Chapter I General Provisions Article 1 In order to strengthen the management of river courses, ensure the safety of flood control, drainage and water supply, improve the urban and rural water environment and ecology, and give full play to the comprehensive benefits of river courses, these Regulations are formulated in accordance with the provisions of relevant state laws and regulations and the actual situation of this Municipality. Article 2 These Regulations shall apply to the regulation, protection, utilization and related management activities of rivers (including lakes, reservoirs and artificial waterways) within the administrative area of this Municipality.

The waterway in the river shall be implemented in accordance with the provisions of the state and this Municipality on waterway management. Article 3 This Municipality implements the principles of unified planning, comprehensive management, active protection and rational utilization of rivers. Article 4 The municipal, district and county people's governments shall strengthen their leadership over the management of river courses, incorporate them into the national economic and social development plan, and incorporate the required funds into the fiscal budget at the corresponding level.

River flood control and obstacle clearing work, strictly implement the responsibility system of the chief executive of the people's governments at all levels. Article 5 The municipal water administrative department is the river administrative department of this Municipality, which implements unified supervision and management of rivers in this Municipality and is responsible for the management of flood discharge rivers, urban water supply and drainage rivers and related reservoirs (hereinafter referred to as the municipal river management).

The district and county water administrative department is the district and county river administrative department, which is responsible for the management of rivers outside the municipal water administrative department under the operational guidance of the municipal water administrative department.

Environmental protection, city appearance, fishery, tourism, waterway, land and resources and other relevant administrative departments shall do relevant work in accordance with their respective responsibilities. The determination and classified management of river courses are proposed by the municipal water administrative department and announced to the public after approval by the Municipal People's government. Chapter II River Regulation and Construction Article 8 The professional planning of river courses shall be organized by the municipal, district and county water administrative departments in conjunction with relevant departments, and shall be incorporated into the urban and rural planning at the corresponding level after being approved by the people's government at the corresponding level.

Other professional planning involving rivers should be coordinated with the professional planning of rivers.

Where the detailed planning involves a river course, the opinions of the water administrative department shall be sought in advance. Ninth river regulation and construction shall conform to the river basin planning, regional planning and urban and rural planning, and meet the national and municipal standards for flood control, drainage, shipping and water supply and other relevant technical requirements.

The regulation and construction of rivers should meet the requirements of the basic functions of rivers, carry out comprehensive regulation of water environment and ecology, and realize the goals of smooth rivers, clear water and green shores.

River regulation and construction should consider ecological integrity and pay attention to protecting and restoring the ecological environment and historical and cultural landscape of the river and its surrounding areas.

The materials selected for river regulation and construction shall meet the national standards. Tenth river regulation and construction, by the water administrative department is responsible for organizing the implementation.

The water administrative department shall, according to the professional planning of the river and the actual situation of the river, formulate the annual plan for river regulation and construction; Rivers that affect flood control safety, water quality and environmental landscape shall be included in the annual plan of the year and arranged for regulation. Eleventh water administrative departments involved in waterway regulation, should take into account the needs of shipping, and solicit the opinions of the waterway administrative departments in advance.

The waterway administrative department shall comply with the requirements of flood control and water supply safety in waterway regulation, and solicit the opinions of the water administrative department in advance. Twelfth river dredging, dike reinforcement, earth borrowing and other river regulation need to occupy land, by the municipal, district and county people's government in accordance with the relevant provisions of the state and the city to adjust and solve.

The land increased due to river regulation belongs to the state, and no unit or individual may occupy it at will.

Dredging and other river regulation waste soil is managed, utilized and disposed by the water administrative department, which is mainly used for river regulation and construction, and is free of related expenses. Chapter III River Protection Article 13 The scope of river management shall be defined, and the scope of protection shall be defined according to the actual conditions such as the importance of dikes and the quality of dike foundations.

The scope of river management includes coastline, sandbars, beaches (including cultivated land), flood discharge areas, bank revetments, berms and the waters between estuaries.

The scope of river protection refers to the dike safety protection area connected with the scope of river management. Article 14 The scope of management and protection of reservoirs shall be stipulated separately by the municipal, district and county people's governments. Fifteenth berms within the scope of river management other than reservoirs shall be demarcated in accordance with the following provisions:

(1) Haihe River, Yongding New River, Duliujian River, Ziya New River and Chaobai New River are 30 meters away from the toe of the river embankment;

(II) Zhouhe River, Chanhe River (including water diversion and tidal inflow), Huanxiang River (including old river course and flood diversion river course), Jiyun Canal, Qinglongwan Reduced River (including water diversion and tidal inflow), Yongding River, North Canal, Jinzhong River, Ziya River, South Canal (reducing river above a single river), Daqing River and Zhongting River (reducing river above a single river)

(three) Beijing sewage river, Machang River (more than a single river) and Xinkai River are 20 meters outside the toe of the river embankment;

(four) the river outside the city river is ten meters outside the bank slope.

If it is not suitable to set berms for flood discharge rivers in the central city and the built-up area of Binhai New Area, flood control emergency passages with a width of not less than15m shall be set on both sides of the river, which shall be regarded as berms. The outer ring river extends15m from the outer edge of the estuary on one side and above the other side of the highway, which is regarded as the berm.
