Auctioneer is a professional who presides over auction business activities in auction enterprises. Article 14 of the Auction Law stipulates: "An auction shall be presided over by an auctioneer." Therefore, only people with auctioneer qualification can preside over the auction business.

In the early days of auction trading, people did not have strict qualification requirements for auctioneers. However, most auctioneers actually belong to a large economic entity. In order to ensure the needs of business development, most of these institutions need to carry out certain professional culture training, so that the auctioneer's business can form a certain professional qualification, that is, they must go through certain professional training, obtain a qualified certificate and have corresponding work experience before they can serve as auctioneers. This practice gradually formed a system.

At present, most countries take holding a permit (license) as a prerequisite for engaging in the profession of auctioneer. For example, 1845, the auctioneer's law promulgated in Britain stipulates that practitioners must show their licenses, renew them once a year, and pay 10 for their work. Those without a license shall be sentenced to more than 1 month imprisonment. The license has the name and occupation scope of the practitioner to show what kind of goods are engaged in. Article 6 of the law also stipulates that the auctioneer shall list his name and address in capital letters at the auction place before the auction begins. The notice board must be hung in a conspicuous place until the auction is over, otherwise it will be fined 20 pounds. 1977 according to British criminal law, violation of this provision will be fined 100.

Summarizing the development status of China's auction industry and drawing lessons from foreign experience, Article 15 of the Auction Law clearly stipulates: "An auctioneer should meet the following conditions: ① have a college degree or above and know the auction specialty; (2) Having worked in an auction enterprise for more than two years; ③ Good conduct. A person who has been dismissed from public office or whose qualification certificate as an auctioneer has been revoked for less than five years, or who has received criminal punishment for intentional crimes, shall not be an auctioneer.

Regarding the acquisition of auctioneer qualification, the current international practice is that auction industry associations organize examinations and issue relevant certificates. China's "Auction Law" has also made a similar provision: "The auctioneer qualification examination is organized by the auction industry association. Those who pass the examination shall be awarded the qualification certificate of auctioneer by the auction industry association (Article 16).
