Article 272 of the Civil Code stipulates that the owner shall enjoy the right to the part other than the exclusive part of the building. Rights include possession, use, income and disposition. Article 274 stipulates that the roads and green spaces within the building division shall be owned by the owner, and other public places, facilities and property houses within the building division shall also be owned by the owner. Article 283 Where the parties have agreed on matters such as cost sharing and income distribution of the house and its ancillary facilities, such agreement shall prevail; If there is no agreement or the agreement is unclear, it shall be determined according to the proportion of the owner's exclusive part to the total construction area.

According to the Property Management Regulations, the income of public places can be used for special maintenance funds and can also make up for the lack of management fees, but it must be decided by all owners.

How to distribute public interests and when to publicize them should be agreed in the owners' convention and the articles of association of the owners' congress of the community in advance.

Before the owners' meeting and the owners' committee are established, according to the preliminary realty service contract, the realty service enterprise entrusted to operate the parts and facilities used by * * * can manage the public benefits of the community on its behalf; After the establishment of the owners' congress and the owners' committee, the owners' congress may decide on its own that the public benefits shall be managed by the owners' committee, or entrust the realty service enterprise with the management through the realty service contract.

When managing public revenue, the realty service enterprise shall specify in the contract the proportion of the related maintenance fees and management fees of the realty service enterprise to the public revenue. The realty service enterprise entrusted with the management of public income shall open a special account in the bank to store public income, and the income and expenditure shall be kept separately and shall not be shared with other accounts of the enterprise. Property service enterprises that manage multiple property communities shall establish separate accounts for the public income of each property community.
