What should the excavator driver do if he breaks the optical cable?

If the Employer hires employees for excavator construction and causes losses, the Employer shall bear the compensation; When employees are engaged in employment activities, they should see the obvious signs of protecting optical cables and fail to pay attention to them. If the optical cables are cut and losses are caused, they shall be jointly and severally liable with the employer for compensation.

According to the provisions of Article 34 of the Tort Liability Law of People's Republic of China (PRC), if the staff of the employing unit causes damage to others due to the performance of their work tasks, they shall bear tort liability.

Article 35 If a labor relationship is formed between individuals, and the party providing labor services causes damage to others due to labor services, the party receiving labor services shall bear tort liability. If the party providing labor services suffers personal injury, it shall bear corresponding responsibilities according to the respective faults of both parties.

According to Code for Line Engineering Design of Optical Cable Transmission System in Long-distance Communication Trunks (People's Republic of China (PRC) Ministry of Information Industry [2003] No.393), the buried depth of optical cable in long-distance trunk lines must be ≥1.2m. If the cable is not buried deep enough, the telecom company should also bear certain responsibilities.

The specific responsibility ratio needs to be judged according to the severity of the accident.

Power facilities belong to the state property, and all units and individuals have the obligation to protect power facilities. If losses are caused by endangering power facilities, compensation shall be made; If the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated according to law.
