Regulations on Autonomy of Tianzhu Tibetan Autonomous County in Gansu Province (revised in 2007)

Article 1 These Regulations are formulated in accordance with the Constitution of People's Republic of China (PRC) and the Law of People's Republic of China (PRC) on Regional National Autonomy, and in combination with the political, economic and cultural characteristics of Tianzhu Tibetan Autonomous County. Article 2 Tianzhu Tibetan Autonomous County (hereinafter referred to as Autonomous County) is a place where Tibetan people practice regional autonomy within Tianzhu administrative area under the jurisdiction of Wuwei City, Gansu Province.

The organs of self-government of Autonomous County are located in Huazang Temple Town. Article 3 The organs of self-government of autonomous counties are the people's congresses and people's governments of autonomous counties.

The organs of self-government of autonomous counties exercise the functions and powers of state organs at the county level in accordance with the Constitution, and at the same time exercise the right of self-government in accordance with the limits of authority prescribed by the Constitution, the Law on Regional National Autonomy and other laws. Article 4 The organs of self-government of Autonomous County lead the people of all ethnic groups in Autonomous County, under the leadership of the Communist Party of China (CPC) and under the guidance of Marxism–Leninism, Mao Zedong Thought, Deng Xiaoping Theory and Theory of Three Represents, adhere to Scientific Outlook on Development, develop the socialist market economy, strengthen the construction of socialist democracy and legal system, accelerate the pace of building a new socialist countryside, strengthen the socialist economic, political, cultural and social construction, and build Autonomous County into a United, civilized, prosperous and harmonious ethnic autonomous area. Article 5 The organs of self-government of autonomous counties must safeguard national unity and ensure the observance and implementation of the Constitution and laws in their local areas.

The organs of self-government of autonomous counties should put the overall interests of the country in the first place and actively complete the tasks assigned by state organs at higher levels. Article 6 The organs of self-government of autonomous counties shall ensure that all ethnic groups in their respective administrative areas enjoy equal rights, consolidate and develop socialist ethnic relations of equality, unity, mutual assistance and harmony, and promote the unity, struggle and prosperity of all ethnic groups. Article 7 The organs of self-government of autonomous counties shall, according to the characteristics and actual needs of the county and without violating the principles of the Constitution and laws, formulate special policies and take flexible measures to accelerate the development of various economic and social undertakings in the county.

If the resolutions, decisions, orders and instructions of the state organs at higher levels are not suitable for the actual situation of the autonomous county, the organs of self-government may report to the state organs at higher levels for approval, implement them flexibly or stop execution. Eighth Autonomous County People's Congress is the local organ of state power in Autonomous County.

The Standing Committee of the Autonomous County People's Congress is the permanent organ of the people's congress, and is responsible for and reports its work to the Autonomous County People's Congress.

In the Autonomous County People's Congress, the number and proportion of Tibetan and other minority representatives shall be determined in accordance with relevant laws and the provisions of the Standing Committee of Gansu Provincial People's Congress.

In the Standing Committee of the Autonomous County People's Congress, there shall be a Tibetan citizen as the director or deputy director. Ninth Autonomous County People's Government is the executive organ of the Autonomous County People's Congress and the local state administrative organ at the corresponding level.

The county magistrate of an autonomous county is a Tibetan citizen.

Other members of the Autonomous County People's Government shall be reasonably equipped with Tibetans and other ethnic minorities. Tenth Autonomous County People's courts and people's procuratorates are responsible for the Autonomous County People's Congress and its Standing Committee and report their work. Autonomous County People's Procuratorate and be responsible to the higher level procuratorate.

There should be Tibetan citizens among the leading members and staff of the people's courts and people's procuratorates of autonomous counties. Eleventh Autonomous County citizens of all nationalities have the right to use their own spoken and written languages in litigation.

Autonomous county people's courts and people's procuratorates choose to use Tibetan or Chinese when trying and handling cases according to actual needs; Translation should be provided for litigants who are not familiar with Tibetan and Chinese languages. The cadres of the departments of the organs of self-government of the twelfth autonomous counties shall be reasonably equipped with Tibetans and other ethnic minorities.

There should be Tibetans among the leading members and staff of other state organs and institutions in Autonomous County. Article 13 The organs of self-government of autonomous counties shall train cadres at all levels and various professional and technical personnel of Tibetans and other ethnic groups in a planned way, and pay attention to training cadres and various professional and technical personnel among minority women.

Autonomous County has a plan to send cadres of all ethnic groups to the developed areas for attachment training, organize all kinds of scientific and technical personnel to study, train and further study in institutions of higher learning and economically developed areas, and improve the quality of cadres, managers and professional and technical personnel. Article 14 State organs and institutions of autonomous counties and enterprises and institutions subordinate to state organs at higher levels within the administrative area of autonomous counties shall give priority to the recruitment of Tibetans and other ethnic minorities in accordance with state regulations.

According to the actual needs of economic and social development, the organs of self-government of autonomous counties take preferential measures to introduce and recruit all kinds of professionals.

Autonomous county to set up a reward fund to reward people who have made outstanding contributions in local construction. Article 15 The organs of self-government of autonomous counties use Tibetan, Tibetan or Chinese when performing their duties.

The seals, plaques and major documents of state organs, enterprises, institutions and people's organizations in Autonomous County shall be written in Tibetan and Chinese. Article 16 The organs of self-government of autonomous counties educate and encourage cadres of all ethnic groups to learn from each other. Han cadres should learn the spoken and written languages of local ethnic minorities, and ethnic minority cadres should learn common Putonghua and standard Chinese while learning and using their own spoken and written languages.
