Regulations of Huainan Municipality on Property Management of Residential Quarters
The term "property management" as mentioned in these Regulations refers to the activities of owners and property service enterprises to maintain, conserve and manage buildings, structures, supporting facilities and equipment and related sites in accordance with the property service contract by hiring property service enterprises, and to maintain environmental sanitation and related order within the property management area. Article 3 Property management in residential quarters should be incorporated into the community construction and governance system, and adhere to the working pattern of party building leading, government supervision, owner autonomy, multi-party participation, consultation and consultation, and scientific and technological support. Establish and improve the governance structure of neighborhood (village) committees, owners' committees, owners and property service enterprises under the leadership of township party organizations at all levels. Article 4 The people's governments of cities, counties and districts shall strengthen their leadership over the property management of residential quarters, establish a joint meeting system for the property management of residential quarters, and coordinate and solve major problems in property management.
Huainan Economic and Technological Development Zone, Huainan High-tech Industrial Development Zone and maoji Comprehensive Experimental Zone for Social Development shall, in accordance with their duties, do a good job in the property management of residential quarters within their respective jurisdictions. Fifth city housing and urban and rural construction management department is responsible for the supervision of the city's residential property management activities, and perform the following duties:
(a) to formulate, formulate and publish policies and measures related to property management;
(two) to formulate management regulations, rules of procedure of the owners' congress and other model texts and technical specifications;
(three) to guide and supervise the county to carry out property management related work according to law;
(four) guidance, supervision and management of property management bidding activities;
(five) to supervise and manage the maintenance funds of buildings and their ancillary facilities (hereinafter referred to as special maintenance funds);
(six) to establish and improve the integrity file system of property management;
(seven) to establish a unified property management information system;
(eight) to guide and supervise the city property management association to carry out industry self-discipline and service work;
(nine) to supervise the project quality deposit;
(ten) to supervise the construction unit to perform the project quality warranty responsibility;
(eleven) to accept complaints about housing quality and water supply, gas supply and heating;
(twelve) other duties as prescribed by laws and regulations. Sixth county housing and urban and rural construction management departments are responsible for the supervision of property management activities in residential areas within their respective administrative areas, and perform the following duties:
(a) to guide and supervise the street offices and Township People's governments to carry out property management;
(two) responsible for the temporary management agreement, the signing of the property service contract, to undertake the inspection, the owners' committee related materials for the record;
(three) guidance, supervision and management of property management bidding activities;
(four) supervision and management of special maintenance funds;
(five) to collect and verify the credit information of the property service enterprises, establish the integrity files of property management, and accept inquiries;
(six) organize members of the owners' committee, property service practitioners and neighborhood (village) committees to carry out property management knowledge training;
(seven) the organization to promote the implementation of market-oriented property management in old residential areas;
(eight) to supervise the project quality deposit;
(nine) to supervise the construction unit to perform the quality warranty responsibility of the construction project;
(ten) to accept complaints about housing quality and water supply, gas supply and heating;
(eleven) other duties as prescribed by laws and regulations.
The administrative department of housing and urban and rural construction under the municipal district shall perform the duties specified in items 1 to 3 and items 5 to 11 of the preceding paragraph. Seventh city, county, district administrative departments or institutions shall, in accordance with the following provisions, do a good job in the relevant administrative law enforcement supervision:
(a) the public security organs are responsible for investigating and dealing with illegal acts that affect public safety and order, such as throwing objects at high altitude in residential areas, and conducting supervision and inspection on setting off fireworks, monitoring public security, parking vehicles, raising dogs, etc. Participate in handling traffic safety disputes according to law and do a good job in the supervision of floating population;
(two) the fire rescue agency is responsible for the supervision of the safety behavior of fire facilities and fire exits in residential areas;
(three) the ecological environment department is responsible for the supervision of environmental protection work in residential areas and surrounding areas, and investigate and deal with violations of environmental laws and regulations according to law;
(four) the natural resources and planning management department is responsible for the verification of the property service housing planning and the identification of illegal construction;
(5) The urban management administrative law enforcement department is responsible for investigating and dealing with illegal acts such as changing the load-bearing structure of houses without authorization, occupying roads, setting up stalls, posting advertisements indiscriminately, illegally erecting buildings and structures, and supervising the classification of domestic garbage, acceptance of landscaping in residential quarters, occupation of green spaces, tree felling and transplanting.
(six) the civil air defense department is responsible for the supervision and inspection of the construction and use of civil air defense engineering facilities;
(seven) the market supervision department is responsible for the safety supervision and inspection of elevators and other special equipment and the investigation and punishment of illegal charges for property services;
(eight) the development and reform department is responsible for the establishment, adjustment and supervision of power facilities, power security and property service charges.
Judicial, financial, civil affairs and other departments shall, in accordance with their respective responsibilities, do a good job in relevant supervision and guarantee work.
