General Office of Shandong Provincial People's Government 2065438+March 26th, 2009 (this document was published publicly) Full text of the Measures Chapter I General Provisions Article 1 In order to standardize the management of police auxiliary personnel, these Measures are formulated in accordance with relevant laws and regulations, the opinions of the State Council General Office on standardizing the management of police auxiliary personnel in public security organs, and combined with the actual situation of this province, so as to ensure the rational use of police auxiliary forces according to law, safeguard the legitimate rights and interests of police auxiliary personnel and give full play to the auxiliary role of police auxiliary personnel in public security work.
Article 2 The term "auxiliary police" as mentioned in these Measures refers to the staff who perform the duties of auxiliary police as stipulated in these Measures according to law, are included in the employment quota of auxiliary police, and the financial guarantee is included in the fiscal budget at the corresponding level, and are managed and used by the public security organs, and do not have the identity of the people's police. Social forces such as public security joint defense, public security volunteers, village protection teams and school protection teams, as well as personnel engaged in logistics services such as catering, security and cleaning in public security organs, do not belong to police auxiliary personnel.
Article 3 Auxiliary police officers are collectively referred to as auxiliary police officers. According to the nature, characteristics and management needs of auxiliary police, it can be divided into service auxiliary police and civilian auxiliary police.
Article 4 These Measures shall apply to the recruitment, performance, rights, management and protection of auxiliary police within the administrative area of this province. The employment, rights, management and guarantee of auxiliary police who have signed employment contracts shall be implemented in accordance with relevant state regulations. Auxiliary police recruited by means of labor dispatch shall be implemented with reference to these measures. Fifth auxiliary police do not have the qualification for law enforcement, and should carry out auxiliary work under the command and supervision of public security organs and their people's police.
Article 5 The act of auxiliary police assisting the people's police of public security organs to perform their duties according to law is protected by law, and the relevant units and individuals shall cooperate with them, and the consequences of performing their duties shall be borne by the public security organs where they belong. Those who obstruct the auxiliary police from performing their duties according to law or illegally infringe upon the auxiliary police shall be investigated for legal responsibility according to law.
Article 6 The number of auxiliary police recruits in various places shall be adapted to the local social security situation, economic development level, population, geographical area, police force allocation and the actual needs of public security work, and generally shall not exceed the total number of people's policemen in public security organs at the same level. The specific distribution standard is approved by the people's government at the same level.
Article 7 Under the unified leadership of the local people's governments at or above the county level, the public security organs are mainly responsible for the recruitment, management and use of auxiliary police, the Department of Veterans Affairs is mainly responsible for the evaluation of auxiliary police martyrs who meet the conditions of martyrs evaluation after work death, the financial department is mainly responsible for the guarantee of auxiliary police funds, and the human resources and social security departments are mainly responsible for guiding the determination of auxiliary police wages and the implementation of social security work such as industrial injury insurance.

The management of auxiliary police follows the principle of "who uses, who manages and who is responsible".
Article 9 The public security organs of the local people's governments at or above the county level shall define the auxiliary police management institutions of the public security organs at the corresponding level and be responsible for the management of auxiliary police; The employing unit of the public security organ is responsible for the daily management of the auxiliary police.
Chapter II Duties, Rights and Obligations Article 10 The service auxiliary police shall be responsible for assisting the police in law enforcement posts of public security organs to perform law enforcement duties and other police activities. Perform the following duties:
(a) To help prevent and stop illegal and criminal activities;
(two) to assist in public security patrol, public security inspection and safety inspection of personnel gathering places;
(three) to assist in the investigation, blocking, monitoring and detention of criminal suspects;
(four) to help maintain the order of cases (events), protect cases (events), and rescue the injured;
(five) to help ease traffic, discourage and correct traffic safety violations, and collect traffic violation information;
(six) to assist in the registration and dynamic control of drug addicts, the daily management of drug addicts, the inspection of precursor chemicals enterprises, and the public investigation of drugs;
(seven) to assist in the management and supervision of public security;
(eight) to assist in the development of entry-exit management services and border inspection;
(nine) to assist the fire supervision and management;
(ten) to assist in public security, traffic safety, drug control and other publicity and education;
(eleven) to assist in recording the interrogation and interrogation transcripts;
(twelve) to assist in accepting reports, registering cases, accepting evidence, collecting information, mediating and serving documents;
(thirteen) to assist in driving police cars, motorcycles, boats, police planes and other means of transportation; Driving other police auxiliary vehicles independently;
(fourteen) other work that can be assisted by the auxiliary police. Eleventh civilian auxiliary police are responsible for assisting the people's police in non-law enforcement positions of public security organs in administrative management, technical support, police support and other work. Perform the following duties:
(a) to assist the clerical assistant, file management, wiring inquiry, window service, certificate processing, information collection and entry and other administrative work;
(two) to assist in psychological counseling, medical treatment, translation, computer network maintenance, data analysis, software research and development, security monitoring, communication guarantee, fund analysis, non-confidential financial management, laboratory analysis, on-site investigation, inspection and identification and other technical support work;
(three) to assist in the custody and maintenance of police equipment, logistics services and other police security work; (four) other tasks that can be performed by the civilian auxiliary police. Twelfth auxiliary police shall not engage in the following work:
(1) domestic security, technical reconnaissance, anti-cult and anti-terrorism work;
(2) Handling matters involving state secrets;
(three) the case investigation and evidence collection, issue an appraisal report, and identify the responsibility for traffic accidents;
(four) the implementation of criminal compulsory measures;
(5) Making administrative decisions;
(6) Examining cases;
(7) Keeping weapons and police equipment;
(eight) law enforcement alone or in the name of an individual;
(nine) the provisions of laws and regulations must be engaged in the work of the people's police of public security organs.
