I. Scope and standards of implementation

All construction enterprises that undertake housing construction and municipal infrastructure construction projects within the urban area under the jurisdiction of this Municipality shall pay the construction worker's wage payment deposit (hereinafter referred to as the "deposit") at 3% of the project price. The project price is the construction and installation cost including the main materials, among which the government-invested bidding projects are priced according to the winning bid amount, and the pricing standard for commercial housing development projects is not lower than 1.500 yuan /m2 in principle.

Second, the mode of payment

Before handling the construction permit, the construction enterprise shall pay the deposit to the construction administrative department that issued the construction permit. According to relevant conditions, the deposit can be paid in the form of cash, bank guarantee or guarantee insurance.

(two) within two years before the date of deposit payment, if the construction enterprise has one of the second, third and fourth situations in Item (1) of Article 2, it shall pay the deposit at 4% of the project price.

(3) In the event that Item (1) of Article 2 does not occur, the construction enterprise may choose to pay the deposit in cash, bank guarantee or guarantee insurance:

1. Cash method. For those who choose to pay the deposit in cash, incentive measures such as lowering the deposit and setting the upper limit of the deposit can be implemented.

(1) Within two years from the date of deposit payment, the construction enterprise shall provide valid certificates for projects that meet the following requirements, and the deposit may be reduced or exempted. The following reduction ratios are not cumulative, and each cumulative reduction ratio does not exceed 50%.

(1) If the construction enterprise is awarded in writing by the provincial people's government, ministries and commissions of the State Council and their trade associations, the deposit will be reduced by 40%.

(2) If the construction enterprise is awarded in writing by the municipal (state) people's government, the provincial departments and their industry associations (including the quality, safety, civilized construction and standardized chemical field of the provincial construction system, excluding all kinds of demonstration and observation projects), the deposit will be reduced by 30%.

(3) If the construction enterprise is awarded the honorary title of "Nanchong City Enterprise with Valuable Contract" by Nanchong City Market Supervision Administration and praised in writing by Nanchong City Housing and Urban-Rural Development Bureau (including the honors of quality, safety, civilized construction, standardized industry and strong construction enterprise), the deposit will be reduced by 20%.

(4) Construction enterprises that implement real-name system management, allocate funds separately, and issue funds to special bank accounts, and have no complaints about the wages of construction workers, and are jointly praised by the Municipal Bureau of Human Resources and Social Security and the Municipal Bureau of Housing and Urban-Rural Development, will pay 20% less deposit for new projects.

(5) 30% reduction of the deposit for municipal and above construction qualified enterprises; The second-class construction qualification enterprises in this city pay less than 20% deposit.

(2) For enterprises that actually pay cash deposits in the same deposit supervision department, the maximum payment for a single project is 5 million yuan, and the maximum payment for multiple projects is100000 yuan.

2. Bank guarantee and guarantee insurance.

(1) If the deposit is paid by bank guarantee or guarantee insurance, the policy is paid on demand, and the bank or the insurance department will directly calculate the deposit amount according to the deposit payment standard and calculation method specified in Article 1, and then summarize and feed it back to the project deposit supervision department at the end of each month. The use of bank guarantee and guarantee insurance to pay the deposit does not enjoy incentives such as relief and deposit ceiling.

(2) The bank providing the letter of guarantee shall be the bank where the project is located.

Third, use and return

(1) When the wages of construction workers are in arrears and need to be paid by cash, bank guarantee or guarantee insurance, the cash deposit will be transferred or provided by the cash deposit supervision department, relevant banks or insurance companies within 2 working days after written confirmation by the human society and the housing and construction department, and will be distributed by the general construction contracting enterprise, with on-site supervision by the human society, housing construction and public security departments. If the deposit is insufficient to pay the wages owed to the construction workers, the responsible unit shall raise funds by itself.

(two) after the cash, bank guarantee or guarantee insurance is used passively, the deposit supervision department shall order the construction general contracting enterprise to pay the deposit in cash within 3 months; Responsible enterprises that fail to pay within the specified time will be investigated and dealt with according to the law.

(3) The construction general contracting enterprises that pay the deposit in cash implement real-name system management, separate appropriation, and direct online payment of construction workers' wages for more than three months in a special bank account, and there have been no complaints and reports of arrears of construction workers' wages since the project started. With the approval of the human society and the housing construction department, 50% of the deposit paid can be refunded in advance.

(4) After the completion acceptance of the project is put on record, the construction enterprise will make an announcement at the gate of the project site and the local newspaper (Nanchong Daily or Evening News). If there is no wage arrears 1 month from the date of announcement, the construction enterprise may apply for cash refund or cancellation of bank guarantee and deposit insurance with the approval of the human society and the housing and construction department.

Before the promulgation of these Measures, the enterprises that paid the deposit in cash have not occurred in Item (1) of Article 2 of these Measures within the first two years after the payment of the deposit, and if the deposit is paid more in accordance with the payment standards of these Measures, the excess can be returned to the original paying enterprise.

Fourth, supervision and management.

(1) Arrears the wages of construction workers due to illegal subcontracting, subcontracting, dispute settlement and other reasons. The development and construction enterprise bears the main responsibility. After arbitration and mediation, court judgment or written verification by the housing construction department, the newly implemented construction project shall pay the deposit in full in cash within two years.

(2) If the project has not been completed and accepted for the record, and the validity period of the guarantee and insurance of the deposit has passed, the construction enterprise shall renew the insurance itself one month before the expiration of the guarantee or insurance, re-provide effective bank guarantee and guarantee insurance to the deposit supervision department, or pay the deposit in cash according to the insured amount before the expiration of the guarantee and insurance. If the insurance is not renewed or the deposit is paid in cash within the validity period, the housing, construction and human society departments shall order it to make rectification within a time limit, and if it refuses to make rectification, it shall be dealt with according to the law and regulations.
