Provisions of Kunming Municipality on the Administration of Special Motor Vehicles for the Disabled

Chapter I General Provisions Article 1 These Provisions are formulated in accordance with the Regulations of the People's Republic of China on Administrative Penalties for Public Security, the Regulations of the People's Republic of China on Road Traffic Management, the Measures for the Implementation of Road Traffic Management in Yunnan Province and the relevant provisions of the Ministry of Public Security, in combination with the situation of our city. Article 2 The term "special motor vehicles for the disabled" as mentioned in these Provisions refers to the means of transportation that are included in the management of non-motor vehicles and used by the disabled with lower limbs. Article 3 Special motor vehicles for the disabled are only used by people with lower limbs, and it is strictly forbidden to carry passengers and goods or lend them to others, except for a small amount of articles. Article 4 Disabled persons who use special motor vehicles for the disabled shall abide by these Provisions and the laws, regulations and rules related to traffic management, and obey the management of the public security traffic management department. Chapter II Vehicles Article 5 Motor vehicles for the disabled must be inspected by the non-motor vehicle management office of the traffic police detachment of Kunming Public Security Bureau, go through the formalities, and obtain the number plate, driving license and driver's license before driving.

The number plate must be installed in a conspicuous position at the front and rear of the car body and kept intact and clear. Article 6 Persons with disabilities who apply for motor vehicle license plates and driver's licenses for the disabled must be permanent residents within the administrative area of Kunming. Seventh to buy motor vehicles for the disabled, you should apply before buying, otherwise, you will not go through the formalities of settlement. Buyers should apply to the non-motor vehicle management office of the traffic police detachment of Kunming Public Security Bureau with their resident ID card, preferential card for the disabled or disabled certificate for revolutionary soldiers, and physical examination certificate of lower limb disability of Kunming Physical Examination Center, and can purchase only after approval, and go through the settlement formalities at the non-motor vehicle management office of the traffic police detachment of Kunming Public Security Bureau with vehicle certificate, car purchase invoice and third-party liability insurance certificate within 30 days of buying a car. Eighth motor vehicles for the disabled must be listed in the product catalogue managed by the relevant state departments, which meet the safety technical standards and are allowed to be produced and sold. The design speed shall not exceed 20km/h, and the working volume of the cylinder shall be limited to 50cm. Vehicles with a cylinder working volume of more than 50 cubic centimeters do not belong to disabled motor vehicles, and settlement procedures shall not be handled according to disabled motor vehicles.

The purchase and use of mopeds with a cylinder working volume of less than 50 cubic centimeters by people with lower limbs can be included in the management of motor vehicles for the disabled after the rear seats are removed. Ninth special motor vehicles for the disabled must be purchased from approved business units. Without the approval of the Municipal Traffic Police Detachment and the Municipal Administration for Industry and Commerce, no other unit or individual may operate a motor vehicle for the disabled with a cylinder working volume of less than 50 cubic centimeters. Units and individuals that have gone through the business license formalities in the original industrial and commercial registration must go through the examination and approval formalities again. Tenth special motor vehicles for the disabled must be kept in good condition, clean and tidy, and the technical state conforms to the regulations on management and use. The vehicle management authority shall conduct regular inspection every year; Not according to the provisions of the inspection or inspection unqualified, are not allowed to drive on the road. Eleventh disabled motor vehicles are not allowed to be towed or towed by other vehicles. Twelfth transfer, transfer, change, modification, change the body color and other special motor vehicles for the disabled, must go through the examination and approval procedures at the non-motor vehicle management office of the Municipal Traffic Police Detachment. Thirteenth motor vehicles for the disabled are not allowed to transfer ownership or membership in principle. If it is really necessary to transfer ownership or membership, the following conditions must be met in addition to the relevant provisions:

1, transfer at Wuhua and Panlong District of this city;

2. Transfer to other counties outside Wuhua and Panlong;

3. In other counties outside Wuhua and Panlong districts.

Special motor vehicles for the disabled in eight counties of this city shall not be transferred to Wuhua, Panlong, Xishan and Guandu District. Chapter III Drivers Article 14 Drivers of motor vehicles for the disabled must meet the following conditions:

1, lower limb disability;

2. The age is between 16 and 60 years old;

3 binocular vision (or correction) above 0.7, no color blindness, normal hearing, mental illness, disease or other physical defects that can hinder safe driving. Chapter IV Vehicle Driving Article 15 Driving a motor vehicle dedicated to the disabled must comply with the following provisions:

1. When driving a vehicle, you must bring your driving license and driving license;

2. It is not allowed to lend, alter, forge or impersonate the driver's license;

3. Vehicles are not allowed to be driven by people without a driver's license;

4, are not allowed to drive vehicles other than special vehicles for the disabled;

5. Do not drive a disabled motor vehicle without verification or unqualified verification;

6. It is forbidden to drive a vehicle after drinking;

7, are not allowed to drive a disabled motor vehicle with incomplete safety devices or parts failure;

8. Do not smoke or engage in other behaviors that hinder safe driving while driving. Sixteenth special motor vehicles for the disabled shall comply with the following provisions when driving:

1, abide by the relevant provisions of traffic laws, regulations and rules, and obey the inspection and command of traffic police and traffic assistants;

2. On the road where motor vehicles and non-motor vehicles are divided into lanes, driving on non-motor vehicle lanes;

3. Driving on the right side of the road without dividing motor vehicle lanes and non-motor vehicle lanes;

4. The driving speed shall not exceed 20km;

5. Do not compete with motor vehicles;

6, temporary parking must be close to the right side of the road, and shall not interfere with traffic.
