Two. Provisions on paternity leave
1. According to the latest maternity leave regulations in Beijing, paternity leave is 15 days. In other words, the maternity leave for men in Beijing is 15 days. First of all, the salary paid by the company during maternity leave and the maternity allowance paid by the Social Security Bureau cannot be enjoyed at the same time. If the unit fails to pay social security, the company will pay wages according to normal attendance during maternity leave. During the vacation of female employees and their spouses, organs, enterprises, institutions, social organizations and other organizations shall not reduce their wages, dismiss or terminate their labor or employment contracts.
2. If the company has paid social security, the company does not need to pay wages to employees during maternity leave, but the company will apply for maternity allowance from the maternity insurance fund with the birth certificate of female employees, and the maternity allowance will be used as the salary of female employees during maternity leave. However, if the base of maternity insurance premium paid by enterprises for employees is lower than the average wage income of female employees in the previous year, the maternity allowance received by female employees will be lower than their wages during normal attendance, and enterprises need to make up the difference.
3. Maternity leave for female employees includes maternity leave time stipulated by the state plus maternity leave time stipulated by the local authorities. For example, maternity leave for female employees in Beijing: 98 days plus 30 days, totaling 128 days. Spouses enjoy 15 days of paternity leave, which of course should be continuous. This is specially prepared to take care of the woman's physical recovery. The current maternity leave in Beijing mainly cancels late maternity leave and increases maternity incentive leave.
