How can I become a professional lawyer?
(3) Support the Constitution of our country and have good conduct.
(4) Apply for practicing as a lawyer. After one year's internship, you can apply for practicing as a lawyer. After passing the examination by the judicial administrative department, you can issue a lawyer's practice certificate, and then you can become a lawyer in People's Republic of China (PRC).
Applicants for lawyer internship should have full capacity for civil conduct, support the Constitution and laws of our country, have good conduct, and have not received criminal punishment (except for negligent crimes); I apply for an internship with a law firm, and I can only participate in the internship after the law firm agrees and the local lawyers association examines and registers. The intern applicant and the law firm that intends to accept the intern shall sign.
"Internship Agreement", which specifies the internship related matters. Lawyer practice is generally divided into two stages: centralized training and practical training, and the internship period is one year. Centralized training shall be organized by provincial lawyers associations or local lawyers associations with conditions, and the time shall not be less than one month. The contents of centralized training mainly include: socialist concept of rule of law, regulations on the management of lawyers' practice, lawyers' professional ethics and code of practice, lawyers' practical knowledge and skills, etc. After the intensive training, the trainees will be assessed. After passing the examination, the local lawyers association will issue a certificate of completion of intensive training for interns; Those who fail to pass the examination will be arranged by the local lawyers association to participate in the intensive training again, and the time required will not be included in the internship time.
Interns' internship training is arranged by the law firm that receives interns' internships.
A law firm that accepts interns' internship shall, in accordance with the Guiding Principles for the Practice of Lawyers Applicants formulated by all china lawyers association, assign guidance lawyers to guide interns to conduct basic training in lawyer business, and provide necessary conditions and guarantees for interns' internship activities. Interns should abide by lawyers' professional ethics and practice discipline during their internship. If an intern violates the Lawyers Law, lawyers' professional ethics, practice discipline or other relevant provisions,
Give a warning by the municipal lawyers association where the internship is located; If the circumstances are serious, it shall be ordered to stop the internship and withdraw the Lawyer's Practice Certificate.
If an intern terminates the internship agreement without justifiable reasons, or the internship relationship is terminated by a law firm due to violation of the internship agreement, the law firm that receives his internship shall report to the local municipal lawyers association, and the lawyers association shall confiscate his Lawyer's Practice Certificate, and the internship that has been carried out shall be invalid.
After the internship expires, the local lawyers association will assess the interns' mastery of lawyers' professional ethics, basic skills of lawyers' practice, management system of lawyers' practice and moral performance. If the interns pass the examination, the Lawyers Association shall sign the examination opinions on the "Intern Registration Form" as a valid certificate for the interns to apply for a lawyer's practice license.
A person who has passed the internship examination shall apply to the judicial administrative organ for practicing as a lawyer within three years from the date of receiving the notice of passing the examination. The application for more than three years shall be reviewed by the local municipal lawyers association in accordance with the relevant provisions.
For young college students who are new to the legal profession, whether they apply for practice or practice as lawyers after the internship expires, I am afraid they need to rely on law firms to carry out their work. Applying for a more standardized and leading law firm may make your career development more effective.
Generally speaking, the recruitment requirements for lawyer positions in domestic law firms are: bachelor degree or above in law from well-known domestic universities, with domestic or foreign lawyer qualifications; Fluent in English, able to use English as a working language; Serious and responsible, careful, able to work under great pressure. Under the same circumstances, those who have studied abroad are preferred. So you have to make sure that you basically meet the above requirements before you can apply.
Similar to enterprise recruitment, the recruitment process of lawyers in domestic law firms is roughly as follows: publishing recruitment notices → receiving resumes → screening resumes, getting in touch with applicants → organizing written examinations → interviewing → signing contracts.
Therefore, collecting recruitment information and submitting your resume in an appropriate way should be the first step in applying. The average law firm probably needs some time to screen resumes. Written examination and interview will be notified when necessary.
Secondly, take the written test, and there will be an interview after the written test is passed. Generally speaking, foreign written tests are stricter than domestic ones, mainly including:
(1) Translation of legal documents. For example, comments and summaries on contracts, China regulations or China regulations may also be legal statements, which may be translated from Chinese into English or from English into Chinese. English-Chinese translation is not necessarily simple, but probably a long sentence of 4-5 lines. Generally speaking, a good foreign country is not short of translators. You are not required to translate legal documents in the future. This kind of translation ability is the basic requirement for working in a foreign country. If you can't pass this exam, you can't work in the institute. The written test of law firm mainly focuses on the foreign language proficiency test, which is to examine the level of Chinese-English translation. Therefore, we must strengthen our foreign language ability at ordinary times, not simply communication ability, but the ability to master written language and write beautiful legal documents.
(2) professional examinations. Many well-known foreign firms have their own professional directions, many of which are mainly in the direction of international trade. Therefore, before going to the written examination, you must first understand the business scope of the law firm, and then make preparations in this regard. Professional examinations generally appear in the form of cases, which mainly examine candidates' ability to analyze and solve problems. About interviews: Joining a law firm usually requires at least two rounds of interviews. Generally speaking, once hosted by the human resources department, once hosted by the recruitment position supervisor. If necessary, the indirect supervisor of the recruitment position will also interview you. You may also be invited to participate in necessary assessments, such as professional written tests and various ability assessments.