Thirteenth auxiliary police shall enjoy the following rights according to law:
(a) to obtain the necessary working and labor protection conditions for performing their duties;
(two) to receive wages and enjoy legal benefits and insurance benefits;
(three) to participate in political theory learning and professional knowledge training;
(four) to put forward opinions and suggestions on the work of this unit;
(five) according to the law to deal with complaints against their legitimate rights and interests;
(six) other rights stipulated by laws, regulations and labor contracts.
Article 14 Auxiliary police shall perform the following obligations:
(1) Abide by the Constitution, laws, regulations, rules and the management system of public security organs;
(two) keep state secrets and police work secrets, use the public security information system according to authorization, and ensure the security of the public security information network;
(3) Obeying the management of the public security organ and the command of the people's police of the public security organ, and not carrying out police activities beyond the scope of duties;
(four) civilized duty, dedication, exemplary compliance with social ethics, respect for social customs;
(five) other obligations stipulated by laws, regulations and labor contracts.
Chapter III Recruitment Article 15 The employment plan of auxiliary police shall be put forward by the public security organ of the local people's government at or above the county level according to the relevant provisions of local economic and social development, social security situation and employment quota, and shall be submitted to the people's government at the same level for examination and approval after being compiled at the same level and audited by the financial department.
Article 16 The recruitment of auxiliary police shall be uniformly organized and implemented by the public security organs of the local people's governments at or above the county level within the approved recruitment plan.
Seventeenth recruitment of auxiliary police to take public examination, strict inspection, equal competition, merit-based approach. When recruiting auxiliary police in accordance with the provisions of the preceding paragraph, under the same conditions, priority should be given to recruiting martyrs, spouses and children of public security police and auxiliary police who sacrificed their lives in the line of duty, spouses of serving public security police, retired soldiers, courageous activists and advanced individuals, graduates of public security or political and legal colleges, laid-off workers from state-owned enterprises, and personnel with professional qualifications or skills required for their posts. Eighteenth auxiliary police shall meet the following conditions:
(1) Having China nationality;
(two) support the Constitution of People's Republic of China (PRC), abide by national laws and regulations, and have good conduct;
(three) at least eighteen years of age;
(4) Having a high school education or above and working ability required to perform post responsibilities;
(5) Having the physical and mental conditions to perform their duties normally;
(6) Having other qualifications required for the proposed post. Among them, the civilian auxiliary police should have a college education or above. Special and professional auxiliary police posts may appropriately lower or improve the conditions stipulated in the preceding two paragraphs, but the reasons shall be indicated in the recruitment announcement. Nineteenth any of the following circumstances, shall not be recruited as an auxiliary police:
(a) I or family members or close relatives to participate in illegal organizations, cult organizations or engage in other activities that endanger national security;
(two) my family members or close relatives have been sentenced to punishment, are serving a sentence or are under investigation;
(3) Having received criminal punishment or being suspected of violating the law and crime, which has not been ascertained;
(4) fabricating or spreading theories, lines, principles and policies that are detrimental to the reputation of the country or the opposition party, or violating national laws and regulations;
(5) Having been punished for taking drugs, whoring or gambling;
(six) administrative detention, judicial custody or education;

(8) Having been expelled from public office, army, or dismissed or expelled for violating discipline;
(nine) to engage in police auxiliary work before the expiration of the contract period;
(10) Having a serious personal bad credit record;
(eleven) other people who are not suitable for assisting the police.
