Measures for dealing with problems related to social insurance for urban personnel

1. In order to solve the pension and medical problems of urban workers (hereinafter referred to as over-age workers) in this city who have worked in state-owned enterprises, urban collective enterprises, foreign-invested enterprises (hereinafter referred to as enterprises) or state organs and institutions in this city before the implementation of the individual payment system of basic old-age insurance in this city, but have not paid the basic old-age insurance premiums and basic medical insurance premiums, they are now over the working age stipulated by the state. After research and with the consent of the municipal government, over-age workers are allowed. Approved by the administrative department of labor and social security to meet the conditions, in a one-time payment of basic old-age insurance and basic medical insurance, enjoy the corresponding treatment.

2. Over-age persons with urban household registration in this city within the working age stipulated by the state, who have been recruited by enterprises or state organs and institutions (hereinafter referred to as employers) in this city before the implementation of the individual payment system for basic old-age insurance, have reached the continuous length of service or working years 10 years or more stipulated by the state, but have not paid social insurance premiums after the implementation of the individual payment system, and have exceeded the working age stipulated by the state before September 30, 2005 and cannot enjoy the basic old-age insurance benefits, can apply for supplementary payment.

Three, over-age personnel to apply for payment of basic old-age insurance and basic medical insurance, according to the following provisions.

(1) If the files of over-age personnel are stored in the social security office of the street (town) where my account is located, the employment service center of urban and county, the talent service center and the talent service agency entrusted by the municipal labor and social security administrative department, I can submit a written application to the archiving unit and pay the basic old-age insurance premium and basic medical insurance premium.

(II) If the files of over-age personnel are still in the original employer or the superior competent department of the original employer, but there is no factual labor or working relationship with the original employer within the working age, I can submit a written application to the original employer or the superior competent department of the original employer, pay the basic old-age insurance premium and basic medical insurance premium according to these measures, and sign a written agreement with the original employer or the superior competent department of the original employer to handle the payment procedures.

(3) If the files of over-age personnel are still in the original employer or the superior competent department of the original employer, and the relevant living benefits are paid by the original employer or the superior competent department of the original employer, I can submit a written application to the original employer or the superior competent department of the original employer, and pay the basic old-age insurance premium and basic medical insurance premium according to these measures.

(four) when applying for the payment of basic old-age insurance and basic medical insurance, the over-age personnel shall also submit the original and photocopy of their household registration book to the unit that receives their written application.

Four, entrusted to handle social insurance affairs in the streets (towns) social security offices, city and county employment service centers, talent service centers and municipal labor and social security administrative departments, the original employing unit of the over-age personnel or the superior department in charge of the original employing unit shall, after receiving the written application of the over-age personnel, conduct preliminary registration in accordance with Article 2 of these Measures, and fill out the Approval Form for the Over-age Personnel to Pay the Basic Old-age Insurance Fee and the Basic Medical Insurance Fee.

Five, according to these measures, the unit that receives the application for overdue payment of over-age personnel shall report to the administrative department of labor and social security of the district or county within 15 days after receiving the application, and submit the following materials.

(a) the application for overdue payment of basic old-age insurance premiums and basic medical insurance premiums by over-age personnel shall be handled in accordance with the provisions of Item (2) of Article 3 of these Measures, and a written agreement on overdue procedures shall also be submitted;

(two) the original and photocopy of the residence booklet for the over-age personnel;

(three) the "approval form for the payment of basic old-age insurance premiums and basic medical insurance premiums by over-age personnel";

(four) the original and the list of archival materials of the over-age personnel.

Six, the administrative department of labor and social security at the county level shall, within 30 days after receiving the application materials, review whether the materials are complete and meet the payment conditions, fill in the Approval Form for Continuous Length of Service before the employees of enterprises in Beijing pay the basic old-age insurance premium (hereinafter referred to as the Approval Form for Continuous Length of Service), sign the examination opinions, and report the Approval Form for Continuous Length of Service and the materials submitted in accordance with the provisions of Article 5 of these Measures to the municipal labor and social security administrative department.

Seven, the municipal administrative department of labor and social security after receiving the materials declared by the administrative department of labor and social security at the county level, in 15 days to review whether the materials are complete and meet the payment conditions, and sign the examination and approval opinions. The examination and approval opinions and related materials shall be returned according to the original reporting channels, and the unit that receives the application for overdue payment from the over-age personnel will inform the over-age personnel of the examination and approval opinions.

