owner fails to pay the realty service fee or disagrees with the owner's decision.

Forty-first establish and improve the joint meeting system of property management. Under any of the following circumstances, the subdistrict office and the Township People's Government may hold a joint meeting on property management, which shall be settled through negotiation by representatives of the real estate administrative departments and relevant departments of the people's governments of counties and cities where the property is located, community residents' committees, owners' committees and property service enterprises:

(a) the owners' committee fails to perform its duties according to law;

(2) Changes of the owners' committee;

(three) major disputes in the performance of the property service contract;

(four) property services companies change the handover;

(five) other property management matters that need to be resolved through coordination.

The real estate administrative departments of the people's governments at or above the county level shall establish a system for accepting property management complaints, and timely handle the complaints of owners, owners' committees, property users and property service enterprises in property management activities.

The owners' congress and the owners' committee shall accept the guidance and supervision of the property management department and the community residents' committee, perform the duties of autonomous management according to law, and cooperate and assist the relevant departments and community residents' committees to do a good job in maintaining social order within the property management area.
