Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Organic Law of People's Republic of China (PRC) Local People's Congresses and Local People's Governments at Various Levels, the Legislative Law of People's Republic of China (PRC) and other relevant laws and regulations, and in light of the actual situation of this Municipality, in order to standardize the activities of formulating local laws and regulations, improve the quality of legislation, give play to the leading and promoting role of legislation, and comprehensively promote the rule of law. Article 2 These Regulations shall apply to the formulation, amendment and repeal of local regulations of this Municipality.

The term "local regulations" as mentioned in these Regulations refers to the normative documents with legal effect within the administrative area of this Municipality, which have been deliberated and formulated by the Municipal People's Congress and its Standing Committee and approved by the Standing Committee of the People's Congress of Jiangsu Province. Article 3 The formulation of local regulations shall follow the following principles:

(a) adhere to the leadership of the China * * * production party and implement the party's line, principles and policies;

(two) people-oriented, reflecting the will of the people and representing the fundamental interests of the people;

(three) to maintain the unity of the socialist legal system, and shall not contravene the Constitution, laws, administrative regulations and local regulations formulated by the Jiangsu Provincial People's Congress and its Standing Committee;

(four) from the specific situation and actual needs of this city, reflecting the local characteristics;

(five) fully develop democracy, adhere to the openness of legislation, promote legislative consultation, listen to opinions widely, and ensure the public to participate in legislative activities through various channels;

(six) to adapt to the requirements of economic and social development and comprehensive deepening reform, scientifically and reasonably stipulate the rights and obligations of citizens, legal persons and other organizations, and the rights and responsibilities of state organs.

The normative content of local regulations should be clear, specific, targeted and enforceable; Generally, there are no repeated provisions for the contents that have been clearly stipulated by the superior law. Article 4 The local laws and regulations of this Municipality may make the following provisions on urban and rural construction and management, environmental protection, historical and cultural protection and other matters:

(a) in order to implement the provisions of laws, administrative regulations and local regulations formulated by the Jiangsu Provincial People's Congress and its Standing Committee, it is necessary to make specific provisions according to the actual situation of this Municipality;

(two) matters that belong to the local affairs of this Municipality and need to formulate local regulations;

(three) in addition to the matters listed in Article 8 of the Legislative Law of People's Republic of China (PRC) that can only be formulated, the state has not yet formulated laws and administrative regulations, and it is necessary to formulate local regulations in advance according to the actual situation of this Municipality.

Where the law has other provisions on matters concerning the formulation of local regulations, such provisions shall prevail. Article 5 The local regulations and laws on particularly important matters in this Municipality shall be formulated by the local people's congress, and the local regulations that the Municipal People's Congress thinks should be formulated by it shall be deliberated and adopted by the meeting of the Municipal People's Congress.

The Standing Committee of the Municipal People's Congress (hereinafter referred to as the Standing Committee) formulates and modifies other local regulations except those that should be formulated by the Municipal People's Congress; When the Municipal People's Congress is not in session, the Standing Committee may, in accordance with the provisions of this Ordinance, partially amend and supplement the local regulations formulated by the Municipal People's Congress, but it shall not contravene the basic principles of the local regulations. Article 6 Local regulations should be formulated, but the conditions are not yet ripe. Because of the urgent need of administrative management, government regulations can be formulated first. Before the rules are formulated, the Municipal People's Government shall solicit the opinions of the Standing Committee in writing; After the adoption of the regulations, a written special report shall be made to the Standing Committee.

If the administrative measures specified in the preceding paragraph need to be implemented two years after the implementation of the regulations, the Municipal People's Government shall submit them to the Municipal People's Congress or its Standing Committee for formulating local regulations. Seventh Municipal People's Congress and its Standing Committee are responsible for the organization and coordination of legislative work, and play a leading role in legislative work. Chapter II Legislative Planning and Legislative Plan Article 8 The Standing Committee strengthens the overall arrangement of legislative work by formulating and implementing legislative plans and legislative plans.

When formulating legislative plans and legislative plans, we should carefully study deputies' motions and suggestions, solicit opinions extensively, scientifically demonstrate and evaluate them, and improve the timeliness, pertinence and effectiveness of legislation.

Legislative plans and legislative plans shall be coordinated with those of the Standing Committee of Jiangsu Provincial People's Congress. Article 9 All state organs, political parties, people's organizations, enterprises, institutions, other organizations and citizens within the administrative area of this Municipality may put forward suggestions to the Municipal People's Congress and its Standing Committee on formulating local regulations.

If the Municipal People's Government and its departments, the Municipal Intermediate People's Court, the Municipal People's Procuratorate, the special committees of the Municipal People's Congress (hereinafter referred to as the special committees) and the working bodies of the Standing Committee put forward proposals for legislative planning projects, they shall submit project proposals to explain the necessity and feasibility of legislation and the main problems to be solved; Where a proposal for a legislative plan is put forward, the project proposal and specific suggestions on the main problems to be solved in legislation shall be submitted. Article 10 The Standing Committee shall formulate legislative plans and legislative plans for this year in the first year of each session; According to the legislative plan, combined with the actual needs, the legislative plan for the next year shall be formulated before1Feb. 3 1 every year.

The Legislative Affairs Office of the Standing Committee is responsible for the preparation of the draft legislative plan and the draft legislative plan. Legislative planning shall be discussed and decided by the meeting of directors of the Standing Committee of the Municipal People's Congress (hereinafter referred to as the meeting of directors); The legislative plan shall be submitted by the meeting of directors to the meeting of the Standing Committee for deliberation and decision. The legislative plan and the legislative plan shall be announced to the public after they are passed.

The Legislative Affairs Office of the Standing Committee shall solicit opinions extensively when preparing the draft legislative plan and the draft legislative plan, and organize the Legislative Affairs Office of the Municipal People's Government and relevant departments and units to study and demonstrate the necessity and feasibility of legislation in conjunction with the relevant working bodies of the Standing Committee.

Legislative plans and legislative plans shall solicit the opinions of the Standing Committee of Jiangsu Provincial People's Congress before they are adopted, and shall be submitted to the Standing Committee of Jiangsu Provincial People's Congress in writing before1February 3 1 in the first year of each session and the previous year.
