Detailed Rules for the Implementation of the Regulations on Urban Greening Management in Yinchuan City

Article 1 In order to strengthen the management of urban greening in Yinchuan City and protect and improve the ecological environment, these detailed rules are formulated in accordance with the provisions of the Regulations of Yinchuan City on the Management of Urban Greening. Article 2 These Provisions shall apply to the greening planning, construction and management within the urban planning area of Yinchuan City. Article 3 The urban green space mentioned in these Detailed Rules includes the following seven categories:

(1) Public green space: municipal, district and residential parks, small parks, street squares, botanical gardens, zoos and special parks open to the public;

(2) The green space attached to the unit refers to the environmental green space in the gardens of administrative enterprises and institutions such as organs, organizations, troops, schools, hospitals and other public facilities;

(3) Green space in residential areas: refers to the green space in courtyards and buildings of residential areas except residential parks, small parks and right of way;

(4) Green land production: nurseries, flower beds, grass beds, etc. Provide seedlings, flowers and seeds for urban landscape;

(5) Protective green space: forest belts and green spaces used for environment, sanitation, safety and disaster prevention in cities;

(6) Scenic forest land: refers to the forest land and suburban scenic spots in the city that rely on natural landforms to beautify and improve the environment;

(seven) traffic green space: refers to all roads, green belts, central green island forests, vaginal greening and street trees. Article 4 Units and citizens who have the ability to work within the scope of application of these Detailed Rules shall perform the right to plant trees or other greening obligations in accordance with relevant state regulations.

All units and individuals should cherish the achievements of urban greening and have the right to dissuade and report the acts of destroying urban greening and its facilities.

Units that fail to fulfill the obligation of planting trees by the whole people and citizens who have the ability to work without reason shall pay the voluntary tree planting and greening fees in accordance with the relevant provisions. Fifth Yinchuan city landscaping administrative departments responsible for the city's greening construction and management, the district's urban construction administrative departments responsible for the area of greening construction and management. Article 6 The urban greening planning of Yinchuan City shall be prepared by the landscaping administrative department in conjunction with the planning land administrative department under the guidance of the overall urban planning of Yinchuan City. After approval, the landscaping administrative department shall be responsible for organizing the implementation.

Once the urban greening plan is approved, it must be strictly implemented, and no unit or individual may change it without authorization. If it is really necessary to modify it, it shall be submitted for approval according to the procedures. Article 7 The proportion of green space in the total area of urban construction projects shall meet the following requirements:

(a) the park green space is not less than 70%;

(two) the new residential area is not less than 30%, and the old city transformation area is not less than 25%;

(three) the new urban trunk road is not less than 20%, and the secondary trunk road is not less than15%;

(4) The width of shelterbelts for urban railways, trunk canals and ditches shall be not less than 30 meters;

(five) the attached green space is generally not less than 30%. Among them, the green rate of industrial enterprises, transportation hubs, warehouses and commercial centers is not less than 20%; No less than 30% of the factories produce toxic and harmful gases and pollution, and a shelterbelt with a width of not less than 50 meters shall be set up in accordance with state regulations; The green rate of schools, hospitals, nursing homes (institutes), government organizations, public cultural facilities, troops and other units is not less than 35%.

Due to special circumstances, units that cannot be built according to the above standards shall be approved by the planning land administrative department and the landscaping administrative department, and the compensation fee for ex situ greening shall be paid according to the insufficient area and lot level, and the landscaping administrative department shall uniformly arrange the greening construction. Article 9 The design of urban greening projects shall be entrusted to units with corresponding qualification certificates. After the completion of the greening project, the landscaping administrative department shall, jointly with the relevant departments, pass the acceptance before delivery. Eleventh city greening and greening engineering design, should be approved in accordance with the following provisions:

(a) the design scheme of the city's regional parks and large-scale greening projects, with the consent of the municipal government, shall be examined and approved by the landscaping administrative department in conjunction with the relevant departments;

(two) the greening design scheme of construction projects such as newly built or rebuilt residential quarters and group garden-level houses shall be examined and approved by the landscaping administrative department in conjunction with relevant departments;

(3) The design scheme of the construction project in large-scale green space (including city and district parks) shall be examined and approved by the landscaping administrative department. Twelfth construction units must carry out construction in accordance with the approved design scheme. If the design scheme really needs to be changed, it must be examined and approved by the original approval authority. Article 13 For urban areas, public areas, open spaces along canals (ditches) and state-owned land open spaces on both sides of roads that are not newly built or widened within three years, the greening department may plant trees in advance or build temporary land, and if necessary, transfer the land for construction, and the construction unit shall give appropriate compensation.