Eight, approved by the municipal administrative department of labor and social security agreed to repay, by accepting the application for overdue units to inform the overage personnel to pay the basic old-age insurance and basic medical insurance premiums in one lump sum, and will pay the overdue fees to the social insurance agencies according to the payment channels.

Nine, the basic old-age insurance and basic medical insurance premiums paid in accordance with the following provisions:

Basic old-age insurance premium. Based on the average salary of employees in this city in the previous year, the five-year basic old-age insurance premium will be paid in one lump sum at the rate of 28%, of which 1 1% will be included in the personal account in one lump sum.

(two) the basic medical insurance premium. Based on the average salary of employees in this city in the above years, the basic medical insurance premium for five years shall be paid in one lump sum according to the payment ratio of 12%. All overdue fees go into the overall fund, excluding personal accounts. After the payment period is combined with the continuous length of service recognized by the administrative department of labor and social security, if the male is less than 25 years and the female is less than 20 years, it should also be paid at the same time according to the principle of "how many months to make up the difference".

Ten, over-age personnel to pay the basic old-age insurance premiums and basic medical insurance premiums in full, since the next month approved by the administrative department of labor and social security, according to the following provisions to enjoy the relevant treatment:

The basic pension consists of the following three parts: monthly payment.

1. The basic pension is calculated and paid at 20% of the average monthly salary of employees in this city in the previous year;

2. Personal account pension is calculated according to1120 of the amount stored in my personal account;

3. The comprehensive subsidy is calculated at 147.5 yuan (149.5 yuan for ethnic minorities who are fasting pork and other ethnic groups who are married to ethnic minorities who are fasting pork).

The previous basic pension will not be reissued.

(2) If the over-age personnel meet the continuous length of service stipulated by the state or the length of service is combined to calculate the payment period, it shall be calculated as the payment period, and the adjustment of their basic pension shall be implemented in accordance with the unified provisions of this Municipality.

The inheritance of personal accounts of over-age personnel shall be carried out in accordance with the relevant provisions of the Measures of Beijing Municipality for Handling Relevant Issues Concerning the Implementation of the Provisions on Endowment Insurance for Enterprise Employees (J.F. [1998] No.69).

(three) from the next month approved by the administrative department of labor and social security, the over-age personnel shall enjoy the basic medical insurance benefits and large medical mutual assistance benefits for retirees in this Municipality. The previous medical expenses will not be reimbursed.

Eleven, over-age personnel to pay the basic old-age insurance premiums and basic medical insurance premiums in full, according to the following provisions for the enjoyment of basic old-age insurance and basic medical insurance benefits and transfer of social management procedures:

(a) the unit that receives the application for overdue payment from the over-age personnel shall apply to the administrative department of labor and social security of the district or county where it is located on a monthly basis for the examination and approval procedures for the over-age personnel to enjoy the basic old-age insurance benefits and basic medical insurance benefits.

(II) The over-age personnel who fall under the circumstances specified in Item (1) of Article 3 of these Measures shall be socialized in accordance with the Notice of Beijing Labor Service Management Center on Issues Related to Standardizing the Procedures for the Transfer of Personnel Files of Retirees from Community Management Enterprises (Jing Lao She Fa [2005]1No.).

(3) The over-age personnel who fall under the circumstances specified in Item (2) of Article 3 of these Measures shall be socialized, and the original employer or the superior competent department of the original employer shall sort out the files according to the provisions of the Notice on Printing and Distributing the Provisions on the Management of Enterprise Employees' Files (Lao Zi [1992] No.33) issued by the former Ministry of Labor and the National Archives Bureau. Fill in the "Beijing enterprise retirees socialized management service file transfer roster form" and the "enterprise retirees file transfer notice", go through the social insurance relationship transfer formalities at the social insurance agency in the district and county where the over-age personnel account is located, and then go through the personnel files and related materials transfer formalities at the social management service agency in the district and county where the over-age personnel account is located. After the implementation of socialized management, over-age personnel only enjoy basic old-age insurance and basic medical insurance benefits.

Twelve, other issues not involved in this approach, according to the relevant provisions of the state and the city.