Article 20 The recruitment of auxiliary police officers shall be conducted in accordance with the procedures of issuing recruitment announcement, qualification examination, examination and inspection, physical fitness assessment, physical examination, political assessment and publicity. The recruitment organ shall take measures to facilitate citizens to apply for the exam. According to the nature and characteristics of the post, the recruitment procedures stipulated in the preceding paragraph may be simplified or adjusted. For positions with higher professional requirements, other evaluation methods can be adopted.
Article 21 When recruiting auxiliary police, a labor contract or employment contract shall be signed in accordance with the relevant laws and regulations of the state. The conclusion, performance, alteration, dissolution or termination of a labor contract or employment contract shall be implemented in accordance with relevant national laws and regulations. Twenty-second newly recruited auxiliary police shall implement the probation system, and the probation period shall be implemented in accordance with relevant national laws and regulations. If the trial is qualified, the grade shall be determined in accordance with relevant regulations; If the probation period is unqualified, the labor (personnel) relationship shall be terminated or returned to the labor dispatch unit.
Chapter IV Grade Promotion Article 23 Auxiliary police are divided into seven grades, which are Grade I Auxiliary Police, Grade II Auxiliary Police, Grade III Auxiliary Police, Grade I Auxiliary Police, Grade II Auxiliary Police, Grade III Auxiliary Police and Grade IV Auxiliary Police in descending order. Twenty-fourth auxiliary police rank promotion in accordance with the management authority, promotion conditions and procedures. Auxiliary police should have the corresponding ideological and political quality, professional ability, work experience, work performance and annual assessment and other qualifications, and organize their implementation within the approved grade establishment. Twenty-fifth auxiliary police management departments of public security organs at or above the county level shall organize regular grading promotion every year, and the level of auxiliary police shall be promoted step by step in principle. Adhere to the principles of openness, fairness, justice, performance priority and ability. Article 26 The rank of auxiliary police is the basis for determining the salary and other welfare benefits of auxiliary police.
Chapter V Management Article 27 The public security organs of local people's governments at or above the county level shall establish and improve the post responsibilities, education and training, examination and attendance, confidentiality management and other systems of auxiliary police, and strengthen the management of auxiliary police. At the same time, it is necessary to establish and improve the exit mechanism of auxiliary police to ensure smooth export channels.
Article 28 The public security organs of local people's governments at or above the county level shall incorporate the education and training of auxiliary police into the team education and training plan, provide pre-job training, promotion training and professional training for auxiliary police, and improve the quality of auxiliary police. The local people's governments at or above the county level shall be responsible for organizing and implementing the education and training of auxiliary police.
Article 29 Pre-job training is the induction training for newly recruited auxiliary police. The pre-job training time is not less than 15 days, and the training contents mainly include professional ethics, basic business knowledge, basic job skills, basic legal knowledge, working authority of auxiliary police, workflow standards, etc. Focus on cultivating loyalty awareness, service awareness, confidentiality awareness and basic professionalism. After passing the examination, they can be arranged to perform corresponding job responsibilities.
Thirtieth promotion training is the training for the promotion of the first-class auxiliary police. The promotion training time is not less than 7 days. The training content should be set according to the object to be promoted and the work needs, and the comprehensive ability should be improved, which can be combined with business training. Auxiliary police officers who have participated in promotion training can no longer participate in business training in that year. Business training is the training conducted by the police and departments according to the requirements of the auxiliary police. Auxiliary police attend at least 7 days of professional training every year. The training content is set according to the duties of the auxiliary police, mainly including relevant policies and regulations, basic business knowledge, professional skills and physical fitness, psychological and behavioral training, etc. Focus on cultivating professional quality, strengthening knowledge and skills update and improving work ability.
Article 31 The public security organs of local people's governments at or above the county level shall regularly assess the performance, discipline, education and training of auxiliary police.
Thirty-second regular assessment results are divided into four grades: excellent, qualified, basically qualified and unqualified. The assessment results serve as the main basis for the level fluctuation, reward and punishment, renewal of employment, dissolution of labor (personnel) relations or return of labor dispatch units.
Thirty-third auxiliary police in the process of assisting in police work, in any of the following circumstances, should be avoided:
(a) involving my own interests;
(two) involving the interests of my close relatives;
(3) Other activities that may affect the impartial execution of police auxiliary activities. The withdrawal specified in the preceding paragraph shall be decided by the auxiliary police management institution of the public security organ to which it belongs.
Thirty-fourth any unit or individual has the right to complain to the public security organ about the suspected violation of law and discipline by the auxiliary police. The public security organs of the local people's governments at or above the county level shall establish and improve the acceptance and feedback system of complaints and reports, smooth the channels of complaints and reports, and handle complaints and reports to auxiliary police according to law.
