Legal analysis: For newly-built residential quarters, a general property management agreement is signed with the developer before occupancy, and the property charging standard is stipulated in the agreement, which is reported to the price department for the record and written into the previous owners' convention. Property management fees can be charged according to this standard after the owners move in and before the owners' committee is established.

Legal basis: Article 35 of the Regulations on Property Management, a property service enterprise shall provide corresponding services in accordance with the stipulations of the property service contract.

The realty service enterprise fails to perform the realty service contract, causing personal and property safety damage to the owner, and shall bear corresponding legal responsibilities according to law.
