If an employee terminates the labor contract in the original company and goes through the formalities of receiving unemployment benefits, but the new company goes through the social security formalities in time after arriving at the new company, the employee's unemployment benefits can no longer be received. However, the time for receiving unemployment benefits will remain in the employee's social security file and can be collected together next time.

1. Unemployed persons who meet the following conditions receive unemployment insurance benefits from the unemployment insurance fund:

(1) Before unemployment, the employer and I have paid unemployment insurance premiums for one year;

(2) Discontinue employment without my own will;

(3) Those who have registered for unemployment and have job requirements.

2. In the case of re-unemployment, unemployment insurance benefits:

Workers who are unemployed receive unemployment insurance benefits according to regulations. During this period, if the workers are re-employed, they should stop receiving unemployment insurance benefits, start paying unemployment insurance premiums again, and recalculate the payment time. In this way, the actual period for the unemployed to receive unemployment insurance benefits may be less than the longest period that can be received, that is, there will be a remaining period. Workers who are unemployed again after re-employment can receive unemployment insurance benefits according to the recalculated payment time. In addition, if the re-unemployed still have the remaining period of receiving unemployment insurance benefits during the previous unemployment period, according to the provisions of this article, the period of receiving unemployment insurance benefits after re-unemployment can be combined with the period of receiving unemployment insurance benefits from the previous unemployment, but the maximum period of combined calculation shall not exceed 24 months.
